SAN DIEGO (CNS) - The proposed .8 billion budget that San Diego Mayor Kevin Faulconer unveiled today includes the most infrastructure spending in city history, and prioritizes public safety, street repair and recreation centers, as well as initiatives to fight homelessness and illegal dumping.The spending blueprint also closes a million deficit without significant cuts to major programs, according to the mayor."We're continuing to put neighborhoods first by maintaining the key services we've restored in recent years," Faulconer said. "This balancedbudget will keep our foot on the pedal when it comes to fixing more roads, helping people into stable housing, keeping libraries and rec centers open for children, creating more housing affordability for working families and putting more police officers on the street to protect our communities."The budget proposal includes the largest recruitment and retention package in San Diego Police Department history, the equivalent of 390 miles of street repair and the highest level of library and rec center operating hours in a decade, according to the mayor's office.It also reserves 3 million for initiatives related to the Climate Action Plan, including 1 million to advance the Pure Water San Diego water recycling program. The proposed capital improvement budget of 3 million, including million for street repairs, would represent a large boost over last year's total of 5 million, and triple the amount of infrastructure spending during fiscal year 2014.More than .3 million in proposed SDPD pay hikes would presumably help fill vacant positions within the department, and 6,000 would be earmarked for SDPD's new Neighborhood Policing Division, intended to reduce chronic "quality of life" crimes often related to homelessness.The Vision Zero program, created to improve biker and pedestrian safety, would receive million to improve sidewalk, signal and crosswalk infrastructure. Nearly million would go toward homeless services, including three large tent shelters, a year-round Father Joe's interim housing program and the new Housing Navigation Center.City officials expect only modest revenue increases of 3, 5.3 and 5.5percent from sales, hotel and property taxes, respectively, during fiscal year 2019. Faulconer proposes balancing the budget with .1 million in cuts across various departments, .3 million in projected surplus from the current fiscal year budget and .6 million in excess funds from select reserve accounts.City Councilwoman Barbara Bry, chair of the council's Budget and Government Efficiency Committee, lauded the proposed spending plan."The mayor is proposing zero impacts to core services and fiscal year2019 looks strong," she said. "Today is the beginning of the budget process and as budget committee chair, I am excited to encourage San Diegans to actively participate in this process."Faulconer will present the proposed budget to the council at 2 p.m.Monday, and the council will hold a series of all-day public hearings in May before adopting a final budget in June. 3112

SAN DIEGO (CNS) - The president of the NAACP San Diego Branch Saturday criticized the proposal to de-escalate confrontational law enforcement situations adopted Wednesday by the San Diego County Police Chiefs and Sheriff's Association.The plan calls on all police personnel to "use tactics and techniques to persuade" suspects to "voluntarily comply" and mitigate the need to use increased physical tactics to resolve situations safely, the association said.Francine Maxwell, NAACP San Diego Branch president, issued a statement in reaction to the proposal: "We find this document to be profoundly tone- deaf and utterly inadequate. This document seems to have been prepared inside an echo chamber of highly paid law enforcement officials. Where was the input from the taxpaying public?"The policies unanimously adopted by the group are the culmination of a project that began last June with the creation of a committee tasked with exploring the hot-button issue. The committee included representatives from all countywide municipal police agencies, the San Diego County District Attorney's Office and a local psychiatric emergency-response team.Guiding the development of the new policy was "the overarching principle of reverence for human life in all investigative, enforcement and other interactions between law enforcement and members of the community," according to the association.But Maxwell responded to the proposal by asking, "Where in this document is it affirmed that the purpose of law enforcement is to protect and to serve, not to dominate and control? Where in this document are the policies and procedures needed to reign in the abuse, violence, and death that so regularly occur in citizen interactions with law enforcement?"Maxwell asked the law enforcement group to apologize for and withdraw the proposal, which said argued "does nothing to restore the public's trust and faith." She made a few other recommendations as well, including asking law enforcement to sit down with individuals who have suffered trauma and abuse, and she asked that officials move swiftly to build a new spirit of service and protection into their departments.She said officers who will not change should be removed, "rather than allow them to corrupt another generation of recruits with their aggression and violence."According to the association's strategy, peace officers should consider these concepts:-- Pre-engagements which involve "the process of gathering and assessing information prior to deploying the available personnel, tactics, equipment and other appropriate and obtainable resources" so as to "enhance the probability of a peaceful outcome."-- De-escalation, which hinges on the use of techniques intended "to gain voluntary compliance from an individual in order to gain or maintain control of an incident while reducing the need for physical coercion."-- Disengagement, or "tactical withdraw," an enforcement method that can "be a viable option for individuals in crisis who pose no additional threats to others, or resistant offenders who may later be apprehended under safer conditions."The mission of the project "was to not only define best practices for de-escalation, but to do so collectively to ensure the county is of one mind on the philosophy," said Chula Vista Police Chief Roxana Kennedy, president of the police-leadership body. "As part of this community, we understand the importance of violence prevention whenever possible, and de- escalation techniques are the best way to get there."The association included the law enforcement leadership of the county and all local cities, as well as San Diego Harbor Police, the county Probation Department and the police departments of the San Diego Community College District, San Diego State University, San Diego Unified School District and the University of California San Diego. 3867

