NASHVILLE, Tenn. — Joseph Webster was in his 20s when he was convicted for a first-degree murder he didn't commit. At 41 years old, the father of four is readjusting to his newly granted freedom.Webster was released on Tuesday after a Davidson County judge ruled to vacate his murder conviction. New DNA evidence and key witnesses with different accounts of the incident helped solidify the decision.It's the first time a person was exonerated of murder because of his innocence in Nashville, according to attorney Daniel Horwitz."It's unbelievable but believable," Webster said. "The truth will set you free. I just didn't know when."Webster was sentenced to life in prison 15 years ago for the beating death of Leroy Owens in 1998. Horwitz helped uncover new evidence alongside the Davidson County Criminal Review Unit that points to a different suspect.Webster always maintained his innocence and never wavered from his hope that one day he'd get out of prison."It's a rare entity within the district attorney's office. Wrongful convictions are fairly rare, but they do occur," Horwitz said.In early 2019, Davidson County District Attorney Glenn Funk said he would reopen the case after new testing revealed that Webster's DNA was not found on the murder weapon. The only witness in the case allegedly changed her story several times, and at times the testimony pointed to a different suspect.In late October, Webster's attorney announced that Funk had vacated his sentence after a reinvestigation by the Conviction Review board, which cleared the way for Webster's possible release."The Conviction Review Unit no longer has confidence in the conviction of Mr. Webster," the motion stated. "We recommend Mr. Webster's conviction be vacated and the charges against him dismissed."With the victim's family in the courtroom, the state said there was no other option but to free Webster.Seconds after he could walk free, Webster's mother and children swarmed him with hugs and tears. He said he's been laying low and hanging out with loved ones who helped keep his strength over the years.Webster said there are others in his position without a support system. He eventually wants to his use experience to speak to teenagers about life in prison and to stay out of trouble.In the meantime, he wants to reconnect with society and heal from years of emotional, mental and physical stress."I just want to see the other side, and I just want to be happy and enjoy life," he said.He spent part of his day Thursday trying to get a driver's license with his attorney. Webster wants to rent his own apartment, get a commercial driver's license, and start a trucking business with his children.Horwitz said there are currently no plans to pursue restitution, but he has started a GoFundMe to help raise money for Webster.Money raised above the goal will be donated to the Innocence Project. MILWAUKEE — Surveillance video captured two porch pirates on a casual morning stroll. But what they don't know is that the owner of the package they're about to steal actually wants it to get taken. "Usually I get very mad when I see the package get stolen, but now this one I was like proud to show the video," said Jamie, who left a package of sweet revenge on her Milwaukee porch.Out of fear of retaliation, Jamie asked that her identity be concealed and to only use her first name. She says they've had about eight packages stolen from their front porch and have tried everything to fight back. They installed security cameras, asked for signed deliveries and even had items placed behind a fence. But somehow the thieves continued to be successful. Eventually, they decided to have everything delivered to work, but after a gift sent to her a month ago was stolen as well, she decided that was enough. "That's when we ordered the next package," she said. "We went on to a website that does anonymous deliveries and you can pick from all sorts of different fecal matter. The cheapest one is cow, we decided to go in full blast and we chose gorilla." The thieves didn't like what they had scooped up, and ended up tossing the item into a neighbor's yard. But they aren't the only thieves she's caught on camera. Video also shows a woman stealing that gift someone sent Jamie, that contained memorial stickers honoring her late father. "She threw it because it wasn't anything important to her but to me that was the most important package that had been taken off our porch," said Jamie. A neighbor ended up finding the discarded stickers in a nearby park. Jamie says she's tried to report the thefts to police, but she's been told it's a lost cause and the chances of catching these criminals are slim. So she hopes a little package payback will prevent thefts in the future. "We do live in a nice neighborhood," she said. "It's a nice a street, they're nice neighbors, we just don't know why it keeps happening to us."  2106

MILWAUKEE — Jacob Blake is out of the hospital and in a rehabilitation center, his attorney says.Blake was in Froedtert Hospital since Aug. 23, when Kenosha Police Officer Rusten Sheskey fired seven rounds into Blake's back.Blake's attorney declined to say when exactly Blake left the hospital, or how long he is expected to remain at the rehabilitation center. Blake's family said he had been paralyzed from the waist down. It appears his condition has improved somewhat, as he is now recovering in an unidentified rehabilitation center.Blake was initially handcuffed to his hospital bed after the shooting. Police said at the time that the handcuffs were necessary because Blake still had an outstanding warrant on him. After he posted bond and with the help of local lawmakers, the handcuffs were removed, and the police officers guarding his door left.Officer Sheskey has not been charged in the shooting. Sheskey's attorney says the officer believed at the time that Blake may have been trying to drive off with a woman's child.On August 23, Officers were initially called to a domestic incident. There, they attempted to arrest Blake on an outstanding warrant for third degree sexual assault charges. Blake tried to get into his car, when the officer fired his service gun into Blake's back.The shooting quickly became national news as protests erupted in Kenosha and across the U.S.After a few nights of demonstrations in Kenosha, a 17-year-old man opened fire on the crowd, hitting three people. Two people died and the third was taken to the hospital. The teen, Kyle Rittenhouse, was arrested at his home in Illinois and he is now facing extradition to Wisconsin and charges in the shooting deaths.
