SAN DIEGO (KGTV) - A lawsuit was filed on Monday in San Diego County Superior Court against the County of San Diego, Registrar of Voters and other entities related to the ongoing battle over the future of the Julian volunteer fire department. Attorney and mayoral candidate Cory Briggs filed the suit and told 10News that the claim is that a group of former volunteer fire department board members made the decision to dissolve the department in secret meetings, and the County allegedly let it happen. For the past two years, locals have been in a contentious battle over the future of San Diego County's last all-volunteer fire department. Many residents believe the County should take over the department because it has more resources and money.Opponents don't trust the County and think that the department's volunteers can do a better job on their own. This morning, an independent regulatory agency conducted a final vote in favor of dissolving the department. A hearing on this new lawsuit is scheduled for Wednesday morning. 1041

SAN DIEGO (KGTV) -- A recent poll shows how residents of the 50th Congressional District are feeling a week after Darrell Issa entered the race. According to the poll, Democrat Ammar Campa-Najjar is leading the race, followed by Republican Carl DeMaio and Republican Darrell Issa. Meanwhile, the poll is also an indication of how district residents feel about a number of issues, including impeachment proceedings against President Donald Trump. To get the data, SurveyUSA interviewed 770 voting-age individuals in California’s 50th Congressional District between September 27 and October 2. Of the voting-age individuals surveyed, 671 are registered to vote in the state. 592 of those registered voters were likely to vote in the 2020 California Primary, SurveyUSA says. SAN DIEGO (KGTV) — A new study reveals the importance of having qualified athletic trainers available at high schools. One of the experts behind the study says he is shocked at how poor a job California does at regulating athletic safety."California is either dead last or next to last in all of these ratings of high school sports safety," according to Dr. Eric Post, an Assistant Professor at San Diego State University, who helped author the study.Robbie Bowers, trainer at Rancho Bernardo High School, says only about 60 percent of California schools have a certified trainer. With several sporting events and practices occurring for each school on any given day, it's nearly impossible even for schools with a trainer to have adequate coverage for all athletes.According to Post's research, that greatly increases the risks for student athletes who suffer an injury. "At schools with low athletic trainer availability, kids with a concussion were more likely to have that concussion go unidentified and also more likely to have that concussion be mismanaged as a result." Post adds that at schools with low trainer availability, an athlete with a concussion was often not treated until 24 hours after the injury. At schools with adequate trainer availability, athletes got initial treatment within 30 minutes.Bowers has backed previous efforts to create a statewide standard and certification; however, those legislative attempts have failed to pass. SAN DIEGO (KGTV) - A San Diego company created technology for NASA's 2020 Mars rover, launching in July.The Perseverance is set to launch July 20, at 9:15 a.m. EST.NASA's been working on this project for more than a decade, drawing from past missions with hopes of finding evidence of past life on the red planet."It's a really exciting mission!" Mike Carpenter, VP of Engineering at KULR Technology said."We don't know for sure what they're going to find, but if they find any hard evidence of life that would be wonderful." Carpenter is thrilled to be a part of this mission, bringing a piece of San Diego to Mars.Carpenter said the company is known for it's technology that keeps batteries from exploding.For the rover, they created heat sinks that control the temperature around sensitive instruments. Specifically the heat sinks on Perseverance protect SHERLOC, a detector on the arm of the rover that looks for signs of past life.KULR sent similar tech to Mercury, but this is their first trip to Mars."It is the largest most sophisticated rover NASA has sent there," Carpenter said.According to NASA, Perseverance will be landing in the Jezero Crater, the site of an ancient river delta.The mission has four Science Goals:1. Determine whether life ever arose on Mars.2. Characterize the climate on Mars. (Seeking to find if an ancient climate could have supported life.)3. Characterize the geology of Mars.4. SAN DIEGO (KGTV) - A local family says they were fighting to get back thousands of dollars in family heirlooms. They only got answers, they say, after Team 10 stepped in. "It makes me sick. It's really emotional," said Jill Robertson of Escondido. We interviewed Jill with her son, Jon, and his girlfriend, Megan Gielczyk. Jill and Jon shared with us a few of the limited old pictures they could find of their family heirlooms.She pointed to a photo of her late father wearing a ring. It was one of the pieces of sentimental jewelry that she said her family had given to local jeweler Mark Himmel to redesign. Jon said he was planning to use one of the rings to propose to his girlfriend but he added that the proposal and engagement were put on hold because Himmel hadn't returned their jewelry. Records verify that Himmel operates Sa-Ling Jewelry Imports Incorporated in San Diego. The Robertsons said it was Aug. 12 when they gave him a down payment to redesign thousands of dollars in family jewelry. They said they had expected to have the job completed in two to three weeks, but we met with them almost two and a half months after they wrote out a down payment check."There's evasion. He's constantly evading," said Jill. Jon's girlfriend, Megan, told us Himmel hung up the phone on her. San Diego police confirm they showed up to Himmel's home, where he operates his business, to try to get answers. However, no one came to the door. Two days after Team 10 left Himmel a voicemail, the Robertsons said they got a priority mail package with some of the heirlooms, but not all of them. They said there was no explanation for the wait time or behavior. It was early last week when Team 10 started making calls and leaving voicemails for Himmel. None of Team 10's calls were returned.We made a second attempt to visit him in-person this Thursday and were successful. He told us he's sending out the remaining pair of earrings on Thursday and he will soon send a remaining gold nugget."It took two months this time because I handmade the ring," he told us.He spoke to Team 10 later over the phone. He said he was responsive to the Robertsons about his slight delays. He sent us what he said was a screenshot of a text exchange from mid-September when he notified them that the job would likely take another three weeks and they thanked him.  A representative with the California Franchise Tax Board notified Team 10 that Sa-Ling Jewelry Imports Inc. in San Diego was suspended on 07-03-2017 for unpaid liability with a current billable balance of ,336.81. The Better Business Bureau verified that the Robertsons filed a complaint.
