SAN DIEGO (CNS) - A young man accused in a series of San Diego-area gang-related killings and attempted slayings pleaded not guilty Monday to murder, attempted murder and conspiracy charges.Ismael Betancourt, 20, is charged in the Aug. 1, 2019, shooting death of 57-year-old Marco Magana in Mountain View, the Feb. 8 shooting death of 19-year-old Leah Posey in Southcrest, and two attempted murders that allegedly occurred on July 24, 2019 and Feb. 8.San Diego police announced Betancourt's arrest last month in connection with the April 8, 2018, shooting death of 55-year-old Lowry Rivers in National City, which occurred when Betancourt was 17. Rivers' killing is not listed in the latest complaint, and it's unclear whether Betancourt is being tried in juvenile court regarding that crime or whether additional charges are pending in his current case.In addition to the murders and attempted murders, Betancourt is charged along with six co-defendants with conspiracy to commit a crime, for what prosecutors allege was a plan to kill rival gang members.The overarching conspiracy includes the July 12, 2019, shooting death of 20-year-old Joaquin Ruiz, who was shot in a vehicle in Bay Terraces by assailants who opened fire from another vehicle.The four defendants charged with that slaying have been arrested and pleaded not guilty. Two of those defendants, Ethan Apan, 28, and Kevin Herrera, 26, are also charged in the murders in which Betancourt is charged. The complaint charges Apan in Marco Magana's murder and Herrera in Leah Posey's murder.Betancourt is being held without bail and his next court date is a Dec. 22 readiness conference. 1656

SAN DIEGO (CNS) - A security guard at a bar in Little Italy was sentenced Friday to six years in state prison for shooting a patron during an argument outside the establishment.Dangelo Jeffrey, 24, pleaded guilty earlier this year to charges of assault, discharging a firearm and carrying a concealed weapon for the April 20 attack that began at the El Camino Bar, 2400 India St., according to Deputy District Attorney Mary Naoom.Around 2 that morning, Jeffrey got into an argument with the male victim and others, and made threats. He then followed the victim along India and to Laurel Street, where they got into another argument, during which the victim punched him in the face, according to San Diego police.RELATED: Man shot twice by Little Italy security guard after argument at barJeffrey then shot the victim in the abdomen. The bullet struck his spine, Naoom said.San Diego Police Officer J. Buttle said Jeffrey fired two shots, one of which struck the victim, and that Jeffrey then went home. SAN DIEGO (CNS) - A jury Monday began deliberating the fate of a man accused of fatally beating a senior citizen and going on a shopping spree with the victim's credit cards nearly two decades ago.Prosecutor Christina Arrollado asked jurors to find 39-year-old Edward Jamar Brooks guilty of first-degree murder.The 71-year-old victim, LeRay Parkins, was found in an alley off the 3700 block of 28th Street on Aug. 23, 2000. He died at a hospital three days later of injuries that included two skull fractures and brain bleeding.According to prosecutors, Parkins was out on a morning walk when he encountered Brooks and co-defendant Lester Bell.Brooks allegedly struck Parkins in the head with a bat, then rifled through the victim's pockets and took his wallet. Purchases were made with Perkins' credit card less than two hours later at a Spring Valley gas station and an Escondido clothing store, according to the District Attorney's Office.A baseball bat was later found at a Spring Valley home frequented by Bell and the getaway driver, Terrence Maurice Brown, but authorities lacked sufficient evidence at the time to arrest the trio for the murder, according to previous court testimony.The three were arrested in different states last summer: Brooks in North Carolina, Bell in Colorado and Brown in Arizona. Brown, 38, recently pleaded guilty to a robbery charge, while Bell, 39, pleaded guilty to voluntary manslaughter. Both men have yet to be sentenced.Brooks "took a baseball bat to the (victim's) skull," and his DNA was found on the victim's short pockets, Arrollado alleged in her closing argument.She said Parkins was a senior on his morning walk to stay healthy, and claims that he was "willing to get into a full-blown fight" with the defendants are false."Instead of coming home healthy and more vibrant, (Parkins) lay dying in alley, choking on this own blood," she told jurors.Arrollado also dismissed claims by Brooks' attorney, Robert Ford, that Bell and Brown were the real culprits who conspired against Brooks."If this is a frame-up job, it's the worst frame-up job in history," the deputy district attorney said. "These three set out looking for victims."Ford countered that if three people are involved in such a crime, accomplices "will say anything to save their own skin -- don't convict Mr. Brooks unless it's based on evidence." That evidence, Ford said, would include DNA on the baseball bat.Brooks admits to taking Parkins' wallet, and DNA evidence supports a robbery -- but not murder, the defense attorney said. Ford said Parkins deserves justice, but the DA's office "cannot prove any malice in the heart of Mr. Brooks.""I hope and pray that each and every one of you will agree on one theory, and that he's not guilty," Ford told jurors. "If he's an innocent man, he should be able to walk out that door."Ford has alleged that Brown actually beat Parkins with the bat and that he and Bell -- two "lifelong friends" who grew up in North Park together -- conspired to blame Brooks, the "odd man out."Ford earlier told jurors that as the three defendants prepared to leave, Brown got into a fistfight with Parkins, which the victim was winning, despite being much older than Brown. SAN DIEGO (CNS) - For the fifth day in a row, San Diego County public health officials reported a case rate of fewer than 100 positive COVID-19 tests per 100,000 people -- however, the state said it will have to review the data before removing the county from its monitoring list.Previously, county and state officials had said if the rate stays below 100 per 100,000 people (it was 91.9 Sunday) for three consecutive days, the county would officially be removed from that list. After an additional 14 consecutive days below that number, K-12 schools could potentially reopen for in-person teaching, depending on individual school district metrics.Some 48 elementary schools have filed waivers with the county to return to school early.That timeline is now uncertain, as are the specifics of reopening certain businesses for indoor operations.As the county awaits further guidance from Gov. Gavin Newsom, public health officials on Sunday reported 334 new COVID-19 cases and no new deaths as of Saturday, raising the county's totals to 34,678 cases, with the death toll remaining at 626.Of the 7,047 tests reported, 5% returned positive, maintaining the 14- day positive testing rate at 4.3%, well below the state's target of 8% or fewer. The 7-day rolling average of tests is 7,944 daily.Of the total positive cases in the county, 2,856 -- or 8.2% -- have required hospitalization since the pandemic began, and 715 -- or 2.1% -- were admitted to an intensive care unit.County health officials also reported three new community outbreaks, bringing the number of outbreaks in the past week to 24. The latest outbreaks were reported in a business, a restaurant and a restaurant-bar, according to the county Health and Human Services Agency.The number of community outbreaks remains well above the county's goal of fewer than seven in a seven-day span. A community setting outbreak is defined as three or more COVID-19 cases in a setting and in people of different households in the past 14 days.Latinos are still disproportionately impacted by COVID-19, with that ethnic group representing 61.3% of all hospitalizations and 45.4% of all deaths due to the illness. Latinos make up about 35% of San Diego County's population.A new COVID-19 testing site began operating last week at the San Ysidro Port of Entry PedEast crossing, and County Supervisor Greg Cox cited its immediate success and demand for it.The free testing site will operate from 6:30 a.m. to noon Monday through Friday and will focus on testing essential workers and American citizens who live in Tijuana, according to San Diego County health officials.No appointments are necessary at the walk-up site, which aims to offer about 200 tests daily. People getting tested will not be asked about their immigration status or who lives with them, health officials said."We know that communities in South Bay have been hit the hardest by COVID-19," said Wooten. "The location was selected because of the increase in cases in the region and the number of people, especially essential workers who cross daily." 3073

