SAN DIEGO (KGTV) -- For decades internal documents about officers' use of force were limited to just law enforcement.A new California law changed that, and now some of the most private materials are being released to the public.Documents released by the San Diego Police Department show how incidents are investigated and what type of evidence is collected before use of force cases are submitted to the San Diego County District Attorney's Office.10News asked the department to analyze a case to help the public understand how a report is created. An internal affairs captain also explains how the public getting access to internal documents is helping bridge the gap between the department and the people it serves.2016 Officer-Involved ShootingIn November 2016, Juan Carlos Fernandez shot four people, killing two in the 3800 block of Marlborough Avenue. Police shot and killed Fernandez after officers repeatedly ordered him to lay on the ground, but he refused and continued pointing the handgun at a female, according to police. A 2016 San Diego Police Department press release stated, "An officer, fearing for his life and the safety of the female, fired one round from his service weapon. The round struck the suspect, knocking him to the ground. The suspect was pronounced deceased at the scene by paramedics."The San Diego County District Attorney's Office cleared the officer in the shooting.Under a new California law, Senate Bill 1421, the investigative file and supporting audio and video documents were released to 10News through a public records act request.10News asked the department to talk about what goes into an investigative case file and how the department investigates its own after an officer-Involved shooting.Case Deconstruction"The initial examination is going to be from a criminal standpoint, and the homicide unit is going to roll out there, and they are going to start their investigation," said Internal Affairs Captain Wes Morris.Part of the homicide investigation includes an initial walkthrough at the scene.Using the documents released to Team 10, an initial audio walkthrough of the 2016 shooting identified 15 law enforcement officials, including the officer involved in the shooting, a representative from the San Diego County District Attorney's office, and a member of the Internal Affairs Department."You can get very accurate information right away, and you can start to get a feel for what actually occurred," Morris told 10News.Morris said the homicide team would speak with anyone who was at the location of the shooting, anyone who could have been at the location, and/or anyone who was close to the location and knew anyone involved.All the evidence collected goes into what's called an Officer-Involved Shooting Report.Using the 2016 case as an example, the department report totaled 612 pages. While some of the information was redacted, the report contained sub-reports including: forensic biology report, chain of custody report, firearms lab report, crime scene lab report, vehicle report, witness statement, officer interview, death in custody report, property report, DNA sample report and a report with 586 pages of photos. The San Diego Police Department also released more than 100 audio and video recordings of 911 calls, radio traffic, witness interviews, officer interviews, and body-worn camera."It's not a rubber stamp," Morris said. "There's a lot of work that goes into it. People that really do want to find the truth of what happened in these types of incidents."The report is turned over to the San Diego County District Attorney's Office.According to the DA's website, "The police agency with jurisdiction over the location of the shooting or death conducts the primary investigation of the incident. After the police agency completes their investigation, the District Attorney's Office reviews it, which it does for all officer-involved shootings and in-custody deaths in San Diego County. If the District Attorney wants additional information to supplement the investigation, a request can be made to the jurisdictional agency to obtain the information, or the District Attorney's Office can conduct the additional investigation. The District Attorney's Office does not do a separate, new investigation of the incident." The District Attorney's Office states that when a review is completed, "If the District Attorney's Office determines there is criminal liability, charges will be filed against the officer or deputy. If there is no criminal liability, a letter is written summarizing the facts, evidence, and available statements of those involved. The letter is delivered to the Chief of Police or Sheriff of the jurisdictional agency indicating the actions of the officer or deputy was legally justified. The letter is also posted on the DA's website where any member of the public can read it."If there are no criminal charges pending, internal affairs will take the criminal investigation and do their investigation. Internal Affairs "With an officer-involved shooting, the most important thing we're looking at was if that use of force was within our policy," Morris said.He explained when the case gets to internal affairs, it is assigned to a detective sergeant. The detective sergeant will review the entire case, looking at whether the lethal use of force was within the department's policy and if the officer followed the proper procedures."There are times where we will bring that officer back in again and interview them," Morris said. "We narrowly focus it to what we're looking at, but we may interview them on something that we've seen or some sort of policy and procedure concern, or it could be something outside of that particular use of force."Morris said once the detective sergeant's investigation is complete, it will be put through a review process in-house. The completed investigation will be submitted to the Community Review Board on Police Practices (CRB)."Their main task is to make sure that we haven't left any stone unturned and that we've looked at every aspect of the investigation and that our investigation is thorough, complete, and impartial," Morris said. 6178

