SAN DIEGO (KGTV) -- On January 1, it will be legal for businesses to sell pot in California. With that, the questions and concerns about what that means for drivers out on the roads.“I think we will see an increase in DUI marijuana’s,” said Officer John Perdue, a San Diego Police officer in the traffic division.Perdue is an expert at DUI and drug recognition. Since November 8, 2016, when California voters approved Prop. 64, or the adult use of marijuana act, he’s been hearing the same thing when he comes across drivers he suspects are driving high.“Their first reaction is one of two, either A. ‘I have a medical marijuana card’, or B. ‘marijuana is legal.’ And I have to remind them, so is alcohol, but you still can’t drive under the influence of it,” Perdue said.How exactly will police be able to tell if someone is driving high?One tool that officers will use to help is the Drager Drugtest 5000, a presumptive drug screening test that can detect seven types of drugs in a person’s system.Like an alcohol breathalyzer, Perdue said, “the person has every right to refuse this.” But unlike alcohol, it doesn’t have a percent limit.If the Drager reads positive, Perdue said, “it doesn’t necessarily mean they’re impaired or under the influence, it just says that chemical or drug is in their body.”  So to be arrested for DUI, it’s still up to the officer to decide if the driver shows impairment.But that can be tough. Look at the Drager as an extra tool that’s used along with field sobriety tests, what an officer smells, sees or finds in the car, to formulate that officer’s opinion of whether a driver is high.“The hardest thing will be, because there is no per se limit right now, the officers are really going to have to be aware of the signs and symptoms,” Perdue said. 1808

SAN DIEGO (KGTV) — One man has died after a hit-and-run outside Sharp Memorial Hospital in Kearny Mesa, after he had reportedly been discharged from the hospital.San Diego Police said a 61-year-old man was in the southbound land in the 3000 block of Health Center Dr. when they were hit by an unknown vehicle just after 5:30 p.m. The vehicle fled the scene after hitting the man, SDPD said.The man was taken to the hospital, where he died.Police told ABC 10News at the scene that the man had reportedly just been discharged from the hospital before he was hit by the vehicle.SDPD Traffic Division was investigating the collision. The victim's name was not immediately released.Health Center Dr. and Frost St. were closed following the hit-and-run for investigators. 773

SAN DIEGO (KGTV) - Parents rallied at Poway Unified District Headquarters during their monthly board meeting, asking them to pause on proposed plans to bring a Costco to land zoned to build a school.The vacant lot is at the corner of Camino Del Sur and Carmel Valley Road and was labeled a surplus by the Poway Unified School District.That means they don't need it and believe they have enough schools in the area.Parent Gianni Nguyen said that's not true, "in our particular area the schools are impacted, so no."Nguyen said she doesn't mind the idea of creating mixed use retail, restaurants and a Costco, but she was angered by the process the board went through to get the deal."I felt like we were just robbed... We just want to be part of that process, bring us to the table, give us a voice, let us share with you what our opinions are," she said.The board voted unanimously at their September meeting to pursue a long term lease with Costco, that spans decades. Nguyen said the community was blindsided."I have four kids in the public school district, four young kids, my oldest is only 12, so I am very passionate about this," she said looking away.She hopes the rally makes the board pause and reconsider moving forward on this deal.Nguyen added, "we're going to unite and say we do have a voice and there should be a choice and you guys should be in there to represent us and if you're not representing us, who are you representing?"The deal was not on the agenda Thursday. 1493

SAN DIEGO (KGTV) -- Police are searching for a suspect who shot a man in City Heights Wednesday afternoon.According to San Diego Police, the man was shot in the back at the intersection of Fairmont Avenue and Thorn Street near Clark Middle School and Manzanita Canyon.The shooter left the area with two other men, according to San Diego Police officer Billy Hernandez. The three were described as Asian men, one in a white shirt with the letters "SD" on it in red printing, the others in black shirts, Hernandez said.Police shut down traffic near the shooting scene and searched the area with a helicopter and ground crews. Officers found a gun possibly connected to the case in an alley. There was no sign of the shooter.Paramedics took the shooting victim to the hospital. SAN DIEGO (KGTV) -- Photos captured along the shores of San Diego show the return of a bioluminescent glow cause by a phenomenon known as the red tide. Pictures posted on social media show the eerie neon glow. According to several San Diego photographers who captured the phenomenon, the bioluminescence was captured along the shores of La Jolla and Torrey Pines State Beach Wednesday night. The glow is created by an algae bloom called the red tide. The algae bloom is filled with phytoplankton called "dinoflagellates.” The organisms react with bioluminescence when jostled by the moving water. "Where the wave crashes onto the shore, as it rolls over that’s where the turbulence is highest," said Clarissa Anderson at The Scripps Instutition of Oceanography. "That’s why those are really bright stripes of light. We don’t know the exact smoking gun yet. It’s unclear exactly how long this year’s red tide will last; however, an algae bloom in September of 2013 lasted a week and a bloom in October of 2011 lasted a month, researchers say.According to the Scripps Institution of Oceanography, the red color of the tide is due to the high number of organisms in the water. 1389
