SAN DIEGO (KGTV) - Five people who witnessed a potentially deadly situation were honored by the California Highway Patrol Friday to taking action that helped save a man's life.Dennis McNea is a driver for the Freeway Service Patrol. His job is to help stranded motorists. But Nov. 13, 2019, he was driving on State Route 94 when he suffered a medical emergency. "Almost hit me," said witness Gina de la Torre, a Navy sailor who was on her way home at the time. "And as I saw him, he was hitting the highway barrier and I noticed that he was slumped over in his car."RELATED: Community helps man devoted to keeping park cleanAnother witness, Alberto Robles, used his own truck to make contact with McNea's, slowing them both down to a stop. The other four, including de la Torre, stopped to help. "They just kind of stopped and looked at me like, 'What do we do?'" she told 10News. "So that's when I was like, okay, keep calm and just do whatever you have to do."They performed CPR until medics arrived. "I don't remember what happened to me at all," McNea said. "I woke up in the hospital a couple of days later. "A million thanks is not enough. They gave me a lottery ticket. They gave me life. You can have a billion dollars, but you can't buy life, and they gave me life," McNea said.McNea has since returned to work. He says he plans to take CPR training so he can provide the same life-saving support he received to others in need. 1675

She is less nervous about her 9-year-old who understands social distancing and mask etiquette, but her 5-year-old son hasn't reached that level yet."I'm worried about him going but I'm worried about him staying as well so it's like a double-edged sword," Campbell said.She said he has autism and is regressing without social interaction, but if he were to go to school right now she's worried he could catch coronavirus. These stresses piling up over the past four months.Licensed Psychologist Dr. Michelle Carcel said she's heard from a lot of exhausted parents and has this advice, "all of us need to take a step back and realize this is an imperfect situation and mistakes will be made and that's okay."She said it's important to create a routine to set barriers with the kids. "Also putting signs in different places where there's play area time and where there's school time. So that way you're making a division with work and play," Carcel added.Post a schedule somewhere that everyone can read, so the kids know when parents are busy and when they can have their attention.She suggests dividing and conquering if possible. Enlist help from your partner, or family members to divvy up the childcare responsibilities.She also said if you aren't happy about the decisions being made, let your representatives know. "You're not helpless, you're not alone, make sure you advocate for you and your family," Carcel said.Most importantly, don't forget to take care of yourself."I would just like to tell all the mommas and the daddies to stay strong if they're at home with their kids, it's a lot," Campbell said.A lot to handle, but a labor of love. 2320

  

SAN DIEGO (KGTV) — From the confrontation in a Los Angeles Trader Joe's to a showdown in a San Diego Starbucks, there have been a lot of customers claiming businesses can't legally require them to wear a mask.Some customers even carry a card threatening fines and citing the Americans with Disabilities Act, or ADA. But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. Businesses can ask if a person has a disability, but not much beyond that.RELATED: Confrontation over wearing a mask at Coronado coffee shop"You can't delve into someone's medical condition and ask them a bunch of questions," said attorney Colin Harrison. "I would not advise businesses to ask for any type of documentation."If the person says they have a disability, the ADA requires businesses to make reasonable accommodation. So what's reasonable?"A reasonable accommodation might be to ask the person to wear a face shield, which is about an inch and away and probably wouldn't restrict their ability to breathe," says attorney Steven Elia.RELATED: GoFundMe started for San Diego barista after woman posts about not wearing mask at StarbucksElia says other accommodations might include curbside pickup, but the ADA has limits: businesses don't have to fundamentally alter the way they operate."Customer says I don't want to wear a mask, I want you to deliver to my home. If the business doesn't already provide delivery service, that would be a major fundamental alteration of their business, one they would not be required to do," Harrison said.Both attorneys suggested businesses try to make accommodations first.RELATED: Feds warn of phony cards claiming face mask exemptionBut what happens if those accommodations won't work? There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. There have been at least nine across the country. But businesses that win can pursue legal fees from the other party. 2548
