AURORA, Colo. — Three Aurora Police Department officers who were fired last week over their involvement in taking a picture in front of the memorial for Elijah McClain while mocking the chokehold officers used on him before his death, then sending it in a group text, have appealed their dismissals.Officers Erica Marrero and Kyle Dittrich both submitted their appeals on Wednesday, Aurora spokesperson Michael Bryant said. The Aurora Civil Service Commission will next schedule hearing dates within 15 to 30 days, though those hearings could be pushed back if extensions are filed.Marrero and Dittrich were two of the three officers pictured in the photos taken last October. A third officer in the photos, Jaron Jones, resigned last week before he could be fired.And on Thursday evening, Bryant confirmed that a fourth officer involved in a group text in which the photos were sent, Jason Rosenblatt, who was also fired because he responded "ha ha" to the photos, had filed an appeal over his termination.The fired officers had 10 days to file an appeal from last Friday.“It is my prerogative," Aurora’s Interim Police Chief Vanessa Wilson said in announcing last week the terminations. "And the public outcry and demand for justice for Elijah — they don't deserve to wear a badge anymore. I accelerated [the discipline process], and I was able to do that legally and I felt it was the right thing for this community."The photos were taken on Oct. 20, 2019, nearly two months after McClain's violent encounter with police. Dittrich, Marrero and Jones were on duty and had completed a service call in the area where McClain was detained in August.The three officers posed for a selfie, with Dittrich taking the photo and Jones putting his arm around Dittrich's neck, according to department investigative documents released Friday.Dittrich then texted the photo to two officers, Rosenblatt and Nathan Woodyard, who was also involved in the original McClain incident.Woodyard did not respond and deleted the photo, Wilson said. Woodyard was not disciplined in the incident.Rosenblatt responded, "ha ha," according to the investigation.McClain, 23, was unarmed when he was encountered by Aurora police on Aug. 24, 2019. Police put McClain in a carotid hold, which limits blood flow to the brain, after stopping him while he was walking home. When he became unresponsive, paramedics gave him ketamine, police have said.McClain had a heart attack and died six days later.The officers involved in McClain's death were not arrested or charged, despite continued calls for justice from McClain's family and supporters.In June, as McClain's death garnered national interest, Gov. As parents are deciding whether to purchase Halloween costumes for their children amid the coronavirus pandemic, one Ohio man is ready to safely welcome trick or treaters to his home.Andrew Beattie has installed a 6-foot chute for candy so he can remain distanced from trick or treaters on Beggars’ Night.Beattie says that the chute will be “touch-free” as children will have the treats drop into their candy bucket without having to come in contact with Beattie. For added safety, Beattie says that he will wear a mask and continually change gloves in order to keep children safe.“I want our youngins to be able to have some sense of normalcy and maybe a little bit of exercise in all this madness, and I've put a LOT of thought into how to do so safely, and I appreciate your concern,” Beattie said in a viral Facebook post published earlier this week.Beattie said the chute is a six-foot long tube of cardboard that is four inches in diameter. He said he was able to install the chute on his porch in 20 minutes.“If this candy chute makes things easier or safer, AND gives those with mobility challenges more of a chance to participate, then what's the harm? An ounce of prevention is worth a pound of cure, ya' know,” Beattie wrote.Beattie has created a Facebook group where he hopes to share ideas with others this fall ahead of Halloween. ATLANTA (AP) — A federal judge is permanently blocking Georgia’s 2019 “heartbeat" abortion law, finding that it violates the U.S. Constitution.U.S. District Judge Steve Jones ruled against the state Monday in a lawsuit filed by abortion providers and an advocacy group.Jones had temporarily blocked the law in October, and it never went into effect.The new ruling permanently enjoins the state from ever enforcing House Bill 481.The measure sought to ban abortions once a “detectable human heartbeat” was present, with some limited exceptions.Cardiac activity can be detected by ultrasound as early as six weeks into a pregnancy.Jones found the law violated the 14th Amendment. 685

AURORA, Colo. — Police detained and handcuffed a Black mother and four children after mistaking their SUV for a stolen motorcycle from another state.It happened in the parking lot of a shopping center off of Buckley Road and East Iliff Ave. Sunday morning."Why are you now placing these children on the ground face into the concrete? It's hot! In front of all of us? Screaming at them. They are telling you they are hurt," witness Jenni Wurtz said.Wurtz recorded the incident along with several other witnesses.She says a police car slowly pulled behind the family. The officer drew their weapon on the family and ordered them out of the car. Several of the children were handcuffed."That makes me very mad because I am not anti-police. I'm anti- what happened yesterday, and that was ridiculous," Wurtz said.The car the family was driving was not stolen. Police used a license plate scanner to gather information on vehicles in the area. They should have been looking for a motorcycle with the same plate from another state.Interim Aurora Police Chief Vanessa Wilson blamed the license plate reader, but could not explain why the dozens of officers who responded did not confirm the vehicle description."I totally understand that anger, and don't want to diminish that anger, but I will say it wasn't a profiling incident. It was a hit that came through the system, and they have a picture of the vehicle the officers saw," Wilson said, defending her officers' actions.After officers realized the mistake, the family was uncuffed, but more officers continued to arrive. Video shows more than a dozen officers standing around the traumatized family."I do not think a stolen vehicle is worth traumatizing the lives of children. On top of that, I was 20-feet away with a drawn gun. They didn't even tell me to move, secure the scene. They didn't do anything," Wurtz said.Wurtz filed a complaint with internal affairs. She believes the police department's policy needs to change.By Monday evening, an internal investigation was underway following the incident, according to Wilson. She released the following statement on Monday."We first want to offer our apologies to the family involved in the traumatic incident involving a police stop of their vehicle yesterday. We have been training our officers that when they contact a suspected stolen car, they should do what is called a high-risk stop. This involves drawing their weapons and ordering all occupants to exit the car and lie prone on the ground. But we must allow our officers to have discretion and to deviate from this process when different scenarios present themselves. I have already directed my team to look at new practices and training. I have called the family to apologize and to offer any help we can provide, especially for the children who may have been traumatized by yesterday's events. I have reached out to our victim advocates so we can offer age-appropriate therapy that the city will cover."Sunday's incident comes as the Aurora Police Department faces continued criticism over its handling of the death of Elijah McClain.