  

SAN DIEGO (CNS) - A motorist who allegedly struck and gravely injured a bicyclist near Lindbergh Field last month, then fled San Diego and was arrested in Kern County, pleaded not guilty Monday to a felony hit and run charge.Mauricio Flores, 29, is accused in the Aug. 21 crash at India and West Washington streets that seriously injured a 66-year-old man.The victim was hospitalized with what police at the time said was a life-threatening head injury. His current condition is unknown.Police said Flores was driving a 2005 Dodge Caravan that struck the victim.Video footage shot by a witness shows the driver of a van, which had Georgia license plates, pulling to a stop following the collision and getting out along with a female passenger, identified by police as 50-year-old Jessica Bailey.In the video, the pair walked over to the where the injured man was lying on the side of the road. After looking at him for few moments, the driver pulled the bent bicycle out from under the front of the van and set it aside, then got back into the vehicle along with his companion and drove off. A second, male passenger also was seen getting out of the van in the video, but he was not identified by police.About one week after the crash, San Diego police posted Flores and Bailey's names and pictures online and asked for the public's assistance in locating the suspects.According to the California Highway Patrol, an off-duty Kern County CHP officer who had seen a flyer about the hit-and-run case came across the Caravan while riding his motorcycle in Lake Isabella, an unincorporated community about 35 miles northeast of Bakersfield.The officer reported the van, which had California government-agency license plates.Three days later, another CHP officer spotted the van -- now bearing Vermont plates -- in a parking lot outside a Vons store in the area and called in sheriff's deputies, who found Flores and Bailey and arrested them, CHP spokesman Robert Rodriguez said.Flores was booked Sept. 3 into a San Diego County jail and remains held on 0,000 bail following his Monday morning arraignment. His next court date is a Oct. 6 readiness conference.Jail records do not indicate Bailey is in custody, and it is unclear what charges, if any, she may face. 2269
