SAN DIEGO (CNS) - A 26-year-old pedestrian was hospitalized this morning with a fractured pelvis and other internal injuries she sustained when she was struck by a 2015 Honda Accord sedan while crossing a street in the Mt. Hope area of San Diego, and the driver was arrested on suspicion of DUI.It occurred at the intersection of Market and Denby streets at 10:35 p.m. Friday as the victim was crossing Market Street legally, but not in a marked crosswalk, according to Sgt. Michael Tansey of the San Diego Police Department.The victim, identified as Ruth James of San Diego, was taken to a hospital with serious, but non-life-threatening injuries, Tansey said.The driver of the Honda, a 40-year-old woman, was jailed on suspicion of felony DUI, he said. SAN CLEMENTE, Calif. (KGTV) - New legal action is being taken over the transfer of nuclear waste at the embattled San Onofre Nuclear Generating Station (SONGS). A lawsuit and motion for a temporary restraining order have been filed in federal court.Public Watchdogs is the nonprofit advocacy group pursuing action against Southern California Edison, San Diego Gas & Electric, Sempra Energy, Holtec International and the U.S. Nuclear Regulatory Commission. Public Watchdogs is asking the courts to order a halt to the storage of nuclear waste at the decommissioned power plant. The nonprofit is alleging, in part, that the storage canisters are defective and could fail, which could cause a deadly nuclear disaster. According to court records, the defendants are creating a major threat by burying nuclear waste next to the ocean, in a tsunami inundation zone, near a fault line and in heavily populated area. The restraining order request claims that once a defective canister is buried, there's no existing method to inspect it unearth it or transfer it. “We're not saying, ‘Stop the decommissioning process.’ We're saying, ‘Put the decommissioning process in perspective and give us a good plan and by the way, protect the environment, too, because this is all we have and we don't get a second chance.’ If there's a Chernobyl here, there's no second chance,” says Public Watchdogs’ attorney, Chuck La Bella.10News contacted all of the defendants on Friday.SDG&E responded with “no comment”.Southern California Edison sent 10News the following statement: “This latest effort by Public Watchdogs runs counter to the expressed interest of the communities adjacent to the San Onofre nuclear plant by potentially stranding spent fuel on site, even when options for transport and off-site storage or disposal become available. SALT LAKE CITY (AP) — A tech worker was charged Wednesday with murder and kidnapping in the death of a Utah college student whose body was found in a wooded area with her arms bound behind her.Prosecutors said Ayoola A. Ajayi, 31, was the last person Mackenzie Lueck communicated with before she disappeared on June 17.She died of blunt force trauma to the head, and her body was found with her arms bound with zip ties and ropes, District Attorney Sim Gill said while announcing the charges.He declined to discuss a motive or the nature of the connection between Lueck and Ajayi. He also didn't say what kind of weapon was used.Gill became emotional as he described the Lueck family's reaction to the charges. "They asked me to express on their behalf the generosity of so many strangers and friends," he said. "They are genuinely appreciative and moved by the outpouring of love and compassion."Lueck disappeared shortly after she returned from a trip to her California hometown for the funeral of her grandmother and took a Lyft from the airport to a park.She exchanged text messages with Ajayi and met him there, apparently willingly, but her phone was turned off a minute after the last text "and never powered back on," Gill said.Police later found the charred phone in the backyard of Ajayi's home in Salt Lake City, along with a bone, muscle tissue and part of Lueck's scalp, Gill said.A neighbor reported a fire and a "horrible smell" coming from the yard on the day Lueck disappeared, Gill said.Her body was later discovered in a shallow grave in Logan Canyon, 85 miles (138 kilometers) from Salt Lake City. The site is near Utah State University, where Ajayi had attended classes.Gill said phone data puts him at the canyon a week after Lueck disappeared. SAN DIEGO (CNS) - A former member of the U.S. national wrestling team, who was severely injured during a training camp exercise held at Camp Pendleton, has filed a lawsuit alleging the Marine Corps and USA Wrestling encouraged him and other civilians to take part in a military-style exercise involving weapons that the participants weren't adequately trained to use.Richard Perry and his wife Gina Cimmino filed the lawsuit Tuesday in San Diego federal court against the United States and Armament Systems and Procedures Inc., a company that manufactured and sold a padded baton used in the exercise that resulted in Perry's injury on Aug. 27, 2018.Perry and another civilian attendee of the training camp were provided batons and helmets with facemasks and given "instruction to strike, thrust and jab at the opponent's head and face to score a `kill shot,"' according to the complaint.As Perry's training partner jabbed with the baton, the weapon passed through a gap in Perry's facemask and shattered his eye socket and skull, pushing shattered bone fragments into his brain, the suit alleges.The injury nearly killed him and left him with multiple traumatic brain injuries, skull fractures and "permanent, disfiguring, disabling injuries" which "will require extensive future medical care, vocational rehabilitation, and life care for the rest of his life," according to his court papers.Perry and the other wrestlers were invited to Camp Pendleton as part of a joint event held by USA Wrestling and the Marine Corps that was partly intended as a Marine Corps recruitment initiative, according to the suit.Perry's attorneys allege National Team members were required to attend the camp, as non-attendance resulted in "adverse consequences, including losing a monetary stipend they otherwise earn as National Team members."The lawsuit alleges the Marine Corps and USA Wrestling "placed Richard Perry and other civilian Camp attendees into a `fight club'-style full- speed, full-contact military weapons training exercise," and that Marine Corps and USA Wrestling members "recklessly encouraged head shots and baton jabs by the inexperienced participants" during the exercise in which Perry was injured.The helmets provided to Perry and other wrestlers were "grossly unsuitable for the baton striking drills and posed a clear risk of serious injury," according to the suit.
