SAN DIEGO (KGTV) - The former gang member who killed San Diego Police officer Archie Buggs in 1978 was granted parole suitability Thursday.Jesus Cecena was 17 years old when he opened fire on Officer Buggs during a traffic stop in Skyline. According to the San Diego County District Attorney’s Office, Cecena fired five times at Buggs, then paused, walked toward the fallen officer and fired a final bullet into his head at point blank range. The officer died on the street, his hand still on his service revolver.Cecena was sentenced to life in prison without the possibility of parole. His term was later modified, due to a change in law making him eligible for Youth Offender Parole.Cecena has been denied parole at least 13 times. Governor Brown reversed the parole board’s decisions to release Cecena in 2014, 2015 and 2017, citing the seriousness of the crime.RELATED: San Diego Police honor officer shot and killed by gang memberIn 2014, 10News reported that Cecena’s unstable social history continued during his incarceration, where authorities said he received more than ten violation reports for misconduct while in prison.Thursday’s parole board recommendation will move into a 150-day review period, according to a California Department of Corrections and Rehabilitation spokesman. After that period, the Governor will have 30 days to uphold, reverse, modify, send it to the full Board of Commissioners for another review, or take no action.The parole review period will end in January 2019, after the end of Governor Jerry Brown's term, leaving the decision in the hands of his successor. 1609
SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children. Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids. I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up." He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home. Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809
SAN DIEGO (KGTV) -- The family of the man killed in a wrong-way crash on Interstate 5 Monday morning says the California Highway Patrol got it wrong. According to them, their brother - Justin Callahan - was a driver, but not the driver who caused the crash. RELATED: Driver killed, 2 hurt in wrong-way crash on I-5On Monday CHP told 10News the following: Just before 2 a.m. Monday, a Volkswagon Jetta was traveling eastbound in the westbound lanes of Inerstate 8 from Sunset Cliffs Boulevard. As CHP officers responded, the Jetta entered the northbound Interstate 5 transition ramp to the westbound I-8 in the wrong direction and collided head-on with a Toyota Camry.An SUV then crashed into the back of the Camry, the CHP said.The driver of the Jetta was 35-year-old Justin Callahan, who was declared dead at the scene. Justin's family says he usually drives home from work at the time and would have been traveling in the opposite direction - from Chula Vista to his home in Ocean Beach. Based on that information, they tell 10News the CHP's report just doesn't add up. "It doesn't make any sense," his brother, Tommy Villafranca, said. "Why would he get back on the freeway and get back the opposite direction?"And if Callahan did turn around and got back on the freeway, the timing doesn't add up, his brother said. He says his work caught on security video leaving at 1:38 a.m. and the crash happened less than 20 minutes later."It takes 21 minutes just to get from his work to Sunset Cliffs Boulevard," Villafranca said. "He’s still got to turn around go back, and that would take even more time, so the timeline is not working at all."The family has created a GoFundMe to help them pay for arrangements necessary to get Callahan back to Wheatland, California and arrange a funeral. SAN DIEGO (KGTV) - The California State University Chancellor said Friday the schools will not increase tuition for the 2018-2019 academic year, and demanded the state fund the system's critical needs.CSU Chancellor Timothy P. White said it was in the state’s best interest to fund the university’s critical needs supporting student access, achievement, and degree completion.“In light of California’s strong economy, California’s students and their families should not be saddled with additional financial burden to attain public higher education,” said White. “We will continue to make the case to lawmakers, who represent all Californians, that an educated citizenry should be at the top of the state’s highest priorities.”Last year, nearly 100,000 CSU students earned bachelor’s degrees and 20,000 earned graduate degrees.In November, the CSU budget request sought an increase of 3 million. The system considers its most pressing needs to be enrollment growth, a graduation initiative, increases for employee compensation, healthcare and retirement costs, facility operations and infrastructure requirements.Governor Brown’s budget proposal included an increase of .1 million.10News reached out to the CSU chancellor to find out how officials planned to compensate for the funding gap. Come January 30, the mall will roll out its 'secured parking plan' aimed at keeping non-shoppers from parking on the property.Customers can park free for the first two hours and then pay per additional hour, with a daily maximum of . While the parking stations have been in place for months, some mall employees say they were blindsided to learn they too might have to pay for parking. Mall officials say employers have the option of purchasing parking passes for employees. If not purchased by the employer, individual employees may purchase the passes themselves.“It’s another bill to put on top of the rest," said one employee, who asked to remain anonymous for fear of being fired. His employer will not be purchasing parking passes for employees. The anonymous employee says they were told daily passes will cost and monthly passes will cost .“Personally it’s 0 out of my budget each year to go to work, and that’s on top of car payment and insurance," said the employee.He's concerned for mall employees who only make minimum wage and cannot afford the extra cost. While the mall is offering subsidized public transit passes, the concerned employee says that's not an option for everyone. He wishes there had been more transparency about the policy in the months leading up to January 30 roll-out.
