SAN DIEGO (KGTV) - The San Diego Humane Society launched an investigation into possible animal neglect Monday.  The investigation is focused on the former Carmel Mountain Ranch Country Club.The golf course shut down in July.A spokesman with the Humane Society says someone reported that the declining state of one of the ponds on the course was endangering koi and other wildlife.Homeowners living near the course say they often smell a foul stench coming from the pond.The Humane Society says they’ve they’ve reached out to the owner of the country club and golf course.The Humane Society sent 10News a statement that says in part:"Because it is an open investigation, we cannot discuss details, but we take reports like this very seriously. We encourage anyone who has information relevant to this investigation to come forward and call San Diego Humane Society’s Humane Law Enforcement at 619-299-7012." 934

SAN DIEGO (KGTV) - There's a sign inside Hillcrest's Industrial Grind Coffee that reads, "our first, funky little coffee shop opened in 2011 - not too far from where you're standing right now."It's a place that shaped barista Jennifer Bizjak."It's where I learned everything I know about coffee," she said.That original location is a third of a mile away, near the northwest corner of Park Boulevard and University Avenue. It's now shuttered, and untouched. It's part of a complex that includes small homes and mom-and-pop businesses - one owner said she's preparing to leave after 17 years.Real Estate investment group Diversyfund bought the complex in June for .65 million. It plans to replace it with an 80,000 square foot mixed-use building that includes 58 units, including 6 affordable apartments.Shayan Rajabi, an investment analyst for the group, said the new complex is designed with sensitivity to the neighborhood. He said it would bring more housing to a region with a sever under-supply, plus affordable units. He added the building would feature a coffee shop, or microbrew, that would complement the community."I think the scale of our building is comfortable as it adds density without overloading the area. It’s the kind of scale that they do in German cities, which are known to have very people-oriented building codes," he said. That development would be near the northwest corner of Park and University, where a recent city request is now leading to concerns of future overdevelopment.In February, a city planner asked the Uptown Community Planning Group to support rezoning a little more than an acre at the northwest corner of Park and University to allow more intense development than what is in the recently approved community plan.Board member Mat Wahlstrom said the planner gave very few specifics.  "He simply said that a stakeholder, which, I would assume is the property owner, approached us to see about having this done," Wahlstrom said.Rayabi said the Diversyfund project fits within current zoning and that the group did not ask or need a re-zone for the project.Peggy Shapiro, who owns the strip mall that's actually on the corner - which includes the Medical Center Pharmacy - also said she has no redevelopment plans. She added she was unaware of the proposed rezone.On Thursday, City spokesman Arian Collins said REAL Development submitted a rezone application for the properties at 3906 and 3922 Park Boulevard, to accommodate a 58-unit mixed use complex with affordable housing. He added that the application has since been changed for a foundation and podium, but no permits have been issued. Bizjak said she's concerned about extra development hurting Hillcrest's parking situation."I can't even imagine how far they want to go or how that would even make sense," she said.The Planning Commission is going to consider the rezone at its meeting March 15.  2966

SAN DIEGO (KGTV) -- The San Diego County Board of Supervisors Wednesday voted 4-1 in favor of Otay Ranch Resort Village 13, a mixed-use community to be developed near the city of Chula Vista.When completed, Otay Ranch Resort Village will feature 1,938 homes, a fire station, sheriff's station, trails, an elementary school, parks and open space, according to a county staff presentation."We must have more housing that is well-planned, that is walkable, bikeable, and smart net zero housing such as this proposal," said nearby resident Richard Richardson.Proposed by developers Baldwin & Sons and Moller Otay Lakes Investments, Otay Ranch Village is located less than a mile east of the city of Chula Vista and 12 miles southwest of the community of Jamul.The county Planning Commission voted 4-2 in favor of approval, and the county Planning & Development Services department also recommended approval.Several environmental groups urged the