SAN DIEGO (KGTV) -- An Escondido man who pleaded guilty to firing several rounds into the air in a crowded area when he couldn't get tickets to an Ice Cube concert was sentenced to three years behind bars Wednesday. Daniel Elizarraras, 22, pleaded guilty to discharging a gun at the Del Mar Fairgrounds in early September of 2018. Authorities say Elizarraras raised the gun before shooting into the air while he was in a large crowd near the ticket booth. Elizarraras was shot three times in the torso and once in the arm after he pointed the gun at a deputy. RELATED: Man admits he opened fire before Ice Cube concert at Del Mar FairgroundsElizarraras was facing up to 19 years behind bars, but a charge of assault on a peace officer with a semi-automatic weapon was dismissed as part of his plea. Defense Attorney Pedro Bernal said Elizarraras was severely depressed and trying to kill himself by suicide by cop. They asked for a lower sentence. However, the prosecution said he acted violently, causing chaos, and the situation could have been much worse.Judge Kathleen Lewis agreed saying, "I think it’s amazing that no one was injured or killed in this circumstance.”Before the shooting, officials said the venue was at capacity and began turning people away from the horse races and concert. Fights erupted between security guards and would-be concert-goers who were upset that they wouldn’t be allowed into the show. That’s when the deputy pulled out his Taser, which was ineffective. Authorities say Eikermann pulled out his gun and shot Elizarraras four times. City News Service contributed to this report. 1851

Under the terms of the sale, Kings & Convicts will acquire the Ballast Point brand and its various production facilities and brewpubs, including its Downtown Disney, Long Beach, Miramar, and Little Italy locations, and its newest brewpub in Chicago.RELATED: San Diego craft beer study shows craft brewery, economic impact growthThe new owner will also acquire Ballast Point's original homebrewing supply and tasting room in Linda Vista.Kings & Convicts said it plans to keep Ballast Point's existing workforce, or about 560 employees, and to add a sales and marketing workforce.“We’re excited to welcome the team at Ballast Point into the Kings & Convicts family,” said Brendan Watters, Kings & Convicts’ chief executive officer. “We have long admired the quality and spirit of Ballast Point’s brands and team. Ballast Point’s best-in-class brewing standards will remain unchanged, delivering the same high-quality, award-winning products the company has become known for over the years."RELATED: Museum of Beer planned to open in San Diego's East VillageThe sale is expected to close by the end of the 2020 fiscal year.Craft beer fans will remember when Constellation Brands shelled out about billion to buy Ballast Point in 2015, a move intended to position the company well in the quickly-growing craft beer market.Since the purchase, Constellation Brands CEO Bill Newlands says the craft beer market has "shifted dramatically."“Trends in the U.S. craft beer segment have shifted dramatically since our acquisition of Ballast Point,” said Newlands. “Ballast Point remains one of the most iconic craft beer brands in the country and we’re pleased to transition the business to an owner that can devote the resources needed to fuel its future success.”Newlands added that the sale allows Constellation to focus on its other brands and upcoming products, pointing specifically to a Corona-branded hard seltzer. 2205

SAN DIEGO (KGTV) — A surveillance system caught a man breaking into a College Area Thai Restaurant and stealing hundreds of dollars in cash and tech equipment. 10News met with Chira Svangvitaya, owner of "Sala Thai." She has been serving dishes from her homeland to the San Diego community for almost 30 years. But when she opened the store on Halloween morning, she found her store in shambles. “I saw all the things all over the floor," Svangvitaya said. MAP: Track crime happening in your neighborhoodHer surveillance cameras captured the break-in just before 7 a.m.  A man crept in through the back door, ran through the dining area while pulling up his hood, then headed straight to the front counter. He took 0 in cash, five tablets, and a laptop before tiptoeing out the back door. "He was like a pro," she said. “In and out in less than five minutes.”While the stolen money was substantial, the absence of the tablets hurt her most.“I have Uber Eats. Grub Hub, Postmates, Door Dash, Amazon, and Yelp," she said. She said 30 percent of her sales come solely from deliveries, which means she is losing out on a lot of customers. But she said there is a silver lining to this. What the thief may not know, is that the tablets' only function is food delivery. The resale value is unsubstantial. They all come with serial numbers, which she hopes the police and delivery companies use to track them and the thief down. “I just want them [the police] to catch the guy. I don’t want him to do it to other business, you know? It’s painful," Svangvitaya said.If you recognize the man, call San Diego Crime Stoppers at 888-580-8477. 1690

SAN DIEGO (KGTV) - A teen in San Diego has written a children's book, which she hopes can help in the fight against cancer.Sophia Namazy, 14, wrote "Pigtails, Ponytails, and Fairytales" after seeing her little sister wake up every morning with messy hair. In the book, a pair of fairies come at night and play with it. Sophia says it's loosely based on her sister, Poppy."Her hair was really crazy and frizzy in the morning," says Sophia. "So every morning it would be like that, and I would sketch about it. And I thought I might as well make it into a book."Now that it's published, she's decided to donate all the money from sales to the Dana Farber Cancer Institute in Boston.Namazy picked that location because it's where her twin brother, Max, goes every year for treatment.Max has a rare blood disorder called Schwachman-Diamond syndrome. His body doesn't produce enough white blood cells."I want other kids to know they're not alone, and they're not going through this alone," Sophia says."I'm really proud of Sophia, writing a book," says Max. "It just makes me happy that she's writing a book for me, to me, and helping support the cancer institute."Their mother, Jennifer Namazy, says the book has helped the family support each other."It's very emotional, but it really helps us all think about how a medical disorder in a family can affect everybody," she says. "We're taking what could be negative and making it a positive and helping other kids. That is really the most important message."The book is available on Amazon. 1545
