SAN DIEGO (KGTV) - As the San Diego Padres reopened training camp - this time at Petco Park - a Padres fan is hoping to share one of the only seats in town for baseball.For the past eight years, Chip Messenger has leased a unit on the 15th floor in the Legend building, overlooking Petco Park."The view never disappoints. Everyone is always amazed," said Messenger.The view is about to become even more priceless because the Padres aren't expected to open up the stadium to fans when they start the season later this month. Messenger will have one of the only seats in town to watch live baseball."Looking for forward to it. I think people have been isolated and bored. Ready for something positive to happen," said Messenger.In late June, Messenger tweeted a photo of his view of Petco Park, sparking thousands of likes and hundreds of replies."They tell me, 'I'll bring the beer. I'll bring the fish tacos. Do you remember me from first grade? Do you need a new best friend?'" said Messenger.Messenger will be making a lot of new frends. This season, he plans to share his balcony with other baseball fans."This is a unique opportunity, and I'm happy to share it with people who won't get a chance to watch baseball," said Messenger.He hasn't figured out how he'll divvy up the invites. The financial planner says he won't be accepting money, but probably won't turn down food or adult beverages. He's hoping his plans will also benefit the Padres. He counts about a hundred nearby balconies facing the stadium, which could translate into a lot of cheering."Probably going to be one of the few places in the country where we fans can actually watch our team play. Who knows, maybe the Padres could have a home field advantage. Could be pretty cool," said Messenger.Messenger is planning COVID precautions for his Padres viewing days.Only a handful of teams has similar views outside their stadium. SAN DIEGO (KGTV) - As the world grieves the loss of Aretha Franklin, a local woman is recalling her final and historic San Diego concert on Shelter Island.Linda Moody is the widow of saxophone legend James Moody, who died in 2010. In 2005 during a newspaper interview, an excited Franklin, in town for a concert, learned Moody lived in San Diego. SAN DIEGO (KGTV) — Construction has started on Mission Valley's first public elementary school.The new preschool through 5th-grade campus at the corner of Via Alta and Civita Boulevard will serve residents living in the Civita residential development. Families living in the Mission Valley and Fashion Valley neighborhoods will also make use of the new school.The campus will feature classrooms with roll-up doors that open to the outside for 1st- through 5th-grade students; dedicated play areas for preschool, kindergarten, and 1st- through 5th-grade students; "makerspaces" for students; and an indoor-outdoor multipurpose facility.San Deigo Unified School District provided a virtual walkthrough of the campus here."With more significant growth planned in the area, we must prepare for the influx of new families and students," said Dr. John Lee Evans, Board of Education President. "This community deserves a quality neighborhood school."The campus will enroll up to 500 students and construction is expected to finish in spring 2022.The new school is funded through 2012's voter-approved Proposition Z bond measure, state schools facilities funding, and developer fees, according to San Diego Unified School District. 1231

SAN DIEGO (KGTV) -- California’s new gig economy law was meant to help rideshare drivers and other freelance workers get better benefits, but some critics say it’s threatening the spirit of Christmas itself.Those critics are mall Santas, who have traditionally been hired as independent contractors through third-party bookers or employment agencies.Under Assembly Bill 5, authored by Assemblywoman Lorena Gonzalez (D-San Diego), those workers must be reclassified as employees with insurance and other benefits.“Lorena Gonzalez, she might kill all the Santas. She might kill the Easter Bunnies,” said Steve Schafer, the president of the San Diego chapter of the Fraternal Order of Real Bearded Santas.Some Santas warn that bookers may go to great lengths to avoid paying employee benefits. “I don't know how someone can justify this,” said Jerry Tamburino, a Santa who has worked for more than a decade at a large commercial store.Tamburino said his agent notified him Tuesday that she would replace him and other Santas at a chain of California retail stores with out-of-state St. Nicks.“That's what [the booker is] being forced to do to address -- or evade -- or stay in business with this stupid law,” he said.Bringing in out-of-state workers to skirt AB-5 would violate California law, since labor laws apply to anyone performing work in the state, said Gonzalez’ office. But Tamburino said it would be hard for regulators to enforce.Malls and stores could hire Santas directly as independent contractors, Gonzalez’ office noted, since that kind of relationship passes AB-5’s three-pronged test.To do so, Tamburino said he would have to form his own LLC and said he doesn’t have the experience to run his own business.Tamburino said he would begin reaching out to other Santa-booking agencies in hopes they will hire him as an employee, but there’s a lot at stake: he receives about half of his annual income from Santa jobs. 1938
