SAN DIEGO (KGTV) -- A 2-year-old girl allegedly abducted by her father in Chollas View, triggering an area Amber Alert, was found safe in Escondido Tuesday morning, San Diego police said.According to police, young Charli-Fae Harris was last seen with her father, Lafayette Harris, in the 1000 block of 47th Street at around 5:30 p.m. Monday.Police were notified of the girl’s disappearance by her mother. SDPD officials confirmed 31-year-old Lafayette Harris is under a restraining order related to domestic violence.After an Amber Alert was issued for the child and her father, police located Harris’ white Saturn vehicle in a parking garage near UC San Diego shortly before 6 a.m. However, Harris and his daughter were nowhere to be found.Harris was eventually tracked down at a construction site near UC San Diego Health System in La Jolla. ABC 10News learned Harris, who works at the construction site, was taken into custody without incident.Charli-Fae was found safe just before 8:15 a.m. in an Escondido apartment. Escondido Police said a woman connected to the child's father was watching the news when she realized she had the child police were looking for in her care, so she then called police to alert them. It's unclear if she knew the child had been taken.The girl will be reunited with her mother later Tuesday.Police said Harris will most likely face kidnapping charges and charges related to violating the restraining order against him, and said there could be more charges added as the investigation continues. 1536

SAN DIEGO (KGTV) - 10News is learning more about how suspected Poway shooter John Earnest got the weapon. On Thursday, investigators revealed that they believe he got his rifle from a licensed dealer.In federal documents released on Thursday, prosecutors report, “The firearm was manufactured by Smith & Wesson in Princeton, Illinois and shipped to Springfield, Massachusetts where it was assembled. The firearm was ultimately transferred, via Fort Worth, Texas, to a Federal Firearm Licensed (FFL) Dealer in San Diego, California, which sold the firearm to Earnest. Earnest picked up the rifle on April 26, 2019.”That was the day before the shooting.In a press conference on Thursday, Southern District of California U.S. Attorney Shane Harrigan told reporters, “I can say that there is no allegation that the defendant violated federal law when he acquired the rifle that he used in the violent attack on the synagogue.”Questions still remain as to whether state law was violated. Earnest is only 19 years-old.California law requires that adults be over 21 years-old before they can buy a firearm, unless they have a hunting license, are current or former military, or are in law enforcement.Prosecutors wouldn't comment on whether Earnest had a hunting license. “That allegation isn't in the complaint but please understand that as the criminal process moves forward, more information may be available to the public,” added Harrigan.District Attorney Summer Stephan originally said that the rifle had been obtained legally, but when pressed on Wednesday by 10News, she didn't provide a clear answer. “I don't want to [comment any further] because it's a pending case,” she said.At Thursday’s press conference, a reporter asked the federal prosecution about when Earnest purchased his 60 rounds of ammunition. SAN DIEGO (KGTV) - A former San Diego Unified School District student and football player is suing the district.The lawsuit filed by Jason Srouy alleges he was never informed of the potential financial and legal risks of participating and playing an organized sport if a lawsuit were to be filed alleging any negligent or other claims against the student-athlete.In 2018 Srouy and the school district were sued by a referee. The referee was injured during a 2015 game and claimed it was done on purpose. He alleged Srouy had a history of unsportsmanlike conduct known and encouraged by the coaching staff.At the time Srouy told 10News he was playing wide receiver during the game, tasked with blocking the opposing cornerback. During the block, he says the opposing player fell onto the back of the referee's legs, injuring the official.In a previous interview, Srouy said after learning of the lawsuit a school official led his family to believe the district would help him; however that was not the case. “It wasn’t on purpose, it was an accident, I didn’t mean to hurt anybody," said Srouy.Srouy’s attorney tells Team 10 he was eventually dropped from the lawsuit but not before racking incurring more than 5,000 in costs and fees.A spokesperson for the district says they can’t comment on pending litigation. 1323

SAN DIEGO (KGTV) -- A family from Chula Vista is desperately looking for their 9-year-old loved one. Erik Ochoa was swept away by the current in Rosarito on Easter Sunday. Ochoa lives in Tijuana with his father. His sisters, Zusel and Hilary live in Chula Vista. The boy was with two other children walking along the beach in Rosarito when they were swept away. One boy made it out of the current and ran to get an adult nearby. The third child washed ashore, lifeless, 25-minutes after going missing. Erik hasn't been seen since. The sisters have been looking for their brother since they heard about what happened. They've been going from Imperial Beach all the way down to Border Field State Park.The Mexican Navy is actively searching on the Mexican side. The U.S. Coast Guard broadcast a message to boaters telling them to be on the lookout. Erik was last seen wearing green shorts and a striped shirt. The family tells 10News the Mexican Navy will search until Sunday.  1008

SAN DIEGO (CNS) - Two community boards that review police practices will hold emergency meetings Wednesday and Thursday regarding the San Diego Police Department's de-escalation-of-force policies.The city's Citizens Advisory Board on Police/Community Relations will meet at 6 p.m. Wednesday, followed by a Thursday evening meeting of the Community Review Board on Police Practices, both of which can be viewed on the city's website and YouTube page.San Diego Mayor Kevin Faulconer said the goal of both meetings is to "take a serious look at de-escalation recommendations that could be implemented by our department" and "increasing and facilitating further dialogue and understanding between our officers, our men and women who are out there protecting us, and the community."Faulconer said public input is welcome regarding what SDPD policies should be updated or changed."Many are crying out to be heard. We are listening," Faulconer said. "Your city is listening. Now we want to turn those words into actions."The meetings will be held amid protests against police brutality staged in San Diego and elsewhere across the country, and follow Monday's announcement by the SDPD that it is banning the use of the carotid restraint technique.While the protests occurring both locally and nationwide were triggered by the Memorial Day death of George Floyd in Minneapolis, some have accused local law enforcement of escalating violence during protests in San Diego and La Mesa through the use of tear gas and bean bag rounds to disperse crowds.During a Monday news conference outside the County Administration Center, community leaders said weekend protests in San Diego and La Mesa were peaceful until officers clad in tactical gear crowded protesters, then fired non-lethal ammunition toward the protest groups.Will Rodriguez-Kennedy, chair of the San Diego County Democratic Party, said San Diego police caused "the panic that led to the escalation of violence" on Sunday by boxing in the crowd in downtown San Diego."How many of y'all think marching troops towards a contained space is de-escalation?" he asked.Local activist Tasha Williamson criticized law enforcement who responded to Saturday's protest in La Mesa, during which protester Leslie Furcron was shot in the head with a projectile, allegedly by a police officer.Furcron's family held a news conference outside La Mesa City Hall Tuesday afternoon to call for the officer involved to be fired and criminally charged. 2487
