SAN DIEGO (AP) — A judge delayed the court-martial of a Navy SEAL accused of murder on Wednesday while lawyers resolve questions over whether the government's monitoring of emails compromised his right to a fair trial.Lawyers defending Special Operations Chief Edward Gallagher want the judge in the case removed because he was aware prosecutors planted tracking software in emails sent to the defense team and a journalist in an effort to find the source of news leaks."What we believed is that the judge authorized prosecutors to spy on the defense team," attorney Tim Parlatore said after the hearing. "Now looking at things it appears that prosecutors may have lied to the judge and that he didn't authorize it and he didn't know what they were really doing."Gallagher, who was dressed in Navy whites at the hearing, was scheduled to face trial May 28 on charges he killed a wounded Islamic State prisoner under his care in 2017. He is also charged with shooting two civilians in Iraq and opening fire on crowds.Now that date is uncertain as the defense tries to learn more about the email tracking and whether it violated the attorney-client privilege and protections against illegal searches.Parlatore said leak investigation documents he was provided show the effort was done without a search warrant or proper authorization.Parlatore asked who else knew about the email tracking and Judge Capt. SAN DIEGO (CNS) - A 53-year-old woman caught in the crossfire of an argument between two men in the Mountain View neighborhood of San Diego suffered a non-life threatening gunshot wound, police said Saturday morning.The men were arguing at 37th Street and Ocean View Boulevard about 11:40 p.m. Friday, according to Officer Robert Heims of the San Diego Police Department.The victim was sitting in a vehicle that was between the two men as they argued. During the argument one of the men pulled a gun and shot at the other man, but struck the women in her left hip, Heims said.The woman drove away and police found her about a block away. She was taken to a hospital for treatment of her gunshot wound, he said.No other injuries were reported.A detailed description of the shooter was not immediately available. 818

SAN DIEGO (CNS) - A former San Diego State University student accused of setting a string of fires around the campus over the course of three days was charged with a dozen felony counts Wednesday, including burglary, arson and vandalism. Madelyn Delarosa, 19, was taken into custody Saturday morning, following four fires she's suspected of setting to apartments and vehicles across campus between March 13-16. No injuries were reported in connection with the fires, all of which occurred a few blocks south of Viejas Arena. However, Deputy District Attorney Rikole Santin noted that one of the fires was ignited in an occupied apartment, inside which a person was sleeping. Santin said the heat from the flames caused a window to shatter and ``rain glass and fire'' upon the victim, who was asleep just below the window. A suspected motive for the spree was unknown, as was the reason Delarosa was no longer a student at the campus. Santin said surveillance footage captured the defendant entering a parking garage, where a Toyota Prius was set aflame, then an hour later, she allegedly ignited the exterior door of an unoccupied apartment in the 5600 block of Hardy Avenue, both times by using an unspecified accelerant. A passerby put out the apartment fire before officers arrived, police said. Around 8:30 a.m. Friday, police received word of the apartment blaze near the 5500 block of Montezuma Road, where the sleeping resident was able to escape without injury, according to Santin. That fire went out on its own, police said. Delarosa is also accused with setting a Mercedes-Benz on fire shortly after 8 a.m. Saturday in a parking garage in the 5500 block of Hardy Avenue. Delarosa has no prior criminal history, but had ``numerous prior contacts with law enforcement,'' according to Santin, the nature of which was not disclosed.
