Construction is underway to build what leaders say will be an icon of the city.Spanning 108 ft wide, a new arch will be lifted 40 ft above the intersection of Grand Avenue and Centre City Parkway."Escondido is just the hidden jewel of North County; in fact, Escondido means hidden valley and beautiful hidden valley. We're starting to live up to that more than I've ever seen," said Dan Forster.Forster owns Design Moe Kitchen & Bath and has watched new blood elevate the historic downtown over the last ten years, including restaurants, breweries, and new businesses. Also vice president of the Escondido Downtown Business Association, Forster says they've wanted a grand sign like this for years, but he says it was cost-prohibitive. Forster says that changed with an anonymous million donation made to the Escondido Charitable Foundation for the arch. "There's no money that's being taken out of the city budgets to pay for this, it's just one big beautiful sign," said Forster. Crews will raise the sign on March 3. Employers may soon be able to require workers who make tips to share that money with other staff. It's part of a new regulation from the Department of Labor.The agency says the rule could help increase pay for back of house staff, like cooks and dishwashers who have historically been excluded from tip pools.The rule says pooling is only allowed if the tipped employee makes the full federal minimum wage.Federal law allows tipped workers to make .13 an hour, as long as they earn enough tips to match the minimum. State laws vary on that point, though.The rule also gets rid of a guideline that said tipped workers must spend at least 80% of their time doing tasks that earn them gratuity.The National Restaurant Association has praised the rule, calling it a win for the industry because it clarifies laws under the Fair Labor Standards Act.“Today’s Department of Labor (DOL) final rule revising tipping regulations under the Fair Labor Standards Act (FLSA) is a year-end victory for the restaurant industry and its workers after years of litigation," said the National Restaurant Association in a statement. "The changes in this rule bring much needed regulatory clarification for the small business owners and their employees about what the law allows and requires. At a time when the restaurant industry is faced with instability, this rule provides renewed sensible regulations on tip-pooling and tip-credit standards.”We spoke to an employment attorney named Louis Pechman who founded WaiterPay.com. He said there may be some clarification in the rule, but that's not the big issue.“Tips traditionally have been viewed by management as kryptonite. Don't touch the tips, servers' tips, stay away. That's my money. Now you have a whole situation where servers, it's my money. The tip was left for me. Why am I paying a cook in the kitchen?” said Pechman.The Economic Policy Institute has estimated the rule would let employers take 0 million from tipped workers each year. That's based on numbers before the industry suffered under the pandemic.As Pechman points out, some local laws are very protective of employee tips and will supersede federal regulations.“So, it's important if you're analyzing the issue, is there a state regulation, is there a city regulation which gives more protection to workers than the FLSA does?” asked Pechman.The rule is set to go into effect in 60 days. ESCONDIDO, Calif. (KGTV) - The Old Palomar Hospital on the eastern edge of downtown Escondido could be redeveloped into hundreds of new homes and thousands of square feet of commercial, recreational and office space.In a letter to the city, developer Integral Communities says it wants to turn the site into a 450 homes, and 5,500 square feet of commercial spaces. The project could serve as a new gateway to downtown and add some much needed foot-traffic to Grand Avenue. Some businesses were closed Wednesday despite this being the midst of holiday shopping season. Beth Stevens, who owns the Vinklectic boutique on Grand Avenue, said she would welcome the project and the crowds it could bring. "I think new development is a good thing for everyone," Stevens said. Other business owners, however, said they are concerned about the project's increased traffic. But Rorie Johnston, who heads the Escondido Chamber of Commerce, said downtown needs to become more walkable. "The more you can slow people down, the more you can keep people in an area longer, the more possibility you have to engage with them," she said. Integral reached a deal with Palomar in February to buy the site for million. Palomar moved most of its services to its new hospital in west Escondido in 2012, making the older hospital available. It still offers cancer treatments, mental health services, and has office facilities at the downtown site. A hospital spokesman says it expects to stay in the downtown location through March 2020. Escondido city officials say they expect Integral to submit formal plans to the city in the next week. A call to Integral's project manager was not immediately returned. 1694
