SAN DIEGO (KGTV) -- A .2 million judgment against the San Diego Rock ‘N’ Roll marathon over injuries suffered by an elite wheelchair athlete was recently upheld.Craig Blanchette was born without legs due to a birth defect, but that has not stopped him pursuing his passions. He is a wheelchair racing champion. At 20-years-old, he won a bronze in the 1988 Summer Olympics and over the years, set more than 20 world records. “Wheelchair racing just fit me,” Blanchette said. He eventually took a break to compete in hand cycling, but was preparing to return to wheelchair racing. Court documents said he did everything to prepare for the 2014 Rock ‘N’ Roll marathon, including studying the course map and virtual tour several times. Documents state Competitor Group, which operates the marathon, eliminated a lane on Eleventh Avenue an hour before the race—a move that changed Blanchette’s life. “I wasn’t racing recklessly. I was definitely going to make the corner,” Blanchette said. “When it’s too late to do anything about it, I realized the course had been narrowed by 13 feet. It was significant.” Blanchette was not aware of the change and crashed into a car. He was going more than 20 miles per hour at the time, according to court documents. “It’s the crash that ended my career,” Blanchette said.He filed a civil case against Competitor Group. A jury ruled in his favor and the Court of Appeal recently upheld a judgment of .2 million in his favor. “It’s the best they can offer because they can’t me my racing career back,” he added.It was bittersweet for Blanchette, who had to undergo surgery and several months of recovery. “The doctors basically told me that if I went back to racing and I injured it again, they wouldn’t be able put it back together like I did the first time,” he said.Blanchette now hand cycles, which uses different muscles, and spends time helping other athletes. He has been part of the National Wheelchair Sports Camp for years and this year, Blanchette’s attorney is also helping out. “This case was very eye-opening for me,” said attorney Russel Myrick. “With the proceeds from the case, we intend to make big improvements to the camp and we’re really looking forward to working with the kids.” They hope this ruling will help other athletes with disabilities. “They didn’t accommodate for us in the way that we deserved,” Blanchette said. “[You] want to treat us the same in value, but not the same in function.” Competitor Group did not return Team 10’s request for comment. 2529

Officials say Bello then shook the person.The person was applying for admission to the U.S., officials said.As part of the plea, Bello agreed to resign from his position.“This is a rare and troubling situation,” said U.S. Attorney Robert Brewer. “We will always move swiftly to protect the public from officers who use their power to violate another person's Constitutional rights.”Bello will be sentenced on June 2, 2020. SAN DIEGO (KGTV) -- A 17-year-old boy accused of killing a Carlsbad woman on a popular hiking trail denied the allegations against him during a virtual arraignment Thursday morning.Through his attorney, the teen denied all allegations. He faces charges in connection with the Nov. 23 death of 68-year-old Lisa Thorborg.Thorborg was on a morning walk at Hosp Grove Trail when Carlsbad police investigators said she was attacked and stabbed to death.On Dec. 14, Carlsbad police announced the arrest of a 17-year-old boy in the case. Little information on the teen was released, but police noted the suspect is a Carlsbad resident.Thorborg's death struck a chord with many in the community. In the days following her death, a large group came to honor her by finishing the walk she started.The woman’s death also left many neighbors upset and concerned about their safety while on that trail.During Thursday’s arraignment, the judge also granted the teen's request to two phone calls -- one to his Mom, the other to his grandmother.ABC 10News learned Thorborg’s family was also listening to the hearing through the phone.Another hearing in the case is set for Dec. 22. 1173

  

SAN DIEGO (KGTV) - A controversial retirement center proposed by Skyline Church is moving ahead following a San Diego Planning Commission vote Friday.Officials voted five to one in favor of advancing to the development to the next step.Church officials are looking to build the retirement center in the Valle De Oro neighborhood. It would be located on almost nine acres next to Skyline Church. The 232 units would be made up of independent and assistant living spaces. The facility would also have a walking trail, offices, a pool, and clinics.Those who are in support of this plan say it’s needed because of the growing aging community in the San Diego County. "This application is more than just a request. It’s asking the County’s permission to serve our community, by seeking your permission for this retirement center," said Pastor Dan Grant of Skyline Church.Opponents say this will cause traffic problems in an already congested location along I-94 just East of Via Mercado. They add, this would be a huge environmental impact on the area.Now that the Planning Commission has agreed to move forward, they will bring this recommendation to the Board of Supervisors. 1180

  

SAN DIEGO (KGTV) - A former Camp Pendleton Marine was sentenced Monday to more than 17 years in prison for owning and distributing child pornography.William Walsh IV, 55, was arrested in May 2017. Escondido Police officers searched his home and seized hundreds of files Walsh had downloaded through peer-to-peer file sharing software.A jury found Walsh guilty of all charges. U.S. District Judge Anthony J. Battaglia said Walsh’s conduct was “on the extreme end of the cases I have seen.”“Today a man who committed terrible crimes against children was sentenced to many years in prison,” said U.S. Attorney Adam Braverman. “These horrible experiences will echo in the hearts and minds of young victims for a lifetime, and I am deeply distressed and deeply committed to pursuing cases that will protect our vulnerable youth from people like Walsh.”“Today’s sentence confirms that this predator can no longer victimize innocent children because he is off the streets and he is offline,” said FBI Special Agent in Charge John Brown. “This investigation showcases the success of collaborative federal and local investigations working toward a common goal.”Walsh will serve his sentence in federal prison. 1208