"Before we have to do something different," Walrath continued.He had a talk with his boys about how practice is going to be different to protect them from coronavirus.When quizzed, his sons answered correctly, "no dugout during practice," Austin said. "Stay six feet away." Walrath reminded them, "we're not going to be doing high fives and stuff like that... and no games right away."While Austin wasn't enthused about the new protocol, he was excited to see his friends for the first time in months at practice Monday.President of Sweetwater Valley Little League Arturo Maldonado said they are rolling out practice in three phases. Monday was the beginning of phase one with kids ages 10-15. This weekend phase two will start for kids ages 7-10 and as soon as June 26 the youngest ball players ages 4-7 will get to come back to practice."Everybody's learning how things are going to be done out in the field and that's why we're doing it in three different phases so that we can make adjustments," Maldonado said.He said managers and coaches will be wearing masks, but the kids don't have to. He said the kids will be encouraged to socially distance.There won't be any hugging, high-fives, or sunflower seeds and hand sanitizer is always close by. The dugout will be expanded to the stands, Maldonado said, to accommodate for social distancing.Parents aren't allowed at practice yet and sick players are encouraged to stay home.Monday Walrath said the boys played wiffleball, just as they would any other day."We're not going to change the game of baseball. We're changing how we're watching the game of baseball," Maldonado said.Walrath said safety is a priority for every family. "There's always health concerns in sports, whether that's normal injury concerns. Coronavirus adds a new twist to health concerns and just like with anything else I think this is a personal risk decision for each and every one of our families," Walrath said.Sweetwater Valley Little League has a history of big wins, making it to the Little League World Series in 2015, and Regionals in 2019.Families hope to get their kids some social interaction after months of staying at home and keep them safe. 2426

SAN DIEGO (KGTV) — Efforts to streamline the construction of a massive transportation hub in the Midway District and update the Navy's Old Town campus have been approved by the state.Gov. Gavin Newsom signed AB 2731 this week, which will allow the San Diego Association of Governments (SANDAG) to quicken the environmental review process in order to build a transit hub connecting to San Diego International Airport and redevelop the Naval Information Warfare Systems Command (NAVWAR) Old Town campus site, should the Navy partner with SANDAG.The bill, introduced by California State Assemblymember Todd Gloria and Senate President pro Tempore Toni G. Atkins (D-San Diego), will allow SANDAG to use the Navy's environmental document as the basis of its California Environmental Quality Act document and requires most legal actions over the project to be resolved in 270 days.RELATED: Mayor Faulconer, Acting Navy Sec. agree to make NAVWAR facility a transit hubThe bill will also require the transit hub to meet high environmental benchmarks, such as LEED Gold certification, reducing vehicle miles by 25%, and be greenhouse gas neutral in exchange for the streamlined environmental process."This bill represents a unique opportunity to protect the existing 5,000 Navy jobs from relocation, create a 21st-century transportation system in San Diego, and provide desperately needed economic stimulus to our local economy in the wake of COVID-19," said Gloria. "This project has the potential to generate at least 16,000 jobs and provide housing for up to 27,000 residents – both of which we know are desperately needed. SAN DIEGO (KGTV) — Holiday light displays are one of the best aspects of the holiday season.Thousands upon thousands of lights in some cases dress up homes and businesses throughout San Diego County, bringing out families and friends to enjoy the sights and sounds of the season.Throughout the county, San Diegans have numerous displays to drive to and admire. Some are snuggled in cul-de-sacs around town, others, larger events that continue the fun throughout the end of the year.Here's where you can catch San Diego's best light displays this season:(Links for display locations can be found by clicking the location in the map above.)Displays"Carlsbad Christmas House" can be found on Romeria Street in Carlsbad. Lights are on display from Dec. 2 to Dec. 31, from 5 p.m. to 10 p.m. (closed rain days.) "Christmas on