The Kern County, California District Attorney's Office has decided not to file charges against a man who was on death row for more than two decades, setting him free.Lisa Green made the announcement on Tuesday, saying the case would be nearly impossible to retry in court. She said it would be very difficult to convince a jury beyond a reasonable doubt of Benavides' guilt.According to a decision released by the California Supreme Court last month, the convictions of Vicente Benavides in 1993 "were based on false evidence and that he received ineffective assistance of counsel."The decision also says that "false evidence was introduced at trial and that petitioner's convictions of substantive sexual offenses, special-circumstance findings, and judgment of death must be vacated."Benavides was convicted in 1993 of first-degree murder, rape and other charges. He was sentenced to life. He was serving his term on death row in San Quentin. It was asked that his murder conviction be reduced to second-degree murder. That was also thrown out. The judgment has been vacated entirely. The California Supreme Court cited multiple doctors who evaluated 21-month-old Consuelo Verdugo in November 1991 when she died. The baby was taken from the Delano Regional Medical Center to Kern Medical Center then eventually the UCLA Medical Center where she died November 25, 1991.Multiple reports were made by doctors who said based off the inability to insert a catheter, bruising found near Consuelo's genitalia and other factors, they believed she had been sexually assaulted.In the report put out by the California Supreme Court, many of those doctors then admitted later they were wrong in their initial assumptions and those issues "can instead be attributed to medical intervention," like multiple attempts at inserting a catheter.Speaking on behalf of Benavides’s post-conviction legal team after the conviction was lifted, the Habeas Corpus Resource Center’s Interim Executive Director, Michael J. The New York Times reported late Saturday night that Senator John McCain will lie in state at the Arizona Capitol building and then the U.S. Capitol before being buried at Annapolis, Md.McCain died on Saturday in Arizona after a 13-month battle with brain cancer.The Times cited Republican sources as McCain's family finalizes plans to honor the senator from Arizona. McCain will also reportedly have a full dress funeral at the Washington National Cathedral.Two of McCain's former political rivals, Presidents George W. Bush and Barack Obama, will deliver eulogies, the Times reported, citing Republican sources. President Donald Trump is reportedly not invited to McCain's funeral, but Vice President Mike Pence will receive an invitation. McCain will be the 30th dignitary to have lain in state in the U.S. Capitol since 1852, and the first since Senator Daniel Inouye lain in state in 2012. Eleven of the previous 29 dignitaries who have lain in state were presidents. The tradition of lying in state would generally include an opportunity for the public to pay their respects.  1145

The mother of a 14-year-old boy with autism, who was traumatized after a run-in with a Buckeye, Arizona officer, says she never expected that what happened to her son would spark a national discussion. Diane Leibel also said see police body camera video was also one of the hardest things she’s ever had to do. “It was excruciating honestly,” she said. “I’ve never heard my son scream like that before. I don’t understand how it even got there.” On July 19, a Buckeye Officer named David Grossman mistook Connor Leibel for a drug user. As he drove by a quiet neighborhood park, Grossman claimed he saw Connor putting his hand up to his face, giving him reasonable suspicion to handcuff and detain the boy. It turned out Connor was using a small string to “stim” – a coping mechanism common for people with autism.  Phoenix-based KNXV broke the story about the video on Monday afternoon. Since, reports about the incident have appeared on every local Phoenix station, some national shows, and it’s even been picked up by the New York Times. The reason: It’s sparking a debate about how officers deal and confront individuals with mental illness, other disabilities, and autism. “We were afraid that our child would be ridiculed or that something would happen somewhere along the line,” Danielle Leibel said. "I didn’t think it would be from a police officer.” COMPLAINT DISMISSEDThe day after the incident, Leibel filed a citizen’s complaint with the police department against Grossman, a “drug-recognition expert.” Weeks later, officials up and down Grossman’s chain of command cleared him of using unreasonable force and that he had reasonable suspicion to detain the boy. After the final decision, no one from Buckeye police notified Leibel, she said. “I’m every emotion I can think of. That’s my baby who was manhandled like that,” Leibel said. “I do see that would be reasonable to approach him if he saw him putting something to his face….But after he showed him what he had, that should have diffused the situation. It should end there.” Parents of other children with autism have told KNXV they are horrified by what happened and how the incident was handled by the officer. However, some people are also blaming Leibel’s parents and his caregiver for leaving him alone. His mother’s response: “He’s a 14-year-old. He’s higher functioning. He’s not a danger to himself or others…He plays in that park every week, and we’ve never had an issue.