Nintendo has filed a lawsuit against an Arizona man after the video game giant claims he operated two websites "built almost entirely on the brazen and mass-scale infringement of Nintendo's intellectual property rights," according to court documents.The lawsuit, filed July 19 in Arizona U.S. District Court, claims Jacob Mathias and his company, Mathias Designs, L.L.C, operated 'LoveROMs.com' and 'LoveRetro.co' — websites lawyers for Nintendo say "are among the most open and notorious online hubs for pirated video games."The company claims Mathias posted thousands of Nintendo games on the sites that were downloadable as files — known as "ROMs" — and playable on phones or computers through software referred to as emulators. In court documents, the company's lawyers said Mathias uploaded an instructional video to YouTube explaining how to download and run the games.Nintendo estimates its titles were illegally downloaded from the sites by more than 60 million people.The company is seeking 0,000 for each infringement of its copyrighted work and up to ,000,000 for each infringement of the Nintendo trademark. Its lawyers said Mathias profited off the website through ad sales and donations.On Wednesday night, both 'LoveROMs.com' and 'LoveRetro.co' displayed messages they were shut down.Reached by phone, Mathias declined to comment. NEW YORK (AP) — President Donald Trump’s former personal lawyer and fixer, Michael Cohen, has been returned to federal prison.The federal Bureau of Prisons told The Associated Press on Thursday that Cohen had “refused the conditions of his home confinement.”Cohen’s return to prison comes after the New York Post caught him on camera eating a Manhattan restaurant.The move comes weeks after the 53-year-old was released in late May to serve the remainder of his sentence at home because of the coronavirus pandemic.Cohen pleaded guilty to tax evasion, campaign finance fraud and lying to Congress and began serving his sentence in May 2019, scheduled to remain in prison until November 2021. 699

NEW YORK (AP) — Phyllis Somerville, an actor who appeared in a variety of films, television shows and Broadway productions over her 45-year-plus career, has died. She was 76.Somerville's manager Paul Hilepo says Somerville died Thursday in New York City of natural causes.A native of Iowa, Somerville moved to New York in the 1970s and most recently appeared onstage in the Broadway production of “To Kill a Mockingbird.”On television, she appeared in “The Big C," “NYPD Blue” and was in films like “Arthur” and was among “The Curious Case of Benjamin Button” actors nominated for a Screen Actors Guild Award. 617

  

NORTH FORT MYERS, Fla. -- Orlando Ortega posted a Facebook video of his now-former co-worker, Eileen Marcinkowski, calling him the N-word Sunday. The video has more than 150,000 views.But the owner of the restaurant where the incident took place said the video doesn't tell the whole story. “The lady in the video he actually did hit. She had blood on her face, she was bleeding," said Jane Thursfield, owner of Cactus Jack. Thursfield said Ortega provoked the fight when he punched Marcinkowski in the face after he was let go by the restaurant. Scripps station WFTX in Fort Myers could see no evidence of blood on Marcinkowski's face in the Facebook video. The owner said even if Marcinkowski was provoked, the racial comments were not OK. “No, no, of course not," Thursfield said. "No, we don’t condone that at all.”Other customers, like Johnny Samz, who said he regularly eats at Cactus Jack, agreed. “I don’t think it’s ever good, for anybody to use the N-word," said Samz. "I don’t care what the circumstances are.” WFTX's Jasmine Minor asked since Ortego no longer worked at the restaurant, if Marcinkowski would face the same fate. “She is still working here, yeah," said Thursfield. "I have not been here long and she’s working, but we will obviously address that.” The owner said the incident took place "off-the-clock" and "off business property." She still plans on addressing the issue with her entire staff. Ortega conducted a Facebook live, Sunday night, where he said he "absolutely did not provoke anything" and said he plans on filing a discriminatory lawsuit.  1752

  

NFL and NFL Players Association data for the week of Oct. 25-31 show eight new confirmed positive COVID-19 tests among players, and 17 new confirmed positives among other personnel.A total of 42,916 tests were administered to 7,884 players and team personnel. There were 16,814 tests administered to 2,511 players; 26,102 tests were administered to 5,373 personnel.During this period, players and Tier 1 and 2 personnel were tested daily. Tier 3 individuals were tested weekly. Individuals who test positive are immediately isolated, not permitted access to club facilities, or have direct contact with players or personnel. Club medical staffs are in regular communication with individuals who test positive to monitor symptoms.Total test results for the entire period of Aug 1-Oct 31 show 63 players and 99 other personnel were confirmed with positive cases.
