SAN DIEGO (KGTV) - The U.S. Attorney's Office of Southern California announced charges Friday against a man in the death of a Camp Pendleton Marine who had an overdose in his barracks.The unidentified Corporal was found unresponsive on the floor near his computer chair on January 29, 2017. He was wearing headphones and appeared to have been playing video games, investigators said.An autopsy determined the Marine died of fentanyl toxicity. A pill found on the headboard near a powdery substance and a rolled-up dollar bill tested positive for fentanyl.A complaint unsealed Friday detailed drug charges against 25-year-old Kyle Shephard of San Marcos.Investigators said Shephard met the victim in November 2016 and sold him fentanyl and other drugs multiple times over three months.Shepard acknowledged the pills could lead to an overdose, according to the complaint.In December, Shephard was arrested and charged with possessing for distribution roughly 2,000 fentanyl pills.“What a senseless tragedy that another young life has been lost because of fentanyl,” said U.S. Attorney Adam Braverman. “This Marine was serving his country and had his whole life ahead of him. We are going to hold dealers accountable for the deaths that result from their reckless disregard for human life.”Shephard will be in court March 6 for a detention hearing.  1369

SAN DIEGO (KGTV) — The public is invited to the inaugural Christmas tree lighting ceremony Saturday at the new Legacy International Center in Mission Valley.Dozens of workers made their last-minute touches Friday ahead of the center's tree lighting, which plans to pull out all the holiday stops."We'll have Christmas caroling out there, and Santa will be out there. Just social fun," Jim Penner, executive director of the center, said. Penner said Saturday's event is the first of a three-phase opening for the nearly 0-million hotel, theater, and attraction center opening next year. The center is the brain-child of San Diego-based televangelist Morris Cerullo, who made his fortune as a popular televangelist in the 1980s and 1990s."He [Cerullo] wanted people around the world to be able to experience the people that he got to know through his 70 years of travel to 95 nations in the world," Penner said. Penner told 10News the center was initially supposed to be a small ministry training center and possibly a dormitory. But with the availability of the 18-acre former Mission Valley Resort, they went big. The hotel will have 126 rooms, including 12 suites. The fine-dining restaurant is a steakhouse, which is next to the pool and spa. The attraction building has a domed, 4D theater designed by former Disney Imagineers. Audiences will get to feel like they're flying over Jerusalem in a ride created by the same designers who made Soarin' Over California at Disney California Adventure Park.Another attraction will be an award-winning, computerized dome, where people can digitally tour the world."As we get to know each other, the world gets smaller," Penner said. Before the council approved the blueprints in 2017, critics of the Legacy International Center feared that traffic would be a nightmare. But Penner said that the improvements they made on the roads turned out to have unexpected benefits. "We widened Hotel Circle the entire length of our property. We have 1000 feet of frontage there. And a nice benefit of that is when we had this last big rain last week, in the past, Hotel Circle would flood like crazy in front of the hook ramps here, and no flooding at all!"The inaugural Christmas Tree lighting ceremony will begin at 6 p.m. tomorrow. SAN DIEGO (KGTV) – The two brothers convicted of killing their parents at their Beverly Hills mansion have been reunited in prison, according to the Associated Press.A spokesperson for the corrections department says 47-year-old Erik Menendez has moved into the same housing unit as his 50-year-old brother, Lyle Menendez.Both brothers are serving life sentences for shooting and killing their parents, Jose and Kitty Menendez, in 1989.Officials say Lyle was moved from Mule Creek State Prison to San Diego’s R.J. Donovan Correctional Facility in February, where his brother has been held in a separate unit since 2013. Wednesday, Erik moved into the same facility, where inmates interact in rehabilitation programs. The brothers can now spend time together during meal time and recreational periods. Each of the brothers has served time at three other state prisons. The brothers claim the murders happened after they were sexually abused by their father. Prosecutors said during the trial that the brothers wanted their parents’ multimillion-dollar estate. 1091

SAN DIEGO (KGTV) - The only child to live through the Paradise Hills murder-suicide, died Saturday, relatives told 10News. Nine-year-old Ezequiel Valdivia passed at 11:23 Saturday night at Rady Children's Hospital after his family made the difficult decision to pull the plug."He's probably been gone from us for a while," said Karl Albright, Rosario's brother-in-law. "We were just using the machines to keep his body with us. But he has been upstairs with his family, watching us."Ezequiel's father, Jose Valdivia, also shot and killed his sons, Enzi, 3, Zuriel, 5, and Zeth, 11, and their 29-year-old mother, Sabrina Rosario. Valdivia then turned the gun on himself.The muder-suicide happened on Saturday, November 16 at the family's home on Flintridge Drive in Paradise Hills.The Paradise Hills community and the Twin Hills Little League came together to host this month's "Cruise Reo Car Show" as a fundraiser to help the family."The whole community of Paradise Hills came out today, and the Twin Hills Little League. They are our family forever," Vanessa Pash said. She, like Sabrina Rosario, is a Twin Hills Little League mom. Albright said Baby Enzi was the shy one, Zuriel was playful. Ezequiel was the athlete and Zeth was a sensitive sweetheart. All of them poured their love for baseball into the Twin Hills Little League."The little one was only three, and he wasn't old enough to play, but the coaches would let him go out there and practice, and make him feel like he was part of the team," Pash said. To honor the three players, the league decided to retire each child's jersey number. They also agreed to play in the boys' honor for all future games. Albright says he is overwhelmed with what the community continues to do for their family. "It's amazing how many people are coming together to do all of these things for complete strangers," Albright said. The family is now in the process of donating Ezequiel's organs. Officers received another call en route to the home from a neighbor who said they heard arguing and what they believed to be a "nail gun firing." Three of the boys were found dead in the home. Ezequiel survived for one week, but was taken off life support November 23 after the doctors said he was brain dead, according to Rosario’s brother-in-law. The boys lived in the home with their mother and other relatives, but not Valdivia, who was in the process of divorcing Rosario.
