The nation's bankruptcy laws place limits on the severance payments that can be made to laid-off employees, and they give priority to repaying creditors of the bankrupt companies.Had the employees been laid off before the bankruptcy, they would have been entitled to severance pay of up to one week of pay for every year of service.The million severance fund does not come from Toys "R" Us.The fund was set up following negotiations between the private equity firms and various public interest groups that organized the employees, including Organization United for Respect, Private Equity Stakeholder Project and Center for Popular Democracy."This Fund begins to ensure the hard-working people who spent their lives building Toys 'R' Us and making children happy are not left out in the cold," said Marilyn Muniz, a New York-based Toys "R" employee for nearly 20 years.The groups are seeking additional contributions to the fund from Vornado as well as two Toys "R" Us lenders, Solus and Angelo Gordon, which pushed the company to shutdown operations rather than stay in business. Solus did not respond to a request for comment and Angelo Gordon declined to comment.Tracy Forbes, a former employee who lost her job, told CNN Business that she had worked for the company for 31 years, making her way up to store manager of a Babies "R" Us store in Tempe, Arizona. At the time of the bankruptcy filing she figured she would get about seven months of severance if her store shut down. She said she was shocked when she learned the promised severance wouldn't be paid."It was very difficult," she said. "Here in Arizona, unemployment is only 0 a week. It's not even minimum wage. It was rough. I only got by with friends and family helping me out."After about four months she found a job as an assistant manager of a Home Goods store, which pays less than Babies "R" Us. She said she's kept in touch with the employees who used to work with her at Babies "R" Us."Just about everyone has found some kind of work, but it generally took three or four months," she said. "Some aren't earning as much. Some of the lower-level employees have actually found better paying jobs."The fund has hired attorney Kenneth Feinberg to come up with a formula to determine who gets how much money. Feinberg has made a career deciding distribution to victims of events, such as the terrorist attacks on September 11, 2001, and the BP Deepwater Horizon oil spill. He has proposed that payments go to workers who had been with the company at least a year and who made between ,000 and 0,000 in annual income."In order to maximize the impact of available funds, key eligibility requirements and payment parameters had to be instituted," said Feinberg. Payments are expected to start soon after December 15 and be completed by April.The million fund will not cover a full severance plan for the workers. The employee groups estimate that would take million.The proposed payment schedule provides at least 0 to anyone eligible for payments and as much as ,800 to the top earning employees -- those earning more than 0,000 a year who had been with the company for more than 25 years. USA Gymnastics CEO Kerry Perry apologized Wednesday for the "horrific acts" of Larry Nassar at a congressional hearing examining the Olympic community's role in sex abuse scandals."I want to apologize to all who were harmed by the horrific acts of Larry Nassar," Perry said.She said she was "appalled and sickened by the despicable crimes" of Nassar and said USA Gymnastics has taken a new course over the last five months to protect athletes.Perry was appointed to take over USA Gymnastics late last year. Two Kansas girls whose disappearance from a Kansas home triggered a multi-state Amber Alert on Saturday were found safe in Oklahoma.The Oklahoma Highway Patrol said Saturday night that it has recovered the girls and taken their father, 40-year-old Donny Jackson of Leavenworth, Kansas, into custody.Earlier on Saturday, The Kansas Bureau of Investigation said that Jackson may have been involved in the homicides of two other children, who were found dead at the home from where the girls had been abducted.The Leavenworth County Sheriff's Office responded to a call at a home around 1 p.m. local time Saturday, where deputies located two deceased juvenile males and discovered two young girls were missing.It's unknown exactly when the double homicide or the abduction occurred. Two influential staffers at the Environmental Protection Agency are leaving the agency, CNN has learned.The security chief for EPA Administrator Scott Pruitt and the leader of the agency's Superfund cleanup program are both departing, according to an internal email and an agency statement, respectively.The exits come just days after Pruitt's management of the agency, including substantial spending on his personal security, travel, and office, came under scrutiny at back-to-back congressional hearings.Pasquale "Nino" Perrotta, the special agent in charge of the Pruitt security detail, announced his departure in a one-sentence email to colleagues on Tuesday morning."It has been a tremendous honor to serve as a special agent for the past 23 years and I wish you all a safe journey ahead as you move forward in both your professional and personal lives," Perrotta wrote.The security team overseen by Perrotta, a former Secret Service agent, has ballooned under Pruitt. Expensive and elaborate practices, such as flying in first class airplane seats, have drawn the attention of watchdogs like the EPA's own inspector general.Rep. Trey Gowdy, a South Carolina Republican, has indicated the House Oversight Committee, which he chairs, is interested in interviewing Perrotta about Pruitt's security and travel. Perrotta's predecessor was pushed aside after refusing to drive Pruitt around Washington using police lights and siren, three sources familiar with the situation told CNN.The EPA has repeatedly defended the spending and security practices as necessary given an increased level of threats against Pruitt. The exact nature of his violations were not disclosed.Kelly's former bank, Spiritbank, handled the mortgage for Pruitt's 2004 home purchase in a suburb of Tulsa, Oklahoma. The bank was also involved in the purchase of a minor league baseball team by Pruitt and business partners.The New York Times reported that Kelly's bank also handled the mortgage on an Oklahoma City house Pruitt purchased through a shell company from a lobbyist.
