SAN DIEGO (KGTV) -- A man died Sunday morning after California Highway Patrol says his car flipped over before slamming into a tree in National City. According to CHP, the crash happened around 3 a.m. on I-805 south near Plaza Boulevard. Officers say the vehicle was speeding when the driver lost control and flipped several times before hitting the tree. The crash was the second deadly collision on the 805 south in two days. Saturday morning, a wrong-way driver crashed into another vehicle on I-805 south near the I-8 connector. According to CHP, both drivers were taken to the hospital with life-threatening injuries. The wrong-way driver later died at the hospital. 832

SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

SAN DIEGO (KGTV) -- A Marine killed in a motorcycle crash on I-15 Friday has been identified as 21-year-old Logan Parkhurst.The crash happened in the southbound lanes of Interstate 15 near Miramar Way just after 6:30 a.m.According to the California Highway Patrol, Parkhurst hit the back of a Toyota while attempting to exit onto Miramar Way, causing him to be ejected. SAN DIEGO (KGTV) - A San Diego company is looking to capitalize on a new law that legalizes the growing of hemp in the United States. Medical Marijuana Inc., based in Sorrento Valley, already has a line of CBD products but has to import the raw hemp from outside the United States. That will soon change. On Tuesday, President Donald Trump signed the 2018 Farm Bill. Inside the bi-partisan, 7 billion bill was a revision to the federal laws on hemp, which had largely outlawed commercial production since the 1930s. The bill also removed hemp from being classified as a schedule 1 drug, the DEA category for substances with “no currently accepted medical use and a high potential for abuse.” “We really think this is going to be a tremendous growth market over the next three to five years,” said Stuart Titus, president and CEO of Medical Marijuana Inc. Founded in 2009, the company has several lines of CBD-based products for both humans and animals. Duncan Hunter’s attorney to the United States Deputy Attorney General discussed possible evidence of extramarital infidelity and excessive drinking.On August 6, Hunter attorney Gregory A. Vega wrote to Rod Rosenstein at the Department of Justice requesting the postponement of this week's campaign fund misuse indictment, and addressed “an overly aggressive prosecution intent on criminalizing content that is civil in nature”.“While there may be evidence of infidelity, irresponsibility, or alcohol dependence, once properly understood, the underlying facts do not equate to criminal activity; these allegations are, however, intended to embarrass and humiliate the Congressman shortly before a crucial election, and also to alienate him from his wife, the only other person under investigation and his intended co-defendant,” wrote Vega.Prosecutors allege the Hunters used more than 0,000 in campaign funds to support a lavish lifestyle and reported the purchases as campaign expenses.The affidavit detailed money spent on hotel rooms for different individuals and various social outings, including one involving 30 shots of tequila.
