But there are three things to consider before making an ADA claim, according to lawyers.First, to bring a successful ADA lawsuit, attorneys say the person without a mask must truly have a disability. There's a third component in the ADA: Subsection 36.208 allows businesses to turn disabled people away if they pose a direct threat to the health and safety of others."Someone not wearing a mask, they might think they're not infected, but they could be and pose a direct threat to spread the virus to many people," Elia said.The Equal Employment Opportunity Commission has said COVID-19 does constitute a direct threat, so our experts say the threat of a successful lawsuit in a case like this is low.That said, there's nothing stopping people from filing these lawsuits. It's because the city - with a median home price of .7 million - has no affordable housing. "If they could live here and walk to work we'd get all kinds of benefits from that," said Del Mar Mayor Dwight Worden. To help make that happen, Del Mar may start charging developers of condos and condo conversions fees by the square foot. That could add to more than a hundred thousand dollars per project for affordable housing. Right now developers of those projects pay a flat fee of ,500, which hasn't been updated since 2007.The city council is considering a per square foot charge for existing construction and per square foot for new construction.The money would either go to expanding Del Mar's rent subsidy program, which currently assists five families in the city.Worden, however, said he prefers physical units because they are there forever. So far this season, 341 people have died from the flu including two new deaths reported over the last week.Those who died ranged in age from one to 101.The high number of deaths this season is a result of an unusually severe flu season, but was also due to better reporting and tracking, County Health and Human Services reported.“It appears that we’re at the end of this flu season,” said Wilma Wooten M.D., M.P.H., County public health officer. “However, people should continue to take precautions to avoid contracting the virus.”In total, more than 20,000 lab-confirmed flu cases were reported this flu season compared to just over 5,400 the previous year. 880
