SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. Jason Weeden said.Cushinberry was arrested last Friday about 6:45 a.m. in the 200 block of 17th Street.When Judge Jay Bloom ordered the defendant to stay away from the alleged victim, Cushinberry said ``I don't know the woman,'' according to Deputy District Attorney Martin Doyle.The prosecutor said Cushinberry has a criminal past from Indiana that is still being looked into.Cushinberry -- who is also charged with two counts of digital penetration by a foreign object, faces 21 years in prison if convicted, Doyle said.A readiness conference was set for Dec. 3 and a preliminary hearing for Dec. 5. 1391

SAN DIEGO (CNS) - County health officials today reported the death of a San Diego County man due to flu complications, bringing this flu season's death toll in the region to seven.The 73-year-old man died due to influenza A complications on Dec. 16, according to the county's Health and Human Services Agency.The man's vaccination status and medical history are still being investigated. The other six county residents who have died this season had additional medical conditions and either weren't vaccinated or their vaccination status was unknown."Influenza can be deadly, especially for the elderly and people with chronic medical conditions," said Dr. Wilma Wooten, the county's public health officer. "Getting a flu shot is the best way to prevent getting sick."At this time last year, 11 county residents had died due to flu complications. Last flu season was the county's worst in nearly 20 years of collecting data, with 342 residents succumbing to flu complications. Residents over the age of 65 with underlying medical conditions accounted for much of that death toll, according to the county.According to the county's weekly flu report for Dec. 16-22, lab- confirmed flu cases rose for the fourth consecutive week, from 290 to 410. That jump is a far cry, however, from the same week last flu season when reported cases spiked to 2,332. SAN DIEGO (CNS) - As the Valley Fire burned for a fifth straight day, blackening thousands of acres in rural eastern San Diego County, California Attorney General Xavier Becerra issued a consumer alert today warning that charging excessive prices for goods and services is illegal during a state of emergency.The state's price gouging law holds that it is unlawful to raise the price of items more than 10% after a state of emergency has been declared.Violations of the price gouging statute could carry penalties of up to one year in county jail and/or a ,000 fine. Civil enforcement actions could also include up to ,500 per violation and other monetary penalties.As of midday Wednesday, the Valley Fire had burned more than 17,000 acres and was 11% contained. It was one of many blazes ravaging the state, including the El Dorado Fire in San Bernardino County and the Creek Fire in Fresno, Madera and Mariposa counties.``Multiple fires burning throughout the state have forced evacuations for thousands of California residents. SAN DIEGO (CNS) - Circulate San Diego released a report today detailing how cities in southern San Diego County can make progress toward eliminating traffic deaths.The report outlined ways in which Imperial Beach, National City, Chula Vista and Coronado can prevent fatal traffic accidents by making improvements to the cities' most dangerous intersections and roadways.Circulate San Diego suggested the cities should take steps to calm traffic flows like restriping roadways to narrow them and reduce speeds. Circulate also recommended that the highlighted cities should asses driving behaviors that lead to serious injury and fatal car accidents and work with local law enforcement officers to target those behaviors through education and traffic law enforcement."Every city has room for improvement to make streets safe and we look forward to working with each South County city to save lives,'' said Maya Rosas, co-author of the study and the organization's director of policy.The report is part of the organization's participation in the Vision Zero campaign, which aims to eliminate fatal traffic accidents altogether. Circulate San Diego and the city of San Diego have already set a goal of eliminating traffic deaths in the city by 2025.The organization made similar recommendations to the city of San Diego last year and the city subsequently repaired its 15 most dangerous intersections. SAN DIEGO (CNS) - A security guard at a bar in Little Italy was sentenced Friday to six years in state prison for shooting a patron during an argument outside the establishment.Dangelo Jeffrey, 24, pleaded guilty earlier this year to charges of assault, discharging a firearm and carrying a concealed weapon for the April 20 attack that began at the El Camino Bar, 2400 India St., according to Deputy District Attorney Mary Naoom.Around 2 that morning, Jeffrey got into an argument with the male victim and others, and made threats. He then followed the victim along India and to Laurel Street, where they got into another argument, during which the victim punched him in the face, according to San Diego police.RELATED: Man shot twice by Little Italy security guard after argument at barJeffrey then shot the victim in the abdomen. The bullet struck his spine, Naoom said.San Diego Police Officer J. Buttle said Jeffrey fired two shots, one of which struck the victim, and that Jeffrey then went home.
