SAN DIEGO (KGTV)- Unlike many of its neighboring communities, San Diego’s Midway District does not have any tall skyscrapers. But the local planning commission is hoping that changes very soon. For the last 11 years, the Midway Pacific Highway community planning group has had a plan to modernize Midway. With the city’s lease of the Valley View Casino Center coming up in 2020, the group is hoping to share some big ideas.“What better way to create more housing than in Midway,” Cathy Kenton, Chair of the Midway Pacific Highway Community planning group, said.The advisory group’s goal is to rezone much of the 1,300-acre district, to encourage new, mixed-use construction. A big part of that would be the 11,000 new dwellings, which could increase the residential population from 3,000 to 23,000 in the next 30 years. Except there is one problem — the city’s 30-foot height limit.In 1972, San Diegans voted on Prop D, which limits all buildings west of I-5 in the area (Coastal Height Limit Overlay Zone), to 30 feet.The commission believes this outdated law is stifling its potential growth, literally.“40 feet would be terrific, 70 feet would be awesome,” Kenton said. “Anything that would help us get a little more vertical would certainly open up the community, and not make it so dense.”The commission’s current redevelopment renderings do not include any high-rises.“So they’re all very flat and pretty boring looking, to be honest,” Kenton said. But they are still presenting these plans to the Smart Growth and land use hearing and to city council next week.Kenton says getting that approved is only the first hurdle. She believes the only way that Midway can reach its highest potential is if Prop D is overturned by the voters.That requires a community petition or a city council vote to put the measure on the ballot. “No one has a crystal ball for whats going to happen,” Kenton said. Kenton says the likelihood of getting the measure on the June or November ballots is slim, but they will keep trying.Those opposed to it say, constructing tall buildings would obstruct ocean views. If residents eventually vote to overturn Prop D, the committee says they will go back to the drawing board, to include mostly middle and some low-income high-rise apartments. 2319

(KGTV) - A proposal to build a four-story, 48 unit apartment complex in Carmel Valley has riled some neighbors, to the point where hundreds of them have now signed a petition asking the San Diego City Council to abandon the project.The complex would be at 10211 Rancho Carmel Drive, just off the 15 Freeway near Ted Williams Parkway. It's less than a half-acre. Right now, a two-story parking structure sits on the plot of land.Plans from developer New Pointe Communities say they would build the complex on top of the parking garage, essentially creating a six-story building.People who live in the nearby Provencal community say it doesn't fit the neighborhood. They've started an online petition to stop it."That’s pretty tall, and that just doesn’t fit in" says Eric Von Waldner, who signed the petition."It’s going to take away our view, take away our privacy. There will be balconies looking right at us. I just don’t like the idea of it," he adds.Von Waldner says neighbors worry the added units will overwhelm the area's electrical, water and sewage grid.They also say it will cause traffic headaches at the signal light on Rancho Carmel Drive and Provencal Place."You got Starbucks over there. You got people that live in my community. If you add 48 more units, it’s going to be crazy," says Von Waldner.They plan to send the petition to District 5 City Councilmember Mark Kersey, asking for a new plan. The Council already has an agreement with New Pointe to sell the land.“A number of residents have contacted me about the proposed project on Rancho Carmel Drive, and I continue to welcome feedback from my constituents. Any redevelopment plans for the site will go through an extensive public process with numerous opportunities for input from the community,” Kersey said in a statement to 10News.According to Eric Edelmen, the chair of the Carmel Mountain Ranch Community Council, the developer still has to submit a formal proposal to the city. They also have to ask for the area to be re-zoned to allow the extra units.Right now, Edelman says the land is only zoned for eight units.He says the last time they heard from New Pointe was at a November 14th meeting. The Community Council would have to approve the proposal first. Then it would need to pass through the Planning Commission and finally the full City Council. 2361

SAN DIEGO (KGTV)- Santa Ana winds are once again sweeping through the county. Fire crews and the city are on high alert after recent brush fires around San Diego. They are urging the community to take action. This comes after flames sparked in a canyon in the Talmadge area last Tuesday. The blaze scorched an acre of land. It’s not uncommon for homes to sit within feet of canyon-like areas. The city says they work to clear the brush in these spaces, but they also face some challenges. “Unfortunately, because of the number of open spaces and what we call the wildland-urban interface properties that but up against open space or canyons, they can only really get out there every three years,” says Stowell. SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. Cushinberry’s past convictions include rape in 1995, sexual battery in 1997, and recently, felony robbery in San Diego.His next court appearance is on December 19th. 2407

  

SAN DIEGO (KGTV)- COVID-19 is causing some changes for voters in San Diego county. Your usual polling location may not be active for the November elections.“Because of the pandemic, it has created a level of uncertainty in our universe,” says Registrar of Voter Michael Vu.Vu says to ensure physical distancing the county has consolidated the 1,600 small voting precincts into 235 super poll locations for voters to cast their ballots.“We just want to make sure everyone does it in a safe and healthy way.”Vu says they will be expanding the technology at each site with the ballot marking machines introduced during the primary elections back in March.“There will be, on average, 7 of those ballot marking devices per super polls location,” says Vu. “But we will also be having a number of voting booths because we will have pre-printed paper ballots for voters.”To help with social distancing and the influx of voters, there will be seven different check-in stations at each site to move people along.On Thursday, the Registrar of Voters office will be sending out sample ballots and voter information pamphlets. Those packets will contain each voter’s designated super poll location.The super poll locations will be open for voting starting October 31st.Michael Vu says the mail-in ballots will be sent out on October 5th. 1332