Knob Hill" is located at Knob Hill Road in San Marcos. Lights are displayed from Nov. 22 to Dec. 30, from 5 p.m. to 9 p.m. Santa will make an appearance from Dec. 14 to Dec. 23, from 6:30 p.m. to 7:30 p.m. "Candy Cane Lane" covers Hickory Ct., Hickory St., Butterwood Ct., and Rockrose Ct. in Poway. "Christmas Card Lane" is located on Oviedo St. off Black Mountain Rd. in Rancho Penasquitos. "Belardo Lights" runs on Belardo Dr. through Dec. 27. Lights will be on from about 6 p.m. to 10 p.m. nightly. "Starlight Circle/Sunburst Santee" covers Tomel Ct. off Magnolia Ave. in Santee. Residents have their own schedule for how long lights will be up, but they’ll generally be on from about 5:30 p.m. to 10 p.m. "The Forward House" in Banker’s Hill is located at Ivy St. and 1st Ave. The house will be lit generally from 5 p.m. to 10 p.m. Events"December Nights" will hit Balboa Park on Dec. 7 and 8. The park will be decked out in lights as well as holiday music, vendors, and food. "Jungle Bells" welcomes the holidays to San Diego Zoo from Dec. 14 - Jan. 6. The park will run daily light shows and entertainment with zoo staff and animals. "San Diego Bay Parade of Lights" brings out boats dressed in hundreds of lights to the bay, as they parade on the water Dec. 9 and 16. "Garden of Lights" at San Diego Botanic Gardens showers the garden in more than 125,000 lights, and hosts marshmallow roasting, a musical light show, and more. "Christmas Celebration" at SeaWorld San Diego runs from Nov. 17 to Jan. 6, bringing a 40-foot Christmas tree, Santa’s village, and delicious foods to the theme park. 2429

  

SAN DIEGO (KGTV) - Finding a place to live is about to get easier for low-income San Diegans.Right now, landlords are not required to accept tenants who receive Section 8 rental assistance. However, in August 2019, a new amendment to San Diego's source of income ordinance will prevent landlords from declining a tenant-based only on the household receiving rental assistance."It's safe and everything is right across the street from me," said Maria Hernandez.That's how Maria Hernandez describes her neighborhood in Poway.Maria uses the Section 8 voucher program to help pay the rent. She says she waited about five years for that help."You know without Section 8, I don't know where me or my daughter would be," Hernandez said.Hernandez is lucky. Her landlord accepts Section 8. That's not always the case."I guess there's like that stereotype of people that are on Section 8, you know they think people are going to destroy their homes that people are poor who live on Section 8."Starting August 1, 2019 landlords and property managers in the City of San Diego cannot refuse an application from a prospective tenant, charge a higher deposit, or treat them differently in any other way based on their source of income.According to the San Diego Housing Commission, under the new ordinance, landlords and property managers cannot advertise or state a preference for certain sources of income. The tenant must still meet other requirements for tenancy and have the financial resources to pay any rental amounts not covered by the voucher/subsidy. Landlords and property managers must include any rental payments made by the voucher/subsidy when determining whether the applicant meets the minimum income requirements. Landlords and property managers may ask what an applicant's source of income is as long they do not discriminate based on that information."I want to give an equal treatment to every single San Diegan," said San Diego City Council President Georgette Gomez. "No matter how you're going to pay your rent, everyone should be looked at as an equal applicant."Gomez championed the changes to the city's law. She says for some it could be life-changing, allowing renters to choose what part of town they live in not just who accepts their form of payment."It's not just about housing, but better jobs and just an ability to not have that stress," Gomez said.The anti-discrimination policy is just one move making things more comfortable in San Diego.According to SDHC, "Effective July 1, 2019, SDHC increased its payment standards for the Section 8 Housing Choice Voucher rental assistance program, which helps more than 15,000 low-income households pay their rent. Raising the "payment standard" expands rental opportunities for families by allowing them to consider housing units with higher monthly contract rents, which are paid by a combination of rental assistance from SDHC and a portion of the tenants' income."Also, starting in August, the SDHC will launch the Landlord Partnership Program, which provides incentives to landlords to rent housing units to SDHC Section 8 Housing Choice Voucher rental assistance participants. SDHC tells 10news it will expand the Landlord Services Team, composed of specialized staff, to provide quality customer service to landlords and support families in the move process to ensure timely lease-ups.The agency also launched The Landlord Advisory Committee to identify best practices, programs, and incentives to attract new landlords to the Section 8 Housing Choice Voucher program. Hernandez tells 10News she's not looking for a new place to live, but if she were ever forced to make a change, she feels more secure knowing it easier to find somewhere to live."It will help people put roots down into a place," Hernandez said. 3792
