SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash on Camino de la Plaza May 6, 2017.Investigators said Banda ran a stop sign at Dairy Mart Rd. and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.RELATED: Retrial begins for undocumented immigrant in crashDuring Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States 17 times.Immigration and Customs Enforcement officials told 10News if Banda is not tried again (and effectively not convicted) he may or may not be deported.  ICE has requested that he be forwarded to the agency's custody upon any potential release. Banda's release will be subject to the Sheriff's Department under the California Sanctuary Law, ICE officials said. A judge will decide Friday whether a third trial will take place. 1938

SAN DIEGO (KGTV) — A man wielding a metal chain was shot and killed by a two-year veteran of the San Diego Police Department this week, the department announced Saturday.SDPD said 48-year-old Vaugh Harrison Denham, of San Diego, was shot and killed by Officer Corey Pitts after Denham refused to obey officers' orders to drop a machete he had reportedly used to attack someone Wednesday.Police said they arrived at a violent disturbance call involving a "machete-style" weapon in the 4000 block of Boston Ave. just after 5 p.m. Police found a 57-year-old victim with injuries that suggested he'd been attacked with an "edged weapon."ORIGINAL STORY: Police investigating fatal officer-involved shooting in SouthcrestThe victim was taken to a nearby hospital with non-life threatening injuries.At the scene, police tried to contact Denham around the corner from the initial scene. He was uncooperative with officers, police said, and a Taser was deployed after the confrontation escalated.Witness statements indicated Denham approached officers with a metal chain and refused verbal commands to stop by officers. SAN DIEGO (KGTV) — A San Diego couple is doing all they can to bring joy to hundreds of kids living in orphanages and shelters around the county.And despite the pandemic, they have donated thousands of stuffed animals to little ones in need.Charles and Linda van Kessler, with Passion 4 Kids, have donated 5,000 stuffed animals this year to kids in orphanages and shelters around the county."They need so much more and deserve so much better," Linda van Kessler said. "For these kids, it means a lot. It's something that's theirs. Something that gives them unconditional love."More than half of Passion 4 Kids' donations have been delivered in the past month. The couple says the kids cling to their new toys like a security blanket, of sorts."They are just so craving for love and someone to care about them and play with them. Most of the time we end up in tears because it's just so heartbreaking," Linda said.Charles says he knows the power of giving comfort first hand. He spent nearly 10 years in an orphanage in Amsterdam during World War II."I saw my family snatched away for the nazis. So I ended up in a state orphanage for 8 years, of abuse. I ran away and when I came to America I immediately decided to create a charity," Charles van Kessler said.And the pandemic has taken a toll on children. SAN DIEGO (KGTV) — A lifelong San Diego resident says he's sick of seeing overgrown brush in local medians — and he's willing to put himself in the weeds to resolve it.Adam Huntington says the weeds are giving local beach towns a bad look."Great people, great vibes, unfortunately our aesthetics aren't matching up to the great vibes right now," Huntington says. Next to a traffic sign, he says, "the weed was literally growing this high all around this."While some may be used to the weeds sprouting from Mission Blvd. medians, Huntington said he can't ignore the eyesore anymore. "I don't think anyone wants to see their beach look like this when the come to visit it," Huntington said.So the mortgage loan officer has been cleaning up the medians in his spare time. He first uses a weed wacker to cut down the brush, then rakes out the weeds, and finally sweeps and cleans them up. He's been posting his progress on social media. And it's not just Mission Beach.Clairemont Lutheran Church is doing similar work, organizing volunteers to clean up overgrown medians.Huntington has complained to the city and is frustrated with their response. But officials tell us they are trying to make this issue a priority.The mayor's allocated over a million dollars for vegetation and brush abatement in the current fiscal year. With that money the city has cleaned up weeds on 42 miles of median, completing more than 200 requests since July 1. The city blames excessive weed and vegetation growth to the wet winter and spring. Huntington plans to tackle other areas of the city, and says he'd be pleasantly surprised if the city beats him to it. 1646

SAN DIEGO (KGTV) -- A patient who tested positive for novel coronavirus in San Diego County has fully recovered, UC San Diego said Wednesday. The hospital says it was informed of the recovery by the Centers for Disease Control and Prevention. The individual is no longer infectious and was discharged Wednesday. The person is also no longer under federal quarantine or isolation orders. The news comes as the San Diego Board of Supervisors unanimously voted to extend a local public health emergency in response to the virus.
