SAN BERNARDINO, Calif. (KGTV) -- Prosecutors said Monday that a California man killed his business partner and his family out of greed, according to the Associated Press. Prosecutor Sean Daugherty told jurors that Charles Ray Merritt wrote checks totaling more than ,000 on his partner’s QuickBooks account after the family disappeared. The comments came during opening statements in the trial for the alleged murders of Joseph McStay, Summer McStay and their three and four-year-old sons. Prosecutors also say that, while being questioned about the family’s disappearance just days after they went missing, Merritt kept referring to Joseph in the past tense.Outside the courtroom, defense attorney Rajan Maline said Merritt’s livelihood depended on McStay being alive. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.RELATED: Trial set to begin in McStay family murder caseIn 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.According to court documents, investigators believe Summer McStay may have been raped before she was killed. Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.During Monday’s opening statements, jurors in the San Bernardino County courtroom are expected to hear a tape of Merritt being questioned by investigators.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 2017

SAN DIEGO — When Johan Engman scouts locations for his breakfast-centric restaurants, he always seeks places with lots of outdoor space.“Just because we're in Southern California,” he says. “Not because I was predicting a pandemic.”But that criteria sure helped when the coronavirus outbreak hit, and restaurants became limited to outdoor-only seating. Some Breakfast Republic locations didn't lose any capacity, while others, such as its Encinitas eatey, lost about 75 percent.“We're surviving,” Engman says. “I think 2020 is really about being here in 2021.”On Monday - a little help making it through the year. Gov. Newsom and the county paved the way for restaurants across San Diego County to serve tables indoors at 25 percent capacity, after two months of outdoor only. Still, it’s unclear whether the increased restaurant capacity will lead to more jobs- as tens of thousands of displaced workers wait for the call.In July 2019, more than 130,000 San Diegans worked in county restaurants, according to the state Employment Development Department. Last month - with restaurants at outdoor only - that number was just 103,000, a nearly 21 percent drop.Alan Gin, an economist at the University of San Diego, said restaurants will be cautious when it comes to adding staff.“If they can get by without additional staff I think they're going to try to do that,” Gin said. “But if they're strained, if they're already at capacity and to add those 25 percent they're going to need to bring more people back, I think that's what they'll do.Engman says Breakfast Republic will be hiring with the increased capacity, but it’s too early to know the number. He says, however, that he is concerned about winter weather amid still mostly outdoor dining in the coming months.Engman says what would help spur hiring - another round of government stimulus Paycheck Protection Program loans. 1887

SAN DIEGO (AP) — The San Diego Zoo has two new arrivals: a pair of endangered African penguin chicks. The zoo announced Wednesday that the fluffy chicks, named Doug and Barbara, hatched two months ago.The eggs came from two breeding couples. The zoo says it's the first time eggs laid by its adult penguins have hatched there.Staff has been working with the chicks to get them used to humans before they are introduced into the penguin colony in the next few weeks.African penguins are an endangered species. Their numbers have dropped by more than 60% in the past three decades and only 23,000 breeding pairs are known to exist. The decline is blamed on several factors, including disease, habitat destruction and lack of food from overfishing, climate change and pollution. 781

SAN DIEGO (CNS) - A 43-year-old man was hospitalized Wednesday morning with serious injuries after the car he was riding in crashed into four parked cars on a Mountain View street, police said.It happened shortly before 10:30 p.m. Tuesday on South 40th Street just south of Imperial Avenue, San Diego Police Officer Robert Heims said.A 38-year-old man was driving a 2005 Honda Civic southbound on South 40th Street when the car drifted to the right for unknown reasons and struck four parked cars, Heims said. The 43-year-old man, who was sitting in the front passenger seat of the Honda, was taken to a hospital for treatment of a fractured neck, which was not believed to be life-threatening, the officer said. The Honda driver was uninjured and 31-year-old man in the back seat of the sedan had a complaint of pain to his leg, Heims said. 847

SAN DIEGO — Todd Brown doesn’t hold back when he talks about the impact Coronavirus restrictions have made on his bottom line.“It’s been basically devastating to us,” he said.Brown owns multiple restaurants in San Diego - including Bub’s in Pacific Beach. This past Fourth of July weekend was not what he was hoping for.“With the holiday weekend, our numbers, they were tremendously disappointing,” Brown said. It's going to get worse before it gets better. That's because Brown is going to have to shut down his indoor service for three weeks,Along with a variety of other business owners in the county. The county made the Governor’s monitoring list for three days in a row, meaning restrictions are going into effect at restaurants, tasting rooms, breweries, entertainment centers, zoos, theaters and card rooms for the next three weeks.“I say we are going back instead of forward,” said Patrizia Branchi, who owns Operacaffe downtown.Branchi said business has really suffered during the pandemic - with sales down to 35 percent. These new restrictions still allow her to serve customers outside - but with social distancing rules, her patio only holds six people.“I don’t want to think about closing because to me that means my family is going to have a problem,” Branchi said. “I have me and my daughter, and the other partner, which is with us since ever. What do we do?"And to make matters more difficult, Brown and Branchi both say they have all but exhausted their Paycheck Protection Program funds - meaning they won't have any stimulus money to get them and their workers through this new round of closure. 1621
