SAN DIEGO (CNS) - The CEO of a La Jolla-based financial services firm pleaded guilty Wednesday to defrauding shareholders, falsifying tax returns and operating an unlicensed money services business.David Nava, head of Surf Financial Group LLC, worked with others to convert publicly traded companies' debt into unrestricted stock under false pretenses, and then sold the stock, despite being banned since 1994 by federal securities regulators from taking part in the securities industry, according to federal prosecutors.Prosecutors say Nava, 62, directed others to write fraudulent attorney opinion letters that facilitated removing restrictions on stocks so they could be sold, in circumvention of the U.S. Securities and Exchange Commission's regulations on the offer and sale of securities.The Department of Justice said brokerage firms cleared the sale of shares of the restricted stocks on the basis of those letters, allowing Nava and others to sell millions of shares, then move the proceeds into bank accounts under his control.In addition to his plea to a federal count of conspiracy to commit securities fraud, Nava also pleaded guilty to operating an unlicensed money transmitting business, which he used to move millions of dollars in financial proceeds, and a tax fraud count for falsifying federal tax returns from 2014 to 2016, in which he underreported Surf Financial's profits in order to conceal his true income and tax liability, according to the Department of Justice.Sentencing is slated for Jan. 8 in San Diego federal court. 1556

SAN DIEGO (CNS) - The San Diego County Board of Supervisors voted 4-1 today to request guidance from the state on allowing resumption of several activities, including private planned events, wedding receptions, hotel conferences, street fairs and team competitions.In a letter to be sent to Gov. Gavin Newsom, the county will also seek guidance on reopening playgrounds.Supervisor Jim Desmond made the proposal after the board was updated on the county's efforts to contain the spread of the coronavirus.Any reopening of those industries, he and other board members said, would only happen with the blessing of Dr. Wilma Wooten, the county's public health officer.He added that while the county must take note of an uptick in community outbreaks, it ``can't have a blanket stop on the economy.''``Maybe, by the time Newsom responds, there will be more time to review this. I want to be prepared with this next group of businesses,'' Desmond said.Because it takes months to plan certain events, such as weddings, planners ``will lose this entire season otherwise,'' Desmond said. ``We have one (board) meeting scheduled for July, and I'm trying to be ready if the numbers look good.''The supervisors also heard from numerous people employed in the private events industry, who urged the board to let them resume. Many said they have safety protocols in place, and would be able to provide lists for contact tracing if necessary.Wooten told the board that as of now, ``we couldn't recommend any opening in the next week or next couple of weeks, in terms of opening up broad industries, if (community) outbreaks continue.''``If we're above seven community outbreaks, it would be ill-fated'' to make such recommendations, she said.Another three community outbreaks were reported Monday by county health officials, raising the number reported in the last week to 10 -- the most in any week's span since the pandemic began in early March.Supervisor Nathan Fletcher cast the dissenting vote on the motion. The county ``has hit the community outbreak `trigger' for six consecutive days and recent days have generated not only the highest reporting of new COVID cases but also a doubling of the percentage of total tests being positive,'' Fletcher said after the vote. ``Given these facts, it is reckless and irresponsible to propose expedited reopening of additional in-door close contact group gatherings without any restrictions on the number of attendees.'' 2460

All but one had underlying medical conditions.The county reported a record 16,429 diagnostic tests Friday, 4% of which returned positive. The 14-day rolling average of positive tests is 5.8%. A community setting outbreak is defined as three or more COVID-19 cases in a setting and in people of different households.Cal State San Marcos sent an advisory to students and staff Thursday evening notifying them that two employees who were working on campus have tested positive for COVID-19."One individual was last on campus on July 16 and the other individual on July 17," the advisory said. The team's exact powers were not clear."This is a carrot approach, not a stick," Cox said. "But we still have the stick and other tools to ensure compliance."Supervisor Nathan Fletcher said the team would enable the county to step up enforcement on "egregious violations" -- but the details on that enforcement were also unclear. She said the recent spike in cases began to occur after bars, hotels and gyms reopened June 12.The last metric the county has failed to maintain is the percentage of cases that have been handled by a contact investigator within 24 hours of being reported. There are more than 500 investigators employed by the county, and although 98% of all cases had been investigated in that time frame as recently as June 25, that rate had dropped to 9% as of Wednesday.Wooten said that in response, the county is attempting to hire more contact investigators, with 212 in the hiring process. 3403

  

SAN DIEGO (CNS) - San Diego Mayor Kevin Faulconer accepted a nine-figure loan from the U.S. Environmental Protection Agency Tuesday to help the city finance phase one of the Pure Water San Diego water recycling program.Faulconer joined EPA Acting Administrator Andrew Wheeler to formally claim the 4 million Water Infrastructure Finance and Innovation Act loan. The city estimates that the first phase of the program will cost roughly .4 billion, including funding from the loan.San Diego will provide one-third of the city's drinking water through the Pure Water program by 2035, according to city officials. The city plans to break ground on the project's first phase in 2019."This federal funding is validation that our Pure Water Program is cutting-edge technology and a worthy investment for San Diego's future water independence,'' Faulconer said. "This is going to be one of the most significant infrastructure projects in San Diego history and will deliver clean, reliable water to our residents for decades to come.''As part of the first phase, the city will upgrade existing water facilities and construct new ones, like the North City Pure Water Facility near Eastgate Mall. Phases two and three will result in new water pipelines and facilities in central San Diego and South Bay.Congress enacted the WIFIA loan program in 2014. The EPA has loaned more than .5 billion in WIFIA assistance for five projects over the last two years."This WIFIA loan will help San Diego construct a state-of-the-art water purification facility that will produce 30 million gallons of clean drinking water each day,'' Wheeler said.City officials estimate that the Pure Water project will add nearly 500 jobs in the next five years.