board to table the project until the county resolves issues over its Climate Action Plan, along with species protection concerns and wildfire hazards."The amount of greenhouse gas here is substantial," said Dr. Peter Andersen, a Jamul resident and member of the Sierra Club. Board Chairman Greg Cox said the project has "gone above and beyond" to address greenhouse gas emissions.Cox said the county is facing a housing shortage emergency, and Otay Ranch Resort Village is "one that's better designed than most I've seen" in terms of fire safety. "I believe this is a good project that checks all the boxes," he added.Although he praised the overall project, Supervisor Nathan Fletcher cast the lone no vote."My reluctance today is that we're very close to resolving a series of lawsuits and there's an effort to get a legally enforceable climate action plan, and then we can assess this project," he said.The county's plan has been the subject of several legal challenges. In June, a three-judge panel of the 4th District Court of Appeal in San Diego also found that reliance on carbon offsets was not legal, and shouldn't be used as a mechanism to allow general plan amendments to move forward.Fletcher said that while the Otay Village project is consistent with the density requirements in the county General Plan, his concerns over the use of carbon offsets prevented him from voting yes on Wednesday.Supervisor Jim Desmond said that despite problems with the Climate Action Plan, the county shouldn't have to stop all development.The board vice chairman also said that Otay Ranch Resort Village 13 complies with the county's Multiple Species Conservation Program, and received the blessing of San Diego County Fire Chief Tony Mecham. "This project of all the projects [brought] before this board is probably the safest from a fire safety standpoint," he said. SAN DIEGO (KGTV) - There’s now a bombshell update about the standoff from earlier this summer at a condo complex near SDSU.Two officers were shot and dozens of neighbors were terrorized. 10News Investigative Reporter Jennifer Kastner has confirmed that officers wanted to search the suspect’s home for weapons days before the shooting.However, the Office of the San Diego County District Attorney did not attempt to get a search warrant. It was a horrifying night that ended with one person dead and two San Diego Police officers wounded by gunfire. Suspect Joseph Darwish died in the massive standoff.He had numerous hand guns and rifles, according to police. In the days after the shooting, 10News was tipped off by a law enforcement source that the FBI’s Joint Terrorism Task Force had wanted to search Darwish's home because they thought he had a weapon and was buying parts to make more weapons.Darwish wasn't supposed to own any weapons because of his criminal history. Our source says the FBI asked the District Attorney's Office to sign off on having a judge issue a search warrant, but the DA’s Office did not do so.For the past 7 weeks, 10News has been trying to confirm this with the DA’s Office.After our 10News attorneys got involved, the DA’s Office sent us a letter reading in part, “On June 13, 2018, the San Diego County District Attorney's Office received a request by law enforcement to review a draft of an affidavit in support of a search warrant to conduct a search of Mr. Darwish's person, property and residence. The District Attorney's Office determined that the warrant was legally deficient and so advised law enforcement.”June 13th was 10 days before the big shooting. 10News asked law enforcement expert and former police officer Kevin LaChapelle what "legally deficient" means. “It means that the District Attorney's Office felt that there was insufficient evidence or insufficient information that a judge would not grant a search warrant,” he explained.10News asked the DA’s Office why it turned down the FBI’s request to do a search warrant, but the DA’s Office will not answer that question, stating it's "exempt from disclosure".LaChapelle said this may have been a lesson learned the hard way, for the DA’s Office. He explained that the DA’s Office may reevaluate when it’s appropriate to seek a warrant. “It may help them start saying [a warrant] didn't meet [certain] criteria but it met this.It didn't meet a [level] 10 but it was at like a 7 and gosh, maybe [the DA’s Office needs] to start looking at this more so we can prevent these kinds of things,” he added. The FBI declined to comment about Monday’s story. San Diego Police have taken the lead on investigating the shootout. As of Monday morning, a lieutenant with the Homicide division said the investigation is still open and active and will probably take another couple of months to finish. 2913
