NEW YORK (AP) — A federal judge in New York has ruled that Acting Department of Homeland Security Secretary Chad Wolf assumed his position unlawfully. U.S. District Judge Nicholas Garaufis's ruling invalidates Wolf’s suspension of the Deferred Action for Childhood Arrivals program, which shields young people from deportation. Wolf effectively suspended the program in July, a month after the U.S. Supreme Court ruled against President Donald Trump's efforts to end it. Garaufis wrote Saturday that DHS failed to follow an order of succession established when then-Secretary Kirstjen Nielsen resigned in April 2019. DHS did not immediately respond to a request for comment on the ruling. 696

NOBLESVILLE, Indiana — Concertgoers at a Rascal Flatts concert in Indiana on Thursday night were left wondering what happened after the event ended abruptly.Due to a "security concern," everybody in the band had to leave the Ruoff Home Mortgage Music Center, according to a Facebook post from Rascal Flatts."The safety of our fans, band and crew is always the top priority for us, so we are so thankful for everyone who jumped into action and for your understanding," the post reads. Caitlyn Conlon had front-row tickets for the concert. She said at the beginning of the concert, everyone felt safe, and one of the band members said to the crowd, "With everything going on in the world today, we are Americans first before anything else. We are all one and just forget everything going on and let’s all become one tonight.”Later in the concert, the keyboard player started to play another song, then abruptly stopped, she said. Conlon said they were told by security that they had to leave right away. She said there was a lot of speculation about what exactly happened, and that the band didn't get a chance to play its biggest songs. A few videos from fans show the confusion before the concert ended.  1242

NEW YORK (AP) — Walmart said in a press release that the ammunition and firearms removed from displays at U.S. stores on Thursday was returned to the sales floor on Friday.“After civil unrest earlier this week resulted in damage to several of our stores, consistent with actions we took over the summer, we asked stores to move firearms and ammunition from the sales floor to a secure location in the back of the store in an abundance of caution," the company stated in a news release. "As the current incidents have remained geographically isolated, we have made the decision to begin returning these products to the sales floor today.”Walmart said on Thursday that it had removed ammunition and firearms from displays at U.S. stores, citing "civil unrest" in some areas. The nation's largest retailer, based in Bentonville, Arkansas, sells firearms in about half of its 4,700 stores. The discounter said the items remained available for purchase by customers. Walmart made a similar move in the wake of the police killing of George Floyd that set off sometimes violent demonstrations against police brutality and injustice against Blacks. Last year, Walmart stopped selling handgun and short-barrel rifle ammunition while requesting that customers not openly carry firearms in its stores, even where state laws allow it. The company also ended the sale of handguns in Alaska, the only state where the discounter sold them. 1432

  

New details in the case of 13-year-old Patricia Alatorre who was allegedly raped and murdered last week by a man from Los Angeles who she communicated with on social media. The details in those court documents are very graphic, much of which wouldn't be appropriate to release.It was in the neighborhood near Wible Rd and Hosking Ave where police say 13-year-old Patricia Alatorre was kidnapped near her home last week. Documents revealed a lot of information about how she communicated with her suspected 24-year-old killer, the kind of communication they had prior to her death, and the tragic way she lost her life."That's sad. That's unacceptable. We don't want anybody killed, but it's incredibly sad when people kill children," said Kern County District Attorney Cynthia Zimmer.Zimmer shared her thoughts after court documents were released Wednesday morning detailing the tragic events leading up to Alatorre's death. Officials said she was killed in South Bakersfield shortly after midnight on July 2nd after 24-year-old Armando Cruz from Inglewood communicated with her on social media over the course of a week. They would send explicit photos to each other, according to documents.Things would take a turn for the worst, according to Bakersfield Police Sgt. Robert Pair."As you can imagine this is a particularly sensitive case. It's involving details that is especially graphic."Documents state Cruz convinced Alatorre to meet with him to engage in explicit acts on two occasions despite knowing she was only 13. He drove from Los Angeles to Bakersfield to meet her. On the second encounter, Cruz drove her around the block as she screamed, telling him she didn't want to go with him.It was about this time documents state she was raped. She tried to get up and physically struggled with Cruz and that's when he allegedly strangled her and tied her up with duct tape. He then took her body with him but the details following are too graphic to release.On Sunday night Cruz was arrested by BPD in Los Angeles County and brought back to Bakersfield. On Tuesday he was charged with 12 felony counts."The first count is first-degree murder and in connection with first-degree murder, I charged four special circumstances which carry the penalty of life without the possibility of parole, in prison, or the death penalty," explained Zimmer.Cruz has pleaded not guilty to that first-degree murder charge and all other felony charges, including kidnapping, and aggravated sexual assault. He is due back in court on July 30th. 2538

  

NEW YORK (AP) — Jeffrey Epstein’s longtime confidante Ghislaine Maxwell has been transferred to New York to face charges she recruited women and girls for him to sexually abuse.The Bureau of Prisons confirmed that Maxwell was transferred Monday and is currently being held at the Metropolitan Detention Center in Brooklyn.Prosecutors have asked a judge to schedule a Friday court appearance in Manhattan federal court for Maxwell.The 58-year-old was arrested last week at a million estate she had purchased in New Hampshire.Maxwell was the former girlfriend and longtime close associate of Epstein, who killed himself in a Manhattan jail last August while he awaited trial on federal sex trafficking charges.She has denied wrongdoing and called claims against her “absolute rubbish.” 794
