WASHINGTON (AP) — A federal appeals court has ruled that the first federal execution in nearly two decades can proceed as scheduled on Monday. The ruling from the 7th U.S. Circuit Court of Appeals overturns a lower court order that had put the execution of 47-year-old Daniel Lewis Lee on hold. Lee, of Yukon, Oklahoma, had been scheduled to die by lethal injection on Monday at a federal prison in Indiana.He was convicted in Arkansas of the 1996 killings of gun dealer William Mueller, his wife, Nancy, and her 8-year-old daughter, Sarah Powell. 555

WASHINGTON — President Donald Trump is teasing running again for president in 2024 as he hosted a holiday reception at the White House. "We’re trying to do another four years. Otherwise, I’ll see you in four years,” Trump told the crowd on Tuesday. On Tuesday, hours before the White House party, Attorney General William Barr told the Associated Press that the Department of Justice had not yet found evidence of widespread fraud.Despite his loss, Trump remains overwhelmingly popular within the Republican party — both with constituents and lawmakers alike. Though polling showed Trump never had widespread appeal, he's remained extremely popular within the Republican party despite his loss in the 2020 election. VISTA, Calif. (KGTV) -- A Fallbrook woman was convicted of negligence for killing a father of four off of Highway 395 near the Pala Mesa Resort on May 23, 2017.Sulem Garcia was on prescription medications when she veered off the road crashing into Paul Burke who was on his bicycle, blocks from his home. Garcia's lawyer argued she was exhausted from finishing her finals at Palomar College that day and had been on the prescription medications to treat depression for three years.Garcia received the maximum sentence which was 1-year behind bars. More than 60 of Burke's family members and friends were in the courtroom. Burke's wife Laura gave a victim impact statement saying she does not believe that Garcia is remorseful and that the sentencing was a slap on the wrist.Burke owned and operated a custom surf shop for more than 40 years. He also worked at Costco. Burke's daughter and son both spoke at the sentencing hearing. 938

  

VISTA, Calif. (KGTV) -- A Vista judge has dropped two charges against Gerardo Martinez Sr., a father arrested last week by San Diego County Sheriff's deputies. Martinez Sr. was facing two charges, felony resisting arrest, and lynching of an officer. The video surfaced last week. Martinez Sr. and his son, Gerardo Martinez Jr., arrested by five deputies. The family says the deputies used excessive force and that the two men were compliant and already in handcuffs. On Monday, the family demanded the department release body cam video and conduct an independent investigation. They also want to see the deputies involved prosecuted. The sheriff's department says they were called for a domestic dispute and that Martinez Jr. was armed with a knife. Deputies were also called to the home in late April for another incident involving Martinez Jr. The family's legal team did not address any questions about what lead up to the video but said Martinez Jr. has an issue with mental illness. They plan on filing civil lawsuits at the end of the week. The deputies in the video are on administrative duty as the investigation continues.   1186

  

WASHINGTON — The Justice Department explored whether it could pursue either criminal or civil rights charges against local city officials as violence erupted night after night on the streets of Portland, Oregon.Federal officials researched whether they could levy criminal or civil charges against the officials, department spokesperson Kerri Kupec said.The research likely explored whether the rhetoric and actions of city officials may have helped spur the violence in Portland.The revelation underscores the Trump administration's effort seek action against those who officials believe may be helping contribute to protest-related violence.Kupec declined to comment on whether charges would be brought.According to The Associated Press, federal officials have reported that they were told by local law enforcement that they were explicitly told not to intervene at Portland's federal courthouse — the site of more than a hundred straight days of protest this summer. Protesters threw rocks and bottles at police and vandalized the building during several protests during that stretch.The Trump administration then briefly sent federal agents to the city in an attempt to quell the protests. Their initial presence in the city led to heightened tensions in mid-summer months.Portland Mayor Ted Wheeler said in a statement that it was "ridiculous" that the Trump administration was attempting to "distract" from its failures in handling the COVID-19 pandemic and west coast wildfires."The administration has made the cynical decision that the suffering of others is politically beneficial, regardless of the cost," he said, according to The Associated Press. "The people of this city — and throughout the nation — will not be intimidated, and I remain committed to doing my part as mayor to work with local partners to advance racial justice, and address the pandemic and economic challenges facing our community." 1923
