SAN DIEGO (KGTV) - It wasn't the opening day anyone envisioned, but by game time, foot traffic had picked up around Petco Park.It was vastly different compared to past years, according to Brant Crenshaw. He owns Social Tap San Diego, located next to the ballpark. Due to public health orders, the capacity at their restaurant was significantly reduced. However, they were able to fill the tables and chairs set up in their outdoor areas, and by the start of the game, they had a healthy waitlist.Crenshaw says despite the pandemic, Opening Day still brought more people out than usual."This is baseball. We're Americans. They go hand in hand," he said. It's definitely special and were playing the hand we're dealt."Meanwhile, there were many fans spotted decked out in game-day gear trying to catch a glimpse of the game from their balconies near the ballpark. Some fans waved Padres flags from the balcony to show support.Chip Messenger kept opening day tradition going by watching from his balcony. He has a great view of the field and has invited a small group of people to watch the game from the outdoor vantage point. He plans to share the spot with other people as the season goes on."I run a tight ship on opening day, this is my 8th or 9th opening day from my balcony," Messenger said. "So you invite people you can't have too many, but I want to start inviting people I don't know in a few days. There's going to be like some babies for the time, moms and dads, couples you know. I'll make it fun."Messenger says he usually leaves his balcony party to go to his seats at the ballpark, this year is different. But he is just happy to have baseball back after the season was delayed and shortened."It's about time," he said. 1741

SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation. The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. Medel stated that he would have a ruling by 5 p.m. on Friday. If not, he said he would issue his decision on Monday. 1916

SAN DIEGO (KGTV) — It's a challenge chickens around the world hope you don't attempt.A Rancho Bernardo man has set a new record for eating Chick-fil-A the most consecutive days in a row — barring the company's usual Sunday closure.Even before the challenge, Mark Mendenhall was a regular at the Carmel Mountain Ranch Chick-Fil-A, with employees dubbing him "Mayor of Chick-fil-A.""I have eaten everything on the menu, except the coffee and tea, I don't like coffee or tea, I've had every sauce," said Mendenhall.RELATED: Chula Vista Chick-fil-A employee saves man's lifeBy day he's a realtor, by dinner he's Mayor. "The food is great don't get me wrong, but it's the people here that make you feel good!" Mendenhall says.Several months ago, he heard about a Georgia man successfully eating Chick-fil-A 100 days in a row, excluding days when the restaurant is closed. "I thought to myself, I could do that! I could totally do that!" said Mendenhall.RELATED: San Diego County woman believes ultrasound image resembles late fatherHis wife, reacting differently."At first, I thought it was a little crazy, and I didn't think he'd stick with it, but then I could tell he was serious about it," said Mendenhall's wife, Laura. On a family trip to Disneyland, Mendenhall actually drove from Disneyland to his Chick-fil-A, ordered his meal, and then went back to Disneyland. "My dear wife asked me, when is all of this going to end?!" Mendenhall laughs. He decided he'd end the challenge when they went on vacation, so his wife promptly planned one to Palm Springs. Throughout the journey, Mark took a picture each day with employees, friends, and strangers, proof of his amazing streak. But his mission had another cause. Mendenhall also helped raise nearly ,000 for the Poway Unified School District Adopt-a-Family program through the challenge. 1846

