A man used electronic purchase alerts from his bank on a credit card he never received, to track down an alleged crook within hours.In the early morning hours of June 21, Josh Blair noticed an alert on his Apple watch confirming a purchase he made at a nearby gas station.But Blair told KSBY he didn't spend at the gas station and, in fact, Blair said he never even received the new American Express card in the mail the purchase was made on.He decided to find out who was using his new credit card around Santa Barbara.Surveillance footage from Blair's apartment complex shows a man unlock the mailbox and withdraw the envelope containing Blair's credit card.After speaking with officials at the post office, Blair said he learned the key to the boxes was lost and the lock had not yet been replaced.Throughout the morning, a series of charges hit Blair's account, all within miles of his home. So after filing a police report, he decided to track the crook himself."I talked to a friend earlier and he said 'OK, be careful.' And I said 'I guarantee I catch him within 24 hours,'" Blair recounted. "It was actually two hours from that time, I remember. I didn't spend much time thinking about what would happen."Throughout the afternoon, Blair raced from business to business as charges appeared on his card, each time, just missing the thief.Then, Blair got a charge alert from the newly opened hotel and restaurant, so he rushed over and spoke to the bartender."He was like 'yea, I'm sure that guy was just here, he just left the bar. I believe he's staying here, let me go check,'" Blair recalled. "He did that then came back and said the guy just ran out in the parking lot. He told me where, so I ran after him and so did the bartender, he helped me out. That's where we caught up with him and basically apprehended him."Blair said he and the bartender held the man until police arrived.Police arrested the man and Blair said police told him there is an arrest warrant for the suspect in nearby Los Angeles County.This story originally reported by Aja Goare on KSBY.co

A Five Guys in Daphne, Alabama has fired or suspended several of their employees after they refused to serve local police officers, the restaurant posted on their Facebook page.According to the Daphne Police Department, on July 7 three Daphne officers entered the restaurant and after realizing they forgot to put their masks on due to the restaurant's mask policy, so they returned to their patrol cars and came back inside wearing their masks.According to WJW, when the officers came back into the restaurant, the employees refused to serve them, so they left and went somewhere else to eat.After hearing of the incident, the restaurant closed so the store and its employees could work with the police department "for further education and customer service training." 777

A co-author of a criminal justice textbook that included convicted sexual assailant Brock Turner’s photo next to the section titled “Rape” is standing by their decision.Last week, a student at Washington State University posted a photo of the book page on Facebook, and it has since been shared over 100,000 times.Callie Rennison, a University of Colorado Denver School of Public Affairs professor and co-author of “Introduction to Criminal Justice: Systems, Diversity and Change,” said that the vast majority of reaction she’s received has been positive. However, critics have said that even though Turner’s crimes may fit the FBI definition of rape, he was not convicted of rape as defined by California law—instead he was convicted of sexual assault.Currently, the federal definition states that if there’s penetration “with any object, any body part, that’s not consensual, then that’s rape,” Rennison said. “Brock Turner was convicted of a penetration offense and under these definitions that’s rape.”Rennison also points out that critics may not have read the entire section of the book and missed some key context.“That particular section is about how definitions change over time,” Rennison said.In fact, California did alter their definition of rape, in part due to Turner's case.She says they will still add even more context in upcoming editions of the book, a fact the publisher confirmed, as well.She contends that the reason Turner’s image was used in the first place was to keep the curriculum current and thus relatable to students in 2017.“This is who students know and students talk about,” she said. “Contemporary references are a must. Looking at older books students aren’t engaged. They don’t think it applies to them in their world.”She also hopes it starts a larger conversation about punishment. A company is promising to pay San Diegans cash for cutting their energy use when demand is at its peak.The payouts can add to hundreds of dollars per year.But getting that cash means following some very specific instructions, and isn't as simple as turning off your air conditioning. The company is called OhmConnect, which has a contract with San Diego Gas & Electric.San Diegans who sign up let OhmConnect tap into their smart meters. They will then get a text message alerting them to a specific hour when they should cut their energy use - turn off air conditioning, lights, chargers, surge protectors, and avoid opening the fridge and freezer. OhmConnect suggests people do something outside during that time. "Everyone is looking to save a buck, so I was like why not, times are tough?" said Patrick Copley, of Serra Mesa, who signed up Monday. Curtis Tongue, a spokesman for OhmConnect, said the company has ramped up its advertising over the past few months. He said OhmConnect sells the reduced energy use to SDG&E, takes a cut, and passes on the rest to the participant in terms of points. Each point is worth a penny, and can be cashed out to Paypal once a person reaches 1,000 points, worth . OhmConnect says a person who participates two to three times a week can earn between 0 and 0 over a year. An SDG&E spokesman noted that customers are still responsible for paying their bill. A lawsuit has been filed against the County of San Diego and the former Assistant Sheriff for sexual harassment and retaliation.The employee began working for the Sheriff’s Department in 2010 at the Vista Detention Facility, according to the lawsuit.Team 10 is not naming her because she said she is a victim of sexual harassment. The woman worked as Administration Secretary for the Detention Services Bureau at the Sheriff’s Headquarters.She alleges in her lawsuit that on at least five separate occasions, “Miller inappropriate hugged [her] and thrusted his crotch area into her so that she would feel his penis against her.”She said the first three times she was hugged in an inappropriate manner was when he was a Commander.RELATED: San Diego County Assistant Sheriff accused of 'inappropriate conduct'?The two most recent times were after he was promoted to Assistant Sheriff. The female employee claimed that Miller made “inappropriate sexual innuendo” to her, including tickling her hand.She stated in her lawsuit that she confided in two Commanders about Miller’s behavior, but did not raise a formal complaint because she feared retaliation.She applied for a new job within the department with Law Enforcement Services Bureau Administrative Secretary II “in order to avoid Defendant Miller and his continued harassment.”She was not granted the transfer. She alleged “Miller demoted her in retaliation for her rejection of his sexual advances and efforts to avoid further harassment by him.”Team 10 contacted the Sheriff’s Department late Monday. A spokesperson said Miller is no longer with the department, since he retired.She added they cannot comment on pending lawsuits. Team 10 is still waiting to hear back from a county spokesperson.The woman suing the County of San Diego and Miller also believed that “the county had received and/or was aware of several complaints from other employees about inappropriate sexual behavior of the Assistant Sheriff.”The lawsuit stated the county took no appropriate action to protect from Miller’s harassment.Team 10 previously contacted Miller when these allegations first arose in February.He told Team 10 investigator Melissa Mecija he could not comment on an ongoing investigation. He also said he “absolutely” denied allegations of inappropriate conduct.In late February, before the lawsuit was filed, a sheriff's spokesperson told Team 10: "Despite the allegations in the claim, the claimant was not demoted.