“I’ve never, in his 14 years, had an issue or have anybody suspect he was on drugs,” Leibel said. After the incident, Buckeye Police announced they are working on creating a voluntary register for people with disabilities, mental illness, and autism. They also proposed that those individuals wear bracelets. The registry would allow officer to look up specific information on people the come into contact with. Leibel and other parents of children with autism told KNXV they were disgusted by the idea. “I think it’s disgusting that you have to label someone with a disability with a special mark so they don’t have to live in fear of being hurt by police,” she said. “How would that have changed (the situation with my son) at all.” A parent of another child with autism who lives in Buckeye told KNXV the idea reminded him of the "Holocaust."  3418

The Honda CR-V, one of the most popular vehicles in America, is plagued by a potentially dangerous engine problem that could cause the small SUVs to lose power or even stall, according to Consumer Reports magazine.In some CR-Vs, gasoline can leak into the SUV's engine oil. That can eventually cause the engine to lose power or stall completely. Several Consumer Reports subscribers reported the issue which has also been the subject of of dozens of complaints to the National Highway Traffic Safety Administration, according to the magazine. Many more owners have complained of the problem in online forums, Consumer Reports said.Several CR-V owners have posted complaints with NHTSA reporting a strong smell of unburned gasoline as a result of fuel getting into the engine's lubricating oil.A Honda spokesman took issue with Consumer Reports' contention that the problem is widespread, saying there are hundreds of thousands of CR-Vs on the road so a problem affecting even a tiny percentage of them could result in a fairly large number of complaints.Honda's Chris Martin said the automaker is working to figure out a fix for the problem and hopes to have one ready by mid-November. Honda does not consider the problem to be a safety threat requiring a recall. Owners with concerns about the problem should visit a Honda dealer for an inspection. Any needed repairs will be covered under their warranty, the automaker said.Consumer Reports counters that the issue is, indeed, safety related."There are many ways stalling can be a safety issue, so if these cars are stalling, they need to be recalled," said David Friedman, vice president for Advocacy at Consumer Reports and a former acting NHTSA director.The problem occurs in 2017 and 2018 CR-Vs with Honda's new 1.5-liter turbocharged engine. Somehow, gasoline is getting into the car's lubricating oil which should not normally happen, Consumer Reports said. That dilutes the engine oil making it less effective at lubricating the engine. Over time, that can lead to engine damage and loss of power or stalling, especially on cold days or in heavy traffic.Honda says the problem has occurred mostly in northern parts of the country during short drives in extreme cold weather. Consumer Reports said the problem had been reported to the magazine by CR-V owners as far south as Texas and New Mexico.Honda spokesman Martin took issue with Consumer Reports' contention that the problem is geographically more widespread than the automaker says. Honda also pointed out that it is normal for small amounts of gasoline to find their way into the engine's oil but it usually burns away during continued driving."While others may easily complain online of experiencing something similar under other circumstances," Martin said in an email, "it is premature and a bit irresponsible to link them all together without physical inspections of the vehicles, which is what [Consumer Reports] has done here."Honda has recalled CR-Vs in China for a similar issue. But, Honda said those vehicles do not have precisely the same engine used in CR-Vs sold in the United States,When an automaker issues a safety recall in the United States, it is legally required to fix the problem, at no charge to the owner, in all potentially affected vehicles.
