SAN DIEGO (KGTV) -- Following several years of record-breaking fires around California, the state’s department of insurance is letting residents know they have options if their insurance gets dropped. Under Proposition 103, a law approved by voters in 1988, insurers are required to file rate changes with the California Department of Insurance. Although the department doesn’t set rates, state law requires that insurers’ rates are based on a demonstrated risk of loss. New laws that both took effect in 2019 also offer some protection. One of the laws specifies that homeowners living in a declared wildfire disaster area or adjacent zip codes receive one year of protection from non-renewal. The state also extended protections against non-renewal for people who suffer a total loss during a fire to two automatic renewals or 24 months. If you find yourself in the middle of a non-renewal, the department lists specific rights California residents have: The notice of non-renewal must be sent at least 45 days prior to policy expiration. That notice of non-renewal must contain: (1) the reason or reasons for the non-renewal; (2) the telephone number of the insurer's representatives who handle consumer inquiries or complaints; and (3) a statement indicating that if the consumer has contacted the insurer to discuss the non-renewal and remains unsatisfied, the policyholder may have the matter reviewed by the Department. The insurance company must determine whether to renew or non-renew based upon its underwriting guidelines, which must be objective, have a substantial relationship to the risk of loss, and be applied consistently among insureds in the particular group being non-renewed.For anyone who can’t find insurance, the department has another option. The FAIR plan is available to all homeowners as a last option for coverage. The maximum limit written by the plan on residential property is ,500,000. According to the department, insurance companies use different tools and maps to determine high-risk areas around the state. SAN DIEGO (KGTV) - Following a surge in 911 calls from COVID-19 patients, the County of San Diego is now allowing hospitals to divert ambulances if their emergency rooms are already too full. The County reports that the new protocol was tested last weekend and proved to be successful.The County reports that this new type of diversion goes above and beyond the routine ambulance diversion of only a subset of patients that hospitals use on a regular basis.Hospitals across San Diego that are saturated are now allowed to request total ambulance diversion, meaning ambulances have to stop bringing in more patients. A letter posted this Tuesday from the County's Director of Emergency Medical Services details how the new protocol will help area hospitals recover from the rapid influx of patients.According to the County, “Hospitals on County Ambulance Diversion only accept patients who are so critical that they cannot survive transport to another facility (e.g., cardiac arrest, breathing problems that cannot be managed in the ambulance); thus, nearly all basic and advanced life support (BLS and ALS) ambulances must bypass a hospital on County Ambulance Diversion.”The County reports that a hospital can only implement the diversion in 4-hour blocks which must be approved or initiated by the County.Rob Lawrence with the California Ambulance Association explained Wednesday that this type of diversion allows for decompression. “It allows [hospitals] to get a bit of time to process those patients that have already come into their emergency departments. It also means that ambulances aren't sitting in the parking areas for up to four hours with a patient on board.”He added that it also aids the ambulance services because they can then move patients to hospitals where the wait times are lower. “What that means is [that] they can then return to service quicker which is of course good for the next patient or person that's going to call 911,” he told ABC10 News.According to the County, the new diversion protocol has been implemented by local emergency departments several times over the past few days. 2123

  

SAN DIEGO (KGTV) — For the first time Tuesday, 12-year-old Kiera Latulippe faced the man who killed her entire family in a drunk driving crash. The Valley Center girl was in the car with her family headed to the Austin, Texas, airport after vacation when the drunk driver hit their car head-on. Her father, Scott; mother, Nancy, and 14-year-old brother, Jackson, all died. Kiera was the only one to survive. On Friday, Guy Brasted was sentenced to 18 years in prison. After the sentencing, Kiera and her uncle and legal guardian, Mark Latulippe, took the stand with an emotional message for Brasted. "It made me miss out on so much, like daddy daughter dances," Kiera said, listing the things she can't do now that her family has been ripped away from her. RELATED: Valley Center remembers family killed in DUI crashOn Tuesday, after the pair returned from the sentencing in Texas, Latulippe told 10News, "it was extremely emotional for her having to look at this again and place herself in that car again." Brasted had a blood alcohol level more than double the legal limit at the time of the crash."My brother, Jackson, and I had something I can never have with someone else, and it kills me to know I will never have that feeling with anyone else. Everyday I think about him," Kiera said.Since the accident happened two years ago, Latulippe has taken his niece into his own care."I can't replace, I'm a fill-in parent for someone who has tragically had everything robbed from her in one moment," Latulippe says.Latulippe is a CHP officer for California Highway Patrol. He says he now shares his story to prevent drunk drivers from getting behind the wheel, not only as an officer but now, as a victim. 1713
