SAN DIEGO (KGTV) — The Last Real Gym on North Park’s University Avenue took to the streets immediately after it became illegal to operate indoors in mid-July.The whole experiment lasted five days.“The sidewalks are pretty dirty between dog poop, dog pee … and human poop from the homeless sleeping on my side of the building,” owner Frank Kole said Friday.Kole decided to move everything back indoors in defiance of the Gov. Newsom’s July 13 health order meant to slow the spread of the coronavirus.RELATED: Former member of The Gym in Pacific Beach shares experience“Indoors I'm able to bleach, sanitize, wipe after every single use on the equipment that a member uses, and there's not a homeless person or a dog coming by to pee on it in between that,” Kole said.Kole said he's taking serious measures to keep people safe indoors, with hand sanitizing stations, plexiglass barriers, directional walking signs, and instructions to wipe down equipment.And also, no mask, no access.“I'm not going to lie, I'm not being nice about it,” Kole said. “If you're not wearing your mask, get out. Cuz I have another sign that says ‘masks on.’ If I have to remind you to put your mask on, I'm going to ask you to leave, I'm not playing games.”RELATED: County confirms coronavirus outbreak at Pacific Beach gymKole moved back inside July 20. Since that time, county officials identified a different gym that defied the order, called The Gym in Pacific Beach, as the site of an outbreak.Kole expressed confidence in his safety measures. He says San Diego Police officers have visited him twice, educating him, but he still has not received a county warning letter.In a statement, a county spokesman expressed regret for Kole’s situation.“While we sympathize with his situation outside, moving back inside goes against current state guidance for gyms,” the statement said. “It would be ideal if he could get some assistance from his local government to allow for safe, clean operations outside.”RELATED: Gyms lawyer up to stay open amid pandemicA spokeswoman for the City of San Diego said the area would be noted on the next scheduled sidewalk cleaning for North Park, Aug. 5. However, that is not the case with California Junior Colleges, otherwise known as the CCCAA, as they have already come up with a plan for the fall. That means for the next 5 months, athletic fields at Mesa College will be quiet until early 2021."There was a lot of talk," says Mesa College Athletic Director Ryan Schumaker, "and a lot of plans, that included getting sports back on the field quicker. But it just didn't seem feasible, especially when we saw the state start to take steps backwards. It just seemed like the right thing to do, to push it back as far as we could."So in the case of Mesa College, all 21 of their athletic teams will not get started until some point in the spring."The goal is to get our student athletes on campus safely, as well as our staff," says Mesa College Head Football Coach Gary Watkins. "I know we won't start practice until February, but there may be some time in January to get in front of the boys. At that time, will get them acclimated physically and mentally. Now, more than ever, they have to be all in on their academics, and their future development."And with will all sports being pushed back until the spring, the athletic department at Mesa will have to figure out how to share the facilities."The spring is now split into two distinct seasons. We don't have all the answers yet, but we are working diligently to make sure all of our sports are taken care of for practice time and we also leave time for general population classes." 1593

SAN DIEGO (KGTV) -- The 21-year-old killed while driving across the trolley tracks near Encanto has been identified.The San Diego County Medical Examiner says Alex Garza, 21, was believed to be distracted, possibly on the phone, when he reportedly tried to drive his Toyota Prius across the tracks just before midnight at 60th Street and Imperial Avenue. The vehicle was struck by a trolley before it became pinned against a poll.San Diego Police and fire units responded to the scene where Garza was pronounced dead. 525

  

SAN DIEGO (KGTV) - The City of San Diego released Friday body-worn camera video and hundreds of pages of documents related to a 2018 officer-involved shooting. Raul Rivera was shot and killed by police on Hollister Street and Tocayo Avenue in May 2018 after police say he came at them with a knife. The new documents show police collected 28 9mm cartridge casings, nine bean bag cartridge casings, and four Taser cartridges from the scene. At one point, the video shows police tasing Rivera. He appears to rip off the barbs and continued to struggle. After several minutes, the violent scene comes to an end when police shoot and kill Rivera. They say he charged them with a knife. The San Diego County District Attorney's office did not bring charges against any of the three officers who fired.The report noted, "law enforcement officers were confronted by an agitated subject who was armed with a knife and was under the influence of narcotics. Mr. Rivera urged officers to shoot him as he advanced toward them."  At the time of the shooting, family members told 10News Rivera was in a bad mental state and wished the police had helped him, not hurt him. On Friday Rivera's sister told Team 10 investigator Adam Racusin she was too shaken to talk about the loss of her brother. She would only say that she loves him and is disappointed in the way police have handled things to this point.  1495
