BUFFALO, N.Y. — A Buffalo man seen in cell phone video being punched in the head repeatedly by a Buffalo police officer plans to sue the city, the police department, the police commissioner and both officers involved in his arrest.An attorney representing Quentin Suttles, 30, has filed a notice of claim in State Supreme Court. Suttles claims Buffalo Police Officers Ronald Ammerman and Michael Scheu used excessive force when they pulled him over and arrested him on May 10.The arrest, which was recorded on a bystander's cell phone video and police body cameras, shows one of the officers punching Suttles in the head repeatedly while he is on the ground.The claim also accuses the city, the police department and Buffalo Police Commissioner Byron Lockwood of not providing officers with proper use of force training and not providing adequate supervision of their actions.According to the claim, Ammerman and Scheu followed Suttles' vehicle for several minutes and pulled him over after he "committed a minor traffic offense." Police said Suttles was going the wrong way down a one-way street.During a search of Suttles after he stepped out of his car, the claim states the officers "had engaged in prolonged grabbing of his genitals while finding no contraband. The officers...then grabbed his hands and while throwing him to the ground advised that his hands need to be out of his pockets...while his hands were either against the car, or being held by the officers."Suttles' attorney said when a bystander recording the altercation asked why they were punching Suttles in the head, the officers responded by saying they were saving his life because he was trying to eat drugs.The claim also accuses the officers of not seeking medical treatment for Suttles until the following day, despite the fact that he suffered serious injuries.The police report from the incident states that officers noticed a strong odor of marijuana coming from Suttles' vehicle after pulling him over for driving the wrong way."While conducting a pat down, searched defendant did push off vehicle and fight with officers," the police report states. "Defendant continued to fight and reach in his pants, ignoring officers command to stop resisting."The report also says officers recovered a white powder substance from Suttles' left pocket.In an attempt to handcuff Suttles, police say he was taken down to the ground. In May, a police source said that Suttles had drugs on him and tried to destroy the drugs while officers were handcuffing him.In the video, one officer says, "let it go," and "I'm trying to get the drugs.""You're making this hard on yourself," another officer says in the video.A woman off-camera also told Suttles to "stop resisting." Suttles told the woman that he wasn't resisting.The Erie County District Attorney's Office is investigating the incident.Both officers remain on duty with the Buffalo Police Department.The lawsuit comes weeks after a 75-year-old protester was shoved to the ground by Buffalo police officers while peacefully demonstrating against police brutality after curfew. BARNEGAT LIGHTHOUSE STATE PARK, N.J. — A dead whale is sitting on a New Jersey state park beach after a Christmas storm blew through the northeast.The humpback whale is near Barnegat Lighthouse State Park in Ocean County. It is unclear at this time how the roughly 20-foot-long whale died, according to the Marine Mammal Stranding Center, a marine animal focused organization that responded to the whale Saturday. They said it could have been hit by a boat or something else during the storm, or died from contracting a disease. In addition to coming ashore on a holiday weekend, when few state employees are working, the below-freezing temperatures are also delaying the whale’s removal.“The whale’s too frozen,” Bob Schoelkopf, the director of the Marine Mammal Stranding Center said. “We can’t even cut into the blubber, it’s too thick and frozen.”Schoelkopf believes the dead whale was washed ashore on Christmas Eve, then taken back out to sea on Christmas as a large storm came through, and then came back ashore Saturday.Anyone visiting the area should stay clear, Schoelkopf said, because of the possibility for diseases to be in the carcass.Whale watching boats had spotted the whale alive earlier this year in Sandy Hook bay, where it had been photographed feeding, Schoelkopf said.In September, a different humpback whale was found dead off the Jersey Shore after being entangled. Another dead humpback whale was found floating off Cape May in November.The National Oceanic and Atmospheric Administration declared an “unusual mortality event” for humpback whales in 2017, after high numbers of whales were found dead from Maine to North Carolina. BALTIMORE, Marlyland — A mother living without her teenage son who was shot and killed last year got to meet the girl whose life he saved with his heart.    Xavier Young was an organ donor.Although lost to gun violence, his gift saved more than one life — it saved an entire family."I think he really wanted me to see that he’s OK and his heart is also still going," said Jennifer Young.Young is Xavier's mother. He was 14 years old when he was shot and killed in Laurel, Maryland last year."We buried him a year ago back on (November 6) so this week has been really tough," Young said.But in darkness, there is a little light as Young met the girl who now holds her son's heart."My son would’ve loved to meet her in life and would’ve heard about her all the time so it’s bittersweet to me," said Young.For Gwendolyn Ihm's family, it was an emotional and humbling meeting."As we celebrate Gwendolyn’s heart transplant, we also have to remember that at that same time there’s another family that are remembering another year of not having their loved one with them," said Brian Ihm, whose daughter now has Young's heart.Ihm was diagnosed with leukemia before she was just 2 months old and the radiation wreaked havoc on her heart."Without Xavier’s heart Gwendolyn would not be at school, she would not be running around, she would not be able to participate like all the kids," Ihm said.Young heard her son's heart beating inside of Gwen."It’s not really him. It’s a piece, and that’s amazing too," said Young.The families have spoken but never met. "I just feel like they remind me so much of him. It’s like he went back to family is what I want to say," Young told WMAR.Xavier was able to donate seven organs and save five lives after his death last November."Without the help of God, maybe Jennifer (Young) wouldn't have made the decision that she made," said Ihm.The hope is for Gwen to be a normal 13-year-old."We just want her to have a couple of good years of health," Ihm said, "and Xavier’s gift has given us that." 2126
