POWAY, Calif. (KGTV) - Family and friends are mourning the tragic death of a man in Poway this weekend. Thirty-eight-year-old Michael Walker died after a stray bullet hit him in the stomach as he slept early Saturday. It happened at the Sofi Apartment complex on Midland Road. Christina Walker said her husband was sleeping in the spare bedroom so his snoring wouldn't wake her. "All of a sudden, I heard this loud thud, and I didn't know what it was, I ran out of bed, I thought he fell and he was just standing there and I don't think he even knew what was happening, but he was just laying there in bed and got shot," said Walker. She said they didn't realize what had happened. "I'm looking and I'm just seeing this hole in his stomach and then I look over and there's a hole in my wall," said Walker. She rushed him to the hospital, but he died around 3 a.m Saturday ."I think we were still just disbelief, really not knowing, you just don't think, we don't have a gun, it's not like either one of us has ever been shot before, you just don't think, why would you think you have a bullet in you?" said Walker. "Until I heard that they got the person, I couldn't even cry until then, not really, and then I just lost it," said Walker.The Walkers were married less than three years. Christina describes her husband a kind and gentle man. "When I say and stress just how amazing he was, he didn't even know how amazing he was, he was always there when somebody needed him, he was very compassionate, he was an incredible human, he just poured out love for me, and I just hope that I was able to give that to him," said Walker.Her husband worked at Jeromes. Poway, Calif., (KGTV)-- The City of Poway's water boil advisory was officially lifted on Friday, but the inconvenience continues for many residents. Tenants of two dozens units at the La Privada Apartments are being evicted suddenly after management discovered rain damage. When it rains, it pours, especially for Poway resident, Allan Moore. "We have a week left," Moore said. "We have to be out by the 15th."Right in the middle of last week's city-wide water boil advisory, he and tenants in 23 other units at the La Privada Apartments were surprised with an eviction notice. It said they must leave the premises and turn in their keys by December 15, 2019. Moore said management explained that the same set of storms that destroyed the city's water system caused the water damage to the units. According to the notice, Moore will get his security deposit, December, and part of November's, rent paid back."I'm very clueless about it right now," Moore said. "And I haven't had hardly any communication."According to law experts, people in Moore's situation do have rights. Laws state that the landlord or property manager must give "reasonable" time for tenants to move out. The specifics of that time frame are in the provisions of the leasing agreement. In Moore's case, the property manager or tenant has the right to terminate a leasing contract if repairs are expected to take longer than 60 days. In this case, management company, Capital Growth Properties, states the repairs could take up to six months. How much assistance the landlord gives, such as finding new or temporary housing, is up to the property manager. Experts told 10News, in some cases, if the management companies own other properties, they may relocate tenants into unaffected, open units. However, Moore says he has not heard of this option from Capital Growth Properties. The rest, such as additional living expenses and food during the inconvenience, is up to their renter's insurance. In the meantime, Moore's house is a mess. "Christmas has kind of been put on hold," Moore sighed. A nutcracker and one sad set of lights are the only signs of the holidays in the usually festive home. "We're just going to have to take it down before Christmas, so we're like, 'let's just stop decorating,'" Moore said. Moore just hopes they find a place soon before they get kicked out. Potential accuracy issues with a widely used coronavirus test could lead to false results for patients, U.S. health officials warned.The Food and Drug Administration issued the alert Monday to doctors and laboratory technicians using Thermo Fisher’s TaqPath genetic test. Regulators said issues related to laboratory equipment and software used to run the test could lead to inaccuracies. The agency advised technicians to follow updated instructions and software developed by the company to ensure accurate results.The warning comes nearly a month after Connecticut public health officials first reported that at least 90 people had received false positive results for the coronavirus. Most of those receiving the false results were residents of nursing homes or assisted living facilities.A spokeswoman for Thermo Fisher said the company was working with FDA “to make sure that laboratory personnel understand the need for strict adherence to the instructions for use.” She added that company data shows most users “follow our workflow properly and obtain accurate results.”The FDA said one possible problem was related to the incorrect use of equipment that rapidly spins samples in preparation for processing. The agency’s letter tells lab workers to follow new instructions developed by the company for this step.A second issue relates to the software used on Thermo Fisher’s testing platform.
