SAN DIEGO (KGTV) - Southcrest neighbors banned together to file a lawsuit against the City of San Diego, claiming a city park was not designed to properly drain and therefore floods the neighborhood each time it rains.Last December was the breaking point for neighbors near Southcrest Trails Park, at S. 37th Street and a dirt road behind houses situated on Beta Street. They say feet of water flooded into their homes."This actually becomes a sinkhole, this area," said Greg Montoya, who is leading the charge with his hefty binder full of decades of documentation of the problem. Montoya has pictures of his white pickup truck sunken rims-deep into his yard due to saturation.The lawsuit describes it as "a 66-acre, 1.2-mile corridor in the Southcrest neighborhood of San Diego to construct Highway 252, which would connect Interstate 805 and lnterstates 5 and 15."The project never materialized, Montoya says, because St. Jude, thinking of the school, put up a fight."So then the City of San Diego put dirt berms in to keep people from driving back here, to keep people from throwing trash back here, because it became a dump," Montoya said. The park took shape in 2003, according to the lawsuit.Montoya and other neighbors say there was not enough drainage put in, sending water running down the five-foot berm every time it rains.A storm in December 2018 left many stranded, including Ricky Vasquez, who was trying to pick up his one-year-old son."Other cars were stuck in the middle of the street because the water was so high," said Vasquez.Neighbor Pastor Nicolas Martinez said his home flooded, ultimately costing ,000.Montoya was fed up."San Diego's America's Finest City for some but not for all because I've got documentation for over 30 years for asking for help for this situation that they've created and I'm just ignored," said Montoya.He went to attorney Evan Walker, who said his team found one of the two storm drains at the park "is not connected to any sort of system despite the city's own plans to connect them to the system."Montoya hopes the lawsuit causes the city to step up.10News reached out to the City of San Diego who said they could not comment on ongoing litigation. 2211

SAN DIEGO (KGTV) — San Diego Unified School District is warning parents and staff of a breach involving the personal data of students and staff.District official said in a release the breach dating back to January 2018 may have impacted the personal data of as many as 500,000 students enrolled in the district between the 2008-2009 and 2018-2019 school years.The data is believe to have been accessed by a phishing email effort, according to the district. Those staff members and parents affected have been alerted by SDUSD.Officials said investigators began looking into reports of phishing emails in October 2018. At that time, roughly 50 staff members whose accounts were compromised had security on their accounts reset immediately, according to the district. An investigation determined that unauthorized access was gained to the district’s network services, including their student database. The student database contains personal identifying information, potential health information, scheduling, and grade information.The district says it has since taken steps to prevent unauthorized access from reoccurring and to "eliminate" any continuing threat.SDUSD told 10News the breach wasn't announced until now because officials wanted to verify all their information and not compromise the investigation.“Data security has become an increasing concern for public agencies, corporations and private citizens nationwide,” Toren Allen, executive director of San Diego Unified’s Integrated Technology Department, said. “We are constantly reviewing our practices and systems in an effort to find efficiencies and to identify potential vulnerabilities.”The district recommends that anyone whose data may have been accessed to remain vigilant of their credit cards and account and contact a credit reporting agency to notify them of the breach of information. SAN DIEGO (KGTV) - Some local leaders believe a significant number of homes that could help ease the housing shortage are actually vacant, and it may be time to consider a 'vacancy tax.'On any given night, amid the bright lights of the downtown skyline, are the not-so-bright, 41-story towers of the Harbor Club condominiums. Aaron Howe lives two blocks away."Just kind of empty and lonely. You see a few lights, but it's mostly dark," said Howe.Sources tells 10News, at various times in the past decade, as many as half the units have been vacant, meaning they are not a primary residence. I'm concerned you have people making investments in their fourth, fifth and sixth homes. To tackle the housing crisis, you can't just build something you call housing. According to the the real estate tracker CoStar, San Diego's vacancy rate is about 4.5 percent. A healthy market is around 7 or 8 percent, but those numbers generally account for apartments, not single family homes and condos. Months ago, the San Diego Housing Commission directed staff to look into more accurate vacancy numbers, a first step that could lead to the proposal of a vacancy tax, similar to one enacted in Vancouver, British Columbia in 2017. "Housing prices were going up far faster than local incomes were. The program recognizes schools based on performance and progress on state indicators. Those indicators include test scores, suspension rates and conditions and climate, according to the State Superintendent. Schools hold their titles for two years because elementary schools and middle and high schools are recognized on alternate years.
