ROCHESTER, N.Y. -- The Chief of the Rochester Police Department has announced he is retiring after consecutive nights of protests and amid an investigation into the death of Daniel Prude, who died after being restrained by police in March."As a man of integrity, I will not sit idly by while outside entities attempt to destroy my character," Chief La'Ron D. Singletary wrote in a statement obtained by WXXI and WHAM. "The mischaracterization and the politicization of the actions that I took after being informed of Mr. Prude's death is not based on facts, and is not what I stand for."Deputy Chief Joseph Morabito also announced his retirement and said serving with the department was his "extreme honor."The city's mayor, Lovely Warren, said in a city council briefing that there could possibly be other senior commanders retiring from the department, The Associated Press reports.Rochester has been in the national spotlight after police body camera video was released last week, which shows police putting a spit mask over Daniel Prude's face, and holding him down in an effort to subdue him. Prude died of asphyxiation.Since the video's release, seven police officers have been suspended and the New York Attorney General's Office has begun an investigation into Prude's death. On Saturday, Attorney General Letitia James announced she will empanel a grand jury as part of her probe.Many citizens have been calling for the resignation of both Singletary and Rochester's Mayor, Lovely Warren, within 24 hours following the video of Prude's death becoming public.Warren has said that she was originally told Prude died from an apparent overdose, and that it wasn't until August 4 that she saw the footage of Prude being detained.Warren has since publicly pledged overhauls of police practices.For several consecutive nights, protests have erupted through Rochester. Last Friday, upwards of 2,000 people marched through the streets. Gavin Newsom in his first pardons since taking office in January.Newsom pardoned Kang Hen, of San Jose, who pleaded guilty to being the getaway driver during an attempted armed robbery in 1994. Hen, who was brought to the U.S. when he was 9, surrendered to immigration authorities April 1 after he was notified he was wanted for deportation.The governor, a Democrat, also issued a pardon for Hay Hov, of Oakland, who was convicted of solicitation to commit murder and participation in a street gang in 2001.Hov, a naturalized citizen, was taken into custody by immigration officials in March.Both men immigrated to the U.S. lawfully as children. They petitioned Newsom for pardons, saying they have moved past their troubled youth to become respectable men with jobs and families.Pardons don't automatically halt deportation proceedings, but they eliminate the criminal conviction judges often base their decisions on, according to the governor's office.In Hen's case, a pardon may eventually allow him to stay in the U.S. Hov, whose green card was recently re-instated by a judge, is no longer at risk of deportation."Both men have young children, are the primary income provider for their families, and provide care to relatives living with chronic health conditions," the governor's office said in a statement. "Their deportation would be an unjust collateral consequence that would harm their families and communities."The pardons are a rebuke to President Donald Trump's administration, which has cracked down on immigrants who committed crimes. Since Trump took office, a large number of people have been detained and deported to Cambodia, according to advocates.Newsom's predecessor, Gov. Jerry Brown, pardoned five Cambodian refugees who faced deportation last year.Newsom on Monday also pardoned five other people who had convictions more than 15 years old — including business owners, students and at least one grandparent, the governor's office said. RMH Franchise Holdings, a company that operates a number of Applebee's restaurants, announced this week that customers who used credit cards at some locations may have been subject to a data breach. "Upon learning of a potential incident, RMH promptly launched an investigation and obtained the help of leading cyber security forensics firms," the company said in a statement. "Based on the experts’ investigation, RMH believes that unauthorized software placed on the point-of-sale system at certain RMH-owned and -operated Applebee’s restaurants was designed to capture payment card information and may have affected a limited number of purchases made at those locations."The company said that customers’ names, credit or debit card numbers, expiration dates and card verification codes were subject to the breach. Customers who used Applebee's tabletop payment system, or its online ordering system were not subject to the breach.RMH said that customers should closely monitor their payment card statements, and check for any unauthorized transactions. If customers notice any unauthorized transactions, they should contact their bank.RMH said that it learned of the incident on February 13, and has since contacted law enforcement. "RMH is continuing to closely monitor its systems and review its security measures to help prevent something like this from happening again," the company said. The company did not say why it waited three weeks before notifying the public. Many of the affected transactions took place from December 6 through January 2.
