SAN DIEGO (KGTV) – As hospitals across San Diego prepare to distribute the COVID-19 vaccine to front line workers, questions have been raised about whether receiving the vaccine will be mandated for healthcare employees.“We will not make the vaccine mandatory. We do not make the normal flu vaccine mandatory. We do, however, require our staff to continue to wear masks throughout the entire flu season if they chose to not get the flu vaccine,” Palomar Health CEO Diane Hansen told ABC10 News. She said that Palomar Health’s policy will be no different with the COVID-19 vaccine.On Monday, ABC10 News spoke to hospital representatives at Sharp Healthcare, Scripps Health and Kaiser Permanente. They echoed Palomar Health's policy in that the COVID-19 vaccine will not be mandated but workers who decline to get it must wear PPE.San Diego employment attorney and legal analyst Dan Eaton told ABC10 News on Monday that hospitals can impose a mandate but so far that hasn't happened. “Employers generally have the legal right to mandate vaccination in the private workplace, subject to accommodations for medical conditions and religious objections, but there is a broader ethical question about whether they ought to mandate vaccination,” he said. He explained that the concern becomes whether mandating a resistant population creates a morale problem. “[The question is] whether, at the end of the day, you're acting in a nurturing fashion toward your employees if you mandate a vaccination that they don't want or they don't trust.”Eaton said it may be that at some point the state or federal legislature steps in in some form or fashion with respect to mandatory vaccination, but that's not the current case. 1718

SAN DIEGO (KGTV) – Californians voted to pass Proposition 22 – reclassifying rideshare drivers as independent contractors. But, companies like Uber and Lyft are still battling lawsuits from the state claiming billions in wage theft.The legal battle over rideshare drivers did not end with the passing of Prop 22. The California Labor Commissioner is still suing gig companies for not following current law which classifies drivers as employees instead of independent contractors.The Labor Commissioner’s Office is seeking billions for unpaid minimum wage, overtime, sick leave, and business expenses.Nicole Moore with Rideshare Drivers United led the fight against Prop 22. She says since the new law is not retroactive those lawsuits still stand.“This is about back pay that under the law as it was over the last three years, those drivers are still owed that money,” said Moore. “It was .3 billion that were owed to those drivers. Half of that is damages but the other half is just straight pay that under labor law.”Some drivers had to file for unemployment when the pandemic hit, including those with pre-existing conditions hoping to limit exposure to the virus. Others are unable to drive since they have to stay home with kids now out of school for distance learning.Moore says those unemployment protections won’t last once the new law takes over.“If you don’t have unemployment that’s when people become homeless, that’s when kids go hungry. We need that safety net as workers,” said Moore.As San Diego moves into the state’s purple tier, Tonje Ettesvoll says she’ll have to limit hours to reduce her risk of exposure. She says the move for her own safety may prevent her from qualifying for benefits under Prop 22.“I will not be doing my 60 hours a week. I’ll be doing maybe 30 so I may be one of those people who don’t qualify and will have to be on Medi-Cal,” said Ettesvoll. “And that is an expense that’s not Uber’s and Lyft’s. SAN DIEGO (KGTV) — City officials hope to get the construction process for a proposed downtown park, aimed at being an anchor for San Diego's East Village, off the ground this summer.The proposed 4.1-acre, million East Village Green will sit between F and G Streets stretching from 13th St. to 15th St. The massive stretch of green space in the heart of downtown San Diego will feature an 11,000-square-foot multi-use lawn, plaza and fountain areas, children's garden, 14,200-square-foot community center, dog parks, and room for food facilities, according to development plans.RELATED: Officials to break ground on county's first bike skills park in South BayThe green would also include an underground parking structure for 200 vehicles. "The City will be maintaining and programming East Village Green, and Civic [San Diego] hopes to start the bid solicitation process in late summer," according to Kimberly Moore with Civic San Diego. Part of the construction process will also involve restoring nearby historic homes, which sit at the corner of F and 15th Streets. It found that 45 percent of those polled were "extremely proud" to be American, while 70 percent said they were "proud.""Patriotism isn't something that you can force," said David Povlick, who was visiting downtown San Diego Wednesday. "It's something that people have to feel.