SAN DIEGO (CNS) - The FBI reached out to the public Wednesday for help in tracking down a man who faces federal charges for allegedly operating San Diego-based pornographic websites that recruited young women and at least one teenage girl to engage in commercial sex acts by force, fraud and coercion.The federal agency has posted a reward of up to ,000 for information leading to the arrest of 37-year-old Michael James Pratt, who co-owned and ran online sites called "Girls Do Porn" and "Girls Do Toys."An indictment unsealed last fall alleges that Pratt also produced pornographic content involving a 16-year-old girl.Pratt and his co-defendants allegedly videotaped sex acts under the guise of distributing the footage only to private clients, then disseminated the clips online without the victims' knowledge or consent.In January, a judge awarded about million to nearly two dozen women who sued the owners and operators of GirlsDoPorn.com. The plaintiffs -- identified in court documents as Jane Does 1 through 22 -- were awarded just under .5 million in compensatory damages and .3 million in punitive damages.Superior Court Judge Kevin Enright ruled that the defendants falsely claimed that the videos would never appear on the internet and were instead solely filmed for DVDs to be sold to customers living outside the United States.Those lies were often bolstered by "reference women" who posed as models and provided "new recruits with false comfort that the experience (was) safe and enjoyable, and that (previously recorded) videos have never appeared online or been discovered by anyone in the models' lives," according to the judge's 187-page ruling.Also charged and awaiting trial in the case are company co-owner Matthew Isaac Wolfe; porn actor Ruben Andre Garcia; administrative assistant Valorie Moser; and Amberlyn Dee Nored, who is accused of lying to victims about how the pornography they were performing in would be distributed.Anyone who may have information on the whereabouts of Pratt is asked to contact the FBI at 858-320-1800 or contact the agency online at tips.fbi.gov. 2121

  

SAN DIEGO (CNS) - The city of San Diego obtained a preliminary injunction Tuesday against grocery delivery company Instacart, in the wake of a judge's ruling that the company misclassified its employees as independent contractors.San Diego County Superior Court Judge Timothy Taylor's ruling stems from a lawsuit brought by San Diego City Attorney Mara Elliott, who alleged Instacart was evading providing its "shoppers" with worker protections like minimum wage and overtime pay by classifying them as independent contractors rather than employees.In the ruling, which was issued Feb. 18, but not formally served to the parties until this week, Taylor agreed with the City Attorney's Office's assertion that Instacart would not be able to show its workers should be classified as independent contractors.RELATED: San Diego Instacart shoppers upset over service’s pay changesThe judge cited a state Supreme Court ruling in the case of Dynamex Operations West Inc. v Superior Court, which outlines an "ABC" test for determining whether a worker is an employee, a classification that applies if the person performs a core function of the business, is not free from its control, or is not engaged in an independently established trade, occupation or business.Taylor wrote that Instacart would likely be unable to satisfy any of the test's three conditions.The judge also wrote that the city's litigation against Instacart was in line with other recent, related decisions, including the recent passage of AB 5, which gives greater labor protections to workers classified as employees."The policy of California is unapologetically pro-employee (in the several senses of that word). Dynamex is explicitly in line with this policy," Taylor wrote. "While there is room for debate on the wisdom of this policy, and while other states have chosen another course, it is noteworthy that all three branches of California have no spoken on this issue."The Supreme Court announced Dynamex two years ago. The decision gave rise to a long debate in the legal press and in the legislature. The legislature passed AB 5 last fall. The governor signed it. To put it in the vernacular, the handwriting is on the wall."Instacart plans to appeal the decision, which the company said would not affect its operations in San Diego, due to a temporary stay of enforcement during the appeals process."We disagree with the judge's decision to grant a preliminary injunction against Instacart in San Diego," Instacart said in an emailed statement. "We're in compliance with the law and will continue to defend ourselves in this litigation. We are appealing this decision in an effort to protect shoppers, customers and retail partners. The court has temporarily stayed the enforcement of the injunction and we will be taking steps to keep that stay in place during the appeals process so that Instacart's service will not be disrupted in San Diego."Elliott's office touted the ruling as a victory for worker protections."This landmark ruling makes clear that Instacart employees have been misclassified as independent contractors, resulting in their being denied worker protections in which they are entitled by state law. We invite Instacart to work with us to craft a meaningful and fair solution" Elliott said."This decision is also a warning to other companies to do right by their employees. As the court said, `The handwriting is on the wall.' California has had two years since the Supreme Court's Dynamex decision to distinguish between a contactor and an employee. Everyone, not just Instacart, must live up to their legal responsibilities; they cannot ignore the significance of what occurred here." 3686
