SAN FRANCISCO (AP) — A San Francisco firefighter who died this week was knocked over a third-floor railing by a water blast from a valve he had “inadvertently” opened during a training exercise. Firefighter Jason Cortez was participating in a training drill Wednesday when he was injured. The 42-year-old married father of two died an hour later at a hospital. Fire officials previously described his death publicly as a “training accident.” The fire department on Sunday released a copy of the preliminary investigation’s findings to The Associated Press. After days of searching, they find out their dogs were adopted from local shelters.“I would give anything to have him back,” says Valeria Mega?a. The Spring Valley family’s poodle mix, named Cookie, has been missing since Halloween. “Its been really hard. Life is not the same without him.”After searching day and night, the family got word cookie was placed at the El Cajon Animal Shelter. When Mega?a checked, she was told Cookie had already been adopted.A similar situation happened to a family in City Heights. Nora Avila says she was out of town when her dog Mocha, who was staying with a neighbor, got out. By the time she made it to the San Diego Humane Society, he had already been adopted.“We pleaded with them to let the family know… that we loved him. He was never abandoned,” says Avila.The El Cajon Animal Shelter and the San Diego Humane Society have holding periods four days for animals with no identification.Cookie and Mocha were not microchipped. “One in three pets in their lifetime is missing at some point, that’s why for us again, it is so important that people microchip their pets,” says Jennifer Brehler, with the San Diego Humane Society.Both shelters tell 10News they have notified the adopters but they have decided to not return the animals.The families are hoping they will have a change of heart. SAN DIEGO, Calif. (KGTV) - Nearly six years after it passed, Proposition B will be in front of two courts this week, with the future of San Diego pension reform on the line.Prop B was on the ballot in June of 2012 and passed with 65% of the vote. It promised to solve San Diego's pension crisis by giving new City hires a 401(k) style retirement plan instead of a pension. The change went into effect for all city hires except police officers.Since then, it's been mired in legal challenges.Shortly after it passed, union leaders sued, arguing that any changes to union employment agreements have to be negotiated first before they're placed on a ballot. They said that then-Mayor Jerry Sanders violated that rule when he openly campaigned for the Proposition in 2012.In 2015, the State Labor Board agreed with the union claims.That ruling went to the California 4th District Court of Appeals, who overturned the Labor Board's findings in 2017.In 2018, the State Supreme Court reversed the 4th District's ruling. The Supreme Court sent the issue back to the lower courts to decide what an appropriate "remedy" would be to Sanders' improper campaigning."They did not say 'Overturn Prop B.' They could have," says Reform California's Carl DeMaio, who wrote Proposition B. "They said, 'Hey, district court, find out how you punish the City of San Diego for this violation.' What’s the punishment? A slap on the wrist, a speeding ticket?"The 4th District will hold an open session on Monday, March 11 to begin that process. DeMaio says if the District Court rules to overturn Prop B, he plans to appeal that decision."Do you think they’ll actually overturn the citizens initiative? If they do, we will counter-sue on the punishment phase," says DeMaio.Meanwhile, the US Supreme Court will also look into the Proposition this week. On Friday, they'll decide whether or not to hear a case based on the First Amendment. Supporters of Prop B say the California Supreme Court's ruling violated Mayor Sanders' First Amendment rights of free speech and his ability to openly support or oppose items on a ballot."The issue is whether for not elected officials have first amendment rights," says DeMaio. "Can an elected official actually give an opinion on a ballot measure? I think yes. Even if I disagree with that opinion, it is their constitutional right. He doesn’t lose his personal free speech rights to take positions once he's elected."The US Supreme Court will announce their decision on Monday, March 18th. 2515

  

SAN FRANCISCO (AP) — A jury on Monday ordered agribusiness giant Monsanto Co. to pay a combined .055 billion to a couple claiming that the company's popular weed killer Roundup Ready caused their cancers.The jury's verdict is third such courtroom loss for Monsanto in California since August, but a San Francisco law professor said it's likely a trial judge or appellate court will significantly reduce the punitive damage award.The state court jury in Oakland concluded that Monsanto's weed killer caused the non-Hodgkin's lymphoma Alva Pilliod and Alberta Pilliod each contracted. Jurors awarded them each billion in punitive damages in addition to a combined million in compensatory damages.A federal jury in San Francisco ordered the weed killer maker in March to pay a Sonoma County man million. A San Francisco jury last August awarded 9 million to a former golf course greens keeper who blamed his cancer on Monsanto's Roundup Ready herbicide. A judge later reduced the award by 0 million.The three California trials were the first of an estimated 13,000 lawsuits pending against Monsanto across the country to go to trial. St. Louis-based Monsanto is owned by the German chemical giant Bayer A.G.Bayer said Monday that it would appeal the verdict."The verdict in this trial has no impact on future cases and trials, as each one has its own factual and legal circumstances," the company said.The company noted that none of the California verdicts have been considered by an appeals court and that the U.S. Environmental Protection Agency considers the weed killer safe.The EPA reaffirmed its position in April, saying that the active ingredient glyphosate found in the weed killer it posed "no risks of concern" for people exposed to it by any means — on farms, in yards and along roadsides, or as residue left on food crops."There is zero chance it will stand," said University of California, Hastings School of Law professor David Levine said. He said the ratio between the billion in punitive damages and million in compensatory damages is too high. He said judges rarely allow punitive damages to exceed four times actual damages awarded.The California Supreme Court ruled in 2016 that any punitive damages exceeding 10 times the compensatory damages are likely unconstitutionally high. The court didn't propose a ratio it felt correct, but said punitive damages should almost never exceed nine times actual damages, it said.The punitive damages awarded Monday are 36 times the actual damages.The lawsuits have battered Bayer's stock since it purchased Monsanto for billion last year and Bayer's top managers are facing shareholders discontent.Chairman Werner Wenning told shareholders at Bayer's annual general meeting in Bonn last month that company leaders "very much regret" falls in its share price. At the same time, CEO Werner Baumann insisted that "the acquisition of Monsanto was and remains the right move for Bayer."Bayer's stock price closed Monday at .91 a share, down 45 cents or 2.76 percent per share, in trading on the New York Stock Exchange. San Diego (KGTV)- The San Diego Police Department will soon be adding 63 new officers on our streets. The department held the orientation for its 120th police academy this morning. This academy class is the largest class in over 25 years.“It’s very exciting,” says recruit Samantha Koegel. “I’m really excited to start this new journey of my life.”Koegel says her interest in the police force started began as a senior in high school after participating in a ride-along with an SDPD officer. Koegel graduated from Ramona High School. She received her degree from The University of Nevada- Reno, in Criminal Justice. All recruits went through an extensive screening process before being invited to the academy. “This is probably within 5 to 7 percent of all the applicants that we’ve gotten,” says Lt. Steve Waldheim. In the past, the San Diego Police Department has been understaffed. They currently have 1,800 officers but are budgeted for over 2,000. Lt. Waldheim says they the department needs more officers on the streets.“We need more officers in patrol so that they are out answering radio calls that can lower our response times.”The average salary for a San Diego Police recruit is ,000. After they become an officer, that number jumps to around ,000. “The salary now with SDPD, at the end of these pay raises that city council approved, we will be on par with the rest of the agencies around San Diego County,” says Lt. Waldheim. The recruits official first day will be on Monday. The academy graduation is expected towards the end of November. 1569