SAN DIEGO (KGTV) -- Margaret Hunter, the wife of Rep. Duncan Hunter, changed her plea to guilty to one count of conspiracy in a plea deal with the federal government over misused campaign funds Thursday. As part of a plea deal with prosecutors, Margaret Hunter will testify against her husband in his upcoming trial in September. The congressman and his wife both pleaded not guilty in 2018 to federal charges of using 0,000 in campaign funds for personal use and falsifying campaign finance reports. "Defendant agrees to plead guilty to Count One of the Indictment charging her with conspiring with co-defendant Duncan D. Hunter to knowingly and willfully convert Duncan D. Hunter for Congress Campaign Committee funds to personal use by using them to fulfill personal commitments, obligations and expenses would have existed irrespective of Hunter's election campaign and duties as a federal officeholder, in amounts of ,000 and more in a calendar year," the plea deal states. Those expenses include a ,000 family vacation to Italy and a 0 Easter brunch at the Hotel del Coronado.READ THE PLEA AGREEMENT HEREThrough her attorney, Margaret Hunter apologized for her actions through her attorney outside Federal Court on Thursday."I understand that there will be more consequences stemming from my actions, but as demonstrated this morning with the entry of the plea, I have taken the first step in facing those consequences," said Tom McNamara, her attorney, in a prepared statement.According to an affidavit, Hunter allegedly spent the money on expenses like vacations, dental work, tuition, movie tickets, video games and home utilities, among other things. The affidavit goes on to allege that the Hunters lied about the purchases in FEC filings, claiming the money was used for things like dinner with volunteers or campaign contributors, toy drives and teacher/parent events.Rep. Duncan Hunter issued a statement which reads:"I do not have the full details of Margaret’s case, but it's obvious that the Department of Justice (DOJ) went after her to get to me for political reasons. As Margaret’s case concludes, she should be left alone. I am the Congressman, this is my campaign and any further attention on this issue should be directed solely to me. The DOJ’s prosecutorial actions in this case were led by local U.S. Attorneys who attended Hillary Clinton fundraisers in violation of the Hatch Act. The fact remains that this entire matter should have been handled by the Federal Elections Commission (FEC). The DOJ purposely choosing to involve itself in the area where the FEC has primary jurisdiction reveals that their primary agenda was to inflict as much political damage as possible in hopes of picking up a congressional seat. It was politically-motivated at the beginning, it remains politically-motivated now."A trial date was set for September 10, 2019, but that is expected to change following this morning’s court appearance. A conviction would not force Hunter out of office. It takes a two-thirds house vote to do that, meaning 55 Republicans would have to move the same. San Diego Political Analyst John Dadian said he believes Hunter would be expelled if convicted. He added President Trump could pardon him, but it would likely be after the 2020 election. Meanwhile, he said East County Republicans are preparing to file to run if they see an opening. SAN DIEGO (KGTV) — Jayce Tingler doesn't plan to be a homebody in the San Diego Padres clubhouse."I want to be shagging in the outfield ... If you're out being active, more organic natural moments will arrive," Tingler told reporters, saying that he doesn't plan to sit in his office often. The Padres introduced the former Texas Rangers coach to the media at Petco Park Thursday. In front of a backdrop of brown and gold, general manager A.J. Preller spoke on Tingler's experience and confidence in him managing the team starting in 2020. Notably, Preller said he was looking for someone players would "run though a wall for" in his search.RELATED: San Diego Padres to unveil new 2020 uniforms in NovemberBefore Tingler arrived in San Diego to don number 32, he worked with the Rangers has a field coordinator and interim bench coach. Preller hailed Tingler's experience in player development for the organization, and bilingual and communication skills. The duo worked together while Preller was a scout and assistant general manager in Texas. Preller said Thursday that Tingler had showed him that he's "comfortable being uncomfortable" from his success as a young manager in the Dominican Republic. But the big question for many outside of Preller's is Tingler's experience. He becomes the Padres 21st manager in franchise history and the team's sixth-straight skipper without prior MLB managerial experience."Look, I'm going to make mistakes. My guess is at some point the players are going to make mistakes. So we have some common ground," Tingler said. "I hope to learn quick. I hope to have people around from various areas of expertise."Part of the expected change between 2019 to 2020 will include other coaching positions. Tingler says he's looking to surround himself with a staff that pushes players."We're in that process. We're meeting with people. The bottom line, can you build relationships and can you impact players, can you push them and make them better," Tingler said.Tingler walks into a club that has under delivered for the last decade. Last season marked the Padres' ninth-straight losing season. Former manager Andy Green didn't fair better, posting a .428 win percentage during his four seasons with the team. The last time the team finished above .500 was in 2010, under then-manager Bud Black. To that, Tingler says he's confident in the current squad of players and looks forward to his new staff forming those all important relationships to impact young players — hopefully producing a winning season."We've got a lot of players with huge upside ... I think they shared that kind of undying passion to win here in San Diego," Tingler said. 2676
