SAN DIEGO (KGTV) - The trial for a former San Diego County sheriff's deputy accused of sexual misconduct while wearing his uniform began Monday in Vista.More than a dozen women claim Deputy Richard Fischer made unwanted advances."I think he's a bad guy," a San Marcos woman, who filed ,000,000 claim against the County, said.She said in August of 2017 two sheriff's deputies knocked on her door in the middle of the night for a welfare check. There was no problem and they left but she said Fischer returned alone an hour later, saying he needed to use her restroom; then told her she was cute and hugged her, several times."I was stunned shocked, it was very fast and confusing...I felt very vulnerable, intimidated, felt weak. I felt little." She said, next to tears. "It's just a mess! Everything is a mess! This is hard to do. He shouldn't have come back to my house and I don't ... Everything's a mess!"Similar instances were described by other women. In October of 2017, near the entryway of a 64-year-old woman's condo, Fischer took her report for a domestic violence incident and then made his move."His hands went all the way down to her butt and he squeezed both of her buttocks... he took her hand and pulled it down to his groin area," Lawyer Dan Gilleon said. He represents several women who filed claims against Fischer.Gilleon made a theme apparent, "he knows that she's alone, and she's vulnerable, and she's scared." Another victim called him a predator.Some women who came forward claim Fischer became more brazen, forcing sexual acts.Wednesday a plea deal fell through. The deal would mean Fischer would plead guilty to four felony charges -- down from more than 12 felonies -- and serve no more than five years in prison.10News learned that Fischer would also have to register as a sex offender for life under the plea deal.Fischer faces more than 25 years in prison if convicted of all charges. SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. Lake’s father says the young boy is expected to testify in the trial later Thursday.Lake is still receiving extensive treatments for his injuries.RELATED: Jury deadlocked in case against driver accused in San Ysidro hit-and-run?Banda was speeding west on Camino de La Plaza around 11:30 p.m. on May 6 when he reportedly ran a stop sign at Dairy Mart Road and crashed his pickup into a Honda Accord carrying the Lake family. In September of 2017, a jury found Banda guilty of misdemeanor charges of driving without a license, battery and vandalism. The jury was hung, however, on felony charges of hit and run causing death or permanent injury, DUI causing injury and driving with immeasurable blood alcohol causing injury.  1866

SAN DIEGO (KGTV) - To protect his best friend, a Sabre Springs man found himself in a brawl with a bobcat. Bobby Abrams, a 78-year-old Vietnam veteran, said it happened Saturday morning while walking his dog Sammy. The Navy veteran is in tiptop shape; he does hundreds of push-ups a day and goes on walks up to 14 miles. "Oh yea, he was snarling, arggggg, like that!" remembers Abrams. RELATED: Woman spots bobcat lurking through backyard in 4S RanchAbrams was walking on Ted Williams Parkway when he says the bobcat appeared and quickly attacked Sammy, biting him in the neck. Abrams quickly pulled the bobcat off, grabbing it by the throat and slinging it back and forth. He ultimately broke the animal's neck, killing it. Abrams was left with puncture wounds on his hands. He says he had to defend his dog and would do it again if he had to. He says their close relationship began when Abrams rescued Sammy from an abusive situation; he says they both have PTSD. "I love that dog as much as I love my momma. I love that dog, the Navy, and my momma!" said Abrams. RELATED: Photographs show mystery animal in North San Diego County is likely a bobcatHe started his military career in the Coast Guard and then joined the Navy, serving more than 20 years total.Fish and Wildlife officers picked up the bobcat carcass. A spokesperson says bobcats are not unusual in that area but are usually nocturnal. They speculate the animal might not have gone out that night due to bad weather and instead went out during the day.If you find yourself in a similar situation, wildlife officials say stand your ground and try to pull the animal away. They recommend avoiding going out at night when coyotes and bobcats are out. It's also advised to make loud noises and throw objects, like a rock, at the animal to try and scare it off. Officials say bobcats are typically fearful of humans. 1885

  

SAN DIEGO (KGTV) -- The San Diego County Board of Supervisors Wednesday voted 4-1 in favor of Otay Ranch Resort Village 13, a mixed-use community to be developed near the city of Chula Vista.When completed, Otay Ranch Resort Village will feature 1,938 homes, a fire station, sheriff's station, trails, an elementary school, parks and open space, according to a county staff presentation."We must have more housing that is well-planned, that is walkable, bikeable, and smart net zero housing such as this proposal," said nearby resident Richard Richardson.Proposed by developers Baldwin & Sons and Moller Otay Lakes Investments, Otay Ranch Village is located less than a mile east of the city of Chula Vista and 12 miles southwest of the community of Jamul.The county Planning Commission voted 4-2 in favor of approval, and the county Planning & Development Services department also recommended approval.Several environmental groups urged the board to table the project until the county resolves issues over its Climate Action Plan, along with species protection concerns and wildfire hazards."The amount of greenhouse gas here is substantial," said Dr. Peter Andersen, a Jamul resident and member of the Sierra Club. Board Chairman Greg Cox said the project has "gone above and beyond" to address greenhouse gas emissions.Cox said the county is facing a housing shortage emergency, and Otay Ranch Resort Village is "one that's better designed than most I've seen" in terms of fire safety. "I believe this is a good project that checks all the boxes," he added.Although he praised the overall project, Supervisor Nathan Fletcher cast the lone no vote."My reluctance today is that we're very close to resolving a series of lawsuits and there's an effort to get a legally enforceable climate action plan, and then we can assess this project," he said.The county's plan has been the subject of several legal challenges. In June, a three-judge panel of the 4th District Court of Appeal in San Diego also found that reliance on carbon offsets was not legal, and shouldn't be used as a mechanism to allow general plan amendments to move forward.Fletcher said that while the Otay Village project is consistent with the density requirements in the county General Plan, his concerns over the use of carbon offsets prevented him from voting yes on Wednesday.Supervisor Jim Desmond said that despite problems with the Climate Action Plan, the county shouldn't have to stop all development.The board vice chairman also said that Otay Ranch Resort Village 13 complies with the county's Multiple Species Conservation Program, and received the blessing of San Diego County Fire Chief Tony Mecham. "This project of all the projects [brought] before this board is probably the safest from a fire safety standpoint," he said. "This is fantastic; it's showing real progress and real effort," Desmond added. 2902
