SAN DIEGO (KGTV) -- The family of Kimberly Fattorini is suing former San Diego Chargers linebacker Shawne Merriman in connection with her fatal overdose, according to a TMZ Sports report.Fattorini's parents claim Merriman drugged and assaulted their daughter before she died at a house party in 2017, the report says.In a statement, Merriman's representatives said they are unaware of the lawsuit and that the original police investigation found no wrongdoing by the former NFL star.Her parents say Fattorini and her friends were invited to a club promoter's house party, and that Merriman "was allegedly witnessed carrying a bottle with some sort of liquid inside."At some point during the party, she texted the promoter saying, "you friend just poor'd half G in my drink," the lawsuit says. Her "parents believe G refers to GHB," the TMZ report says.Per the report, Fattorini's parents claim that first responders found her unresponsive and "half naked with jeans unzipped and buttoned" at a party in Los Angeles. A preliminary autopsy listed her death caused by a lethal cocktail of alcohol, cocaine, and gamma-hydroxybutyrate -- the last more commonly known as the "date rape" drug GHB.The suit alleges that while her autopsy did not reveal foul play, "a test for sexual assault wasn't done because officials said it wasn't conducted at the time of the initial autopsy, and couldn't be done properly afterward," the report says.The "complaint claims negligence, battery and a violation of the drug dealer liability act," and the Fattorinis are seeking damages, TMZ Sports reports.Merriman's representative told TMZ, "As of right now Shawne, nor his attorney, have any knowledge of him being named in any lawsuit. SAN DIEGO (KGTV) -- The City of San Diego is moving forward with a plan to underground utilities in eight neighborhoods throughout the city. In a meeting Monday, San Diego’s City Council voted to establish underground utility districts. The district's would include the neighborhoods of Otay Mesa-Nestor, San Ysidro, Clairemont Mesa, Encanto, Southeastern/ Skyline-Paradise Hills, College Area, Navajo, and Mid-City: Eastern Area. So far, the City of San Diego has moved roughly 400 miles of utilities underground. RELATED: SDG&E moves 20 miles of power lines undergroundAlthough Monday's meeting marked the first step in the process, the city says construction won’t begin for several more years. In total, the project is estimated to cost more than .2 million, including .5 million for the electrical utility work and .7 for related work, including administration, streetlight replacement, street resurfacing and related work. Recently, the city increased staff to accommodate more undergrounding districts and increase customer service. SAN DIEGO (KGTV) -- The man accused of shooting two people outside a Metallica concert in the Gaslamp, including an off-duty sheriff’s deputy was back in court Tuesday.In July Ray Pitoau had his first trial. He was found guilty of three firearm charges, including felon in possession of a gun.The jury deadlocked when charging him with three counts of assault with a deadly weapon. "When I see the gun it was like okay you know what I mean, just show it to these guys. It be like okay split parts, I run this way they run that way. It be cool," Pitoau said.Pitoau was asked by the defense attorney and prosecutor to recollect the night of August 7, 2017. SAN DIEGO (KGTV) -- The mother of a Cathedral Catholic High School student who sold prescription drugs to minors and marijuana to teenagers pleaded guilty Wednesday.Kimberly Dawn Quach, 49, pleaded guilty to the felony charges, including furnishing Xanax to a minor. Quach now faces between eight and 11 years, eight months in prison.Quach’s live-in companion, William Sipperley III, 50, also pleaded guilty to using a minor to transport marijuana and furnishing to a minor over 14-years-old.RELATED: Mom accused of providing drugs to Cathedral Catholic students  Quach was arrested in 2017 after police said she sold or offered suboxone, an opiate, and Xanax to minors starting in January of 2017.Police also say that Quach gave at least 10 teenagers marijuana to sell, package or transport. Cathedral Catholic students regularly smoked marijuana Sipperley grew at the couples Carmel Valley home.One detective said Quach had as many as 70 teenage clients at the Catholic school and at other schools.During a search of her home, police found large containers of marijuana, plant food, grow lights and drug paraphernalia. SAN DIEGO (KGTV) — The beloved founder of the popular Roberto's Taco Shop chain which began in San Diego died last week, according to the company.Dolores Robledo, 90, died on July 14, the company said in a release. Robledo opened the first Roberto's Taco Shop — and San Diego's first taco shop — with her husband, Roberto, in 1964, according to the company. Prior to that, the couple started their food career providing tortillas to stores and restaurants from their San Ysidro tortilla factory."Since then, Sra. Dolores had been sharing her love for family and authenticity through each meal served," the company said in a release. "She has left the legacy of her love and perseverance. The way she touched lives will remain ongoing. Dolores Robledo will be deeply missed. Please keep her family in your thoughts as they go through this difficult time."Robledo was the mother to 13 children and had 39 grandchildren, 50 great-grandchildren, and 5 great-great-grandchildren. In 1990, Roberto moved to Las Vegas and soon after decided to open his first taco shop in Las Vegas. With the help of her family, Roberto's expanded to 60 locations across California and Nevada.The Roberto's chain is believed to have started the variety of other eateries with the "berto's" suffix in San Diego. It's long-rumored that the famed California Burrito was created at one of these "berto's" shops, but which shop can claim that title continues to be debated.On Instagram, the company continued: "Sra. Dolores Robledo, founder of Roberto's Taco Shop, loved cooking good Mexican food for her family and friends. She and her family expressed that passion by opening their first Roberto's Taco Shop in San Diego in 1964. She will be missed but her legacy of cooking fine Mexican dishes will continue for generations to come."Visitation services for Robledo will be held at 4 p.m. on July 29 at Glen Abbey Memorial Park in Bonita.
