VISTA, Calif. (CNS) - A verdict has been reached in the trial of a woman and her gun instructor who are accused of carrying out a plan to kill the woman's estranged husband.A jury has found Diana Lovejoy, 44, guilty of conspiracy to commit murder and attempted murder. Welcon McDavid Jr. was also found guilty of conspiracy to commit murder, but the reading of the verdict had to be postponed because Lovejoy passed out. Lovejoy and McDavid Jr. were charged with conspiracy to commit murder and attempted murder in the Sept. 1, 2016, attack on 45-year-old Greg Mulvihill, who was wounded in the 11 p.m. shooting in Carlsbad.Police allege Lovejoy and McDavid planned the crime and that the latter - - who worked at a gun range where Lovejoy was taking marksmanship lessons -- called the victim, arranged to meet him in the alley and opened fire on him with a rifle while hiding in a patch of bushes.Court records indicated Lovejoy and Mulvihill were in the midst of a contentious divorce, and that she had obtained a restraining order against him on accusations of emotional and sexual abuse.Mulvihill took the stand during the trial and described the moments leading up to him being shot, saying he didn't realize he'd been shot right away and, at first, he thought he felt something in his back even though he could see the shooter in front of him.Mulvihill testified about a bitter custody battle with his estranged wife.Mulvihill said he went up a remote trail in Carlsbad out of desperation, fearing Lovejoy would reopen their custody battle. He took a friend, a flashlight and a small aluminum baseball bat, but he thought he was picking up documents from a private investigator.Instead, as he approached the spot off Rancho Santa Fe Road and Avenida Soledad, he shined his flashlight around and spotted someone dressed in camouflage pointing a long gun right at him. Before he knew what was happening, Mulvihill said he was hit once in the side, the bullet exiting out his back. McDavid faces 50 years to life behind bars, and Lovejoy could be sentenced to 25 years to life. After court, the jury foreperson, Erin Reed,  told reporters the defense version of the shooting "seemed too far-fetched." 2224

WASHINGTON — Sometimes, politics gives way to the personal at the White House. It has seen 18 weddings and at least 10 people are known to have died there, including two presidents and three first ladies. It will serve Friday as a place of mourning for President Donald Trump and his family with a private memorial service for the president’s younger brother, Robert, who passed away at 71.The president has described Robert as not just his brother but his "best friend.” In an interview Monday, Trump said that he believed his brother would have been "greatly honored" to receive a White House funeral.Anita McBride, who served in three presidential administrations, including as first lady Laura Bush's chief of staff, says it is completely within the president’s ability to honor him with a service there and that the White House serves a complex mission as an office, a museum and a home. 898

VISTA, Calif. (KGTV)- New details are emerging about a weekend murder investigation at a house in Vista. Neighbors tell 10News that a husband was arrested for shooting his wife and the two had a troubled history. A suspect in this case was arrested Saturday night by members of the San Diego Sheriff's Homicide Unit. Deputies report that he has been identified as fifty-seven-year-old Andrew Thomas Smith of Vista and he has been booked for murder at the Vista Detention Facility. He is being held without bail. The victim's family has been notified of her death. Deputies report that she has been positively identified as Jean Moore Smith, a fifty-nine-year-old resident of Vista and she was Andrew’s wife. Neighbor Chris Minster says, “Immediately, Sheriff's deputies screamed, ‘Get in your house now!’” He and other neighbors like Nicole Margulies ran inside their homes on Rancho Vista Road after there were reports of shots fired Saturday inside a neighboring home.Neighbor Chris Minster says, “Immediately, Sheriff's deputies screamed, ‘Get in your house now!’” He and other neighbors like Nicole Margulies ran inside their homes on Rancho Vista Road after there were reports of shots fired Saturday inside a neighboring home.“All of a sudden all these police showed up and [were] running inside with big guns and shotguns,” adds Margulies. The neighborhood was soon wrapped in crimes scene tape as a homicide investigation continued into the night. Deputies say a woman was killed and a man at the house was arrested. According to neighbors, that man was her husband and the father of their adult son who also lives in the home.“The father seemed actually very nice he was very defensive of his wife, despite the abuse and everything,” says Minster. He describes years of verbal abuse that neighbors say the wife directed at her husband and their son. “I would just hear her yelling. She was putting them down, degrading them [and] calling them idiots,” adds Margulies. Neighbors say the adult son may have developmental challenges. Minster saw him just after it all went down. “He had some marks on his face. It looked like maybe [there was] a little bit of blood but it looked like he was definitely attacked in some of the event that happened,” he tells 10News. 2279
