SAN DIEGO (KGTV)- A man suspected in an attack at a Rolando 7-Eleven that left a father of four on life support pleaded not guilty to one charge of assault with a deadly weapon Friday.The assault charge includes a special allegation for great bodily injury on the victim.John Cowan Patch, 26, is accused of striking 30-year-old George Almestar in the head with a wrench during an argument early Tuesday morning. Prosecutors say the two were strangers.According to Almestar’s wife, her husband was at the 7-Eleven on El Cajon Blvd around 4 a.m. Tuesday to grab a cup of coffee before work when he and the suspect began arguing in the parking lot for unknown reasons.RELATED: Man attacked in 7-Eleven parking lot in Rolando, San Diego police sayAlmestar’s wife tells 10News he is now on life support, showing no signs of brain activity.“Our boys are twelve, eleven, five, and our daughter is going to be two next week,” his wife said.She said it has been difficult telling the children what their father is going through.“My two older ones, we just kind of said that he's at the hospital, we just don't know if he's going to make it,” she said. “They're not doing too good right now.”RELATED: 2 teens detained, accused of robbing bicyclist with BB gunThe family has created a Go Fund Me page to collect donations for medical expenses.Patch faces nine years in prison if convicted on the charge. “If new facts come to light regarding the investigation, or the victim's injuries worsen, the people will reassess this case in order to adequately recharge this case,” said Deputy District Attorney, Mary Naoom.He is due back in court for a readiness hearing on November 20 and a preliminary hearing on November 22. 1716

SAN DIEGO (KGTV) - 10News got an exclusive interview with the young San Diego man who says a local ICE agent pointed a gun at his head before being arrested, in part, for driving under the influence.“I’m 20 years-old and for him to pull a gun on me just for test-riding my motorcycle on the street is definitely not okay,” says Jonathan Levenson.A spokesperson for Immigration and Customs Enforcement (ICE) confirms ICE Agent Ed Zuchelli is on administrative leave while officers investigate a criminal matter.San Diego police confirm the incident happened on February 16th on Blue Lake Drive in the community around Lake Murray.Levenson says he was test-riding his dirt bike on his street when he saw the agent walk into the middle of the street to block him.“He had it pointed at me at a ‘shooter’s position’. That’s when I knew it was definitely a gun,” he tells us of the agent, who is his neighbor. “When he first came up to me I could smell some beer on his breath but nothing too strong,” he adds.Levenson says he rode around the agent, but the agent got into his vehicle and followed. “He turned on his lights and sirens and started yelling at me through his microphone. [He was] telling me he was a federal agent and not to mess with him,” says Levenson.Levenson adds that the agent showed him his federal ID badge.SDPD confirms Zuchelli was in a government-issued vehicle at the time of arrest.Police say he was arrested for alleged DUI, showing a weapon and making threats. SAN DIEGO (KGTV) — With President-elect Joe Biden and Vice President-elect Kamala Harris projected to take the White House, Harris will have to resign her seat in the U.S. Senate.The power to fill that seat would fall to Governor Gavin Newsom, and the political jockeying for his pick is well underway.“This is one of the best jobs in American politics, one of the most prominent jobs in American politics and every California political leader wants it,” said UC San Diego political science chair Thad Kousser.Kousser expects Newsom will want to make history with the diversity of his pick, should he have the opportunity.Others are thinking along the same lines. Groups like Equality California have sent the governor a list of their preferred LGBTQ candidates, which would be a first for California.Assemblywoman Lorena Gonzalez tweeted out her own list Friday of Latino candidates, another potential first for the state.“We are the largest demographic in this state, and growing,” she wrote. “It’s time we have a Latino/a US Senator.”Political analyst Laura Fink says the governor is going to have to balance a lot of competing interests.“First and foremost, what's going to be best for California? And then of course, what's going to be best for Governor Newsom moving forward as he looks toward his political ambitions,” Fink said, referring to the possibility that Newsom could run for president.There have been dozens of names floated as potential picks, including California Secretary of State Alex Padilla and state Attorney General Xavier Becerra.Both are sons of Mexican immigrants who would be the first Latino senators in California history.But don’t pencil either in just yet, according to Fink.“Kamala Harris is leaving one of only 26 women in the Senate. That's one out of four. Last time I checked, [women] are north of 50 percent of the population. So that is something that will need to come into consideration,” she said.Rep. Karen Bass is another top contender. She’s the head of the Congressional Black Caucus.There’s also State Senator Toni Atkins of San Diego, who could also make history as California’s first openly gay senator.“She's been the first a lot of times,” Fink said. “First lesbian Speaker of the State Assembly. First Madam President Pro Tem of the State Senate. This would be another first for her should she ascend to that seat.”Atkins declined to say if she was interested in the job or being vetted.“Right now, my focus is on the work before us, and the path ahead of us," she said in a statement to ABC 10News.Atikins said she was “focused on the outcome of the election and our state Senate races, looking forward to a Biden/Harris administration, and continuing our work here in California.”The power to fill a vacant U.S. Senate seat comes from the 17th Amendment to the U.S. Constitution. States have their own laws that shape the process.Five states require Senate vacancies to be filled by a special election. Nine states allow the governor to appoint a replacement, but require a special election shortly after.The remaining 36 states, including California, allow governors to appoint a replacement to serve out the remainder of the term.Newsom’s pick would serve out the remaining two years on Harris’s term, then go up for reelection in 2022 as an incumbent. Incumbency carries significant advantages in name recognition, fundraising and image, said Kousser.“You are getting that news coverage. Somebody is probably playing you on Saturday Night Live for two years, and that elevates you above all the other contenders,” he said.With California a reliably blue state, experts say Newsom’s pick could hold the job for decades. 3685

SAN DIEGO (KGTV) -- UC San Diego has some of the best graduate programs and schools in the U.S., according to a new report by U.S. News and World Report. Engineering, medicine and management all took top spots on the list. According to the report, UC San Diego’s Jacobs School of Engineering was ranked 11th overall in the U.S. and 6th in the nation among public engineering schools. The school’s bioengineering program placed 5th in the nation. Khosla. “We offer students an education that enriches and inspires them.
