SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. "We fully corrected the issues underlying the allegations in this lawsuit years ago and are unaware of any unresolved consumer impact."DEBT COLLECTION LAWSUITSPart of the complaint talked about debt-collection lawsuits.In July Team 10 discovered a 157% increase in the number of rule 3.740 collections lawsuits filed in San Diego County court from 2015 to 2019. That involves any debt collection company."If you look not just in the county of San Diego, throughout the state of California, and in fact the dockets throughout the nation, we have a massive epidemic right now," said attorney Abbas Kazerounian during a July interview.Kazerounian said if someone's been sued or contacted by a debt collection company, they need to know their rights."The amount of debt is irrelevant," he said. SAN DIEGO (KGTV) -- The latest water main break Sunday in the Midway District is the latest example of San Diego’s aging water system. But the city is working to fix the issue, replacing more than 100 miles of water transmission and distribution pipes.According to city documents, since 2013, San Diego spent 8 million to repair and replace 116 miles of water transmission and distribution pipes.A total of 72 miles of those repairs were on cast iron pipes, the oldest ones in the system. The project started in 2007 and sparked a rate increase to pay for the work.RELATED: Water main break in Midway District causes flooding, shuts down roadAs older piper are replaced, the city has seen the number of water main breaks decrease. "We have more than 3,000 miles of pipeline," said department spokesperson Brent Eidson, "To do it properly, we're probably always going to be replacing pipes."Throughout the project, older pipes made from concrete or cast iron are being replaced with new PVC pipes. Edison says PVC is the industry standard. Pipes made from the material usually last between 50-75 years.The city says its water system extends more than 400 square miles and moves roughly 172 million gallons per day. Included in that area is 49 water pumping stations, 29 treated water storage facilities, three water treatment plants and more than 3,300 miles of pipelines.The city hopes to have all the cast iron distribution lines replaced by 2018-19. The goal is to have all the larger cast iron transmission mains replaced by 2023. SAN DIEGO (KGTV) -- The effort to establish a new independent police commission in the City of San Diego appears to be heading to victory.As of Wednesday afternoon, Measure B was leading with roughly 75% voting yes.There is currently a Community Review Board on Police Practices, but supporters of Measure B said that body is far from independent.“Their legal council is the city attorney, who represents both the Police Officers Association and the CRB so it represents a true conflict of interest,” Maresa Talbert with San Diegans for Justice told ABC 10News back in June.Proponents of the new Commission on Police Practices said they have been waiting for years for this to be a reality.“A lot of people will look at this and think, oh look, it happened overnight. Well, no,” said Martha Sullivan, one of the early members of Women Occupy San Diego. “It took nine years of very persistent [and] consistent, research, education, [and] lobbying.”One of the goals of Women Occupy San Diego ended up being police reform after the Occupy San Diego protests in 2011 and 2012. Sullivan said they submitted complaints to the review board at that time, but many of those complaints were lost.Since then, the push for an independent police commission grew. “This measure is the epitome of strength in numbers. It is the epitome of community support,” said Andrea St. Julian with San Diegans for Justice. She helped write the charter amendment that ultimately became Measure B.The Community Review Board will be dissolved and the new commission will be formed, once election results are certified. The commission will have independent counsel, subpoena power, and the ability to review officer misconduct and make recommendations.“They'll have greatly expanded powers, a lot more responsibility, and a lot more freedom to do the right thing,” St. Julian said.Jack Schaeffer, President of the San Diego Police Officers Association, said the POA took a neutral stance on Measure B.“We trusted the voters to decide on the type of oversight that they believe is necessary. We believe this election provided them an opportunity to do just that,” Schaeffer said in a statement to ABC 10News. “SDPOA will continue to support oversight in whatever form the community as a whole demands.” 2279

  

SAN DIEGO (KGTV) -- The Carte Hotel in the heart of Little Italy is not nearly as full as it could be.It had been open just a few months before the pandemic hit, "We had a great start until March and the virus started showing up," said general manager Henri Birmele.Like many other hotels in California, The Carte is only allowed to book rooms for essential workers.But staff is preparing for when the Governor says they can fully reopen. "We have sanitizers on every floor, every piece of equipment that's available we have throughout the building to take care of team members and hotel guests," Birmele said Common areas will be sanitized every hour, the restaurant and rooftop bar will be spaced out to make it easier to social distance, valet service won't be available, there will be at least 12 hours and a deep clean between when one person checks out and another checks in and room service will leave orders at the door instead of bringing them in. The Carte is hoping to ease people back into hotels by encouraging "staycations" and planning to offer locals discounts and deals. "How people react, I don't know. I think time will tell. I think we have all the precautions in place to make sure that everyone is safe during their stay," said Birmele. 1270

  

SAN DIEGO (KGTV) - The elderly victim of a brutal home invasion in Clairemont last week is relieved two of the three suspects are in custody. John Slobig, 59 and Terry Jones, 53 are due in court Wednesday afternoon in connection with last Wednesday's home invasion in the 4600 block of Firestone Street.Eighty-seven-year-old Paul Schmidt suffered injuries to his head, arms, and wrist during the attack. "I was very grateful for the work that the police did, " said Schmidt. Schmidt said he's lived in the home for fifty-three years and never felt unsafe. "I know that drugs have been so dominant in our society lately that it's a whole different world that we're living in. Things we used to take for granted, you can't anymore," said Schmidt. Schmidt was installing a ceiling fan when he says three men burst through his front door."All of a sudden, these three guys come in and said this is a robbery and he grabbed scissors and walked up to me and said don't mess with us. I didn't want to die that day, and there was three. I'm one guy, I'm 87, I'm not as tough as I used to be," said Schmidt. He tried to pull one of the intruders by his beard, that's when Schmidt says one of the robbers hit him over the head with a ceiling fan blade."The one guy was higher than a kite; the one they have in custody, he was really a terrible person." Police say the trio ransacked the home and took off in the victim's truck, which was recovered. The suspects have lengthy criminal records. They're scheduled to be arraigned Wednesday at 1:30 pm. 1551
