This motion will include documentary proof that neither Mr. Evans’ race nor retaliation played any part in Founders’ decision to end Mr. Evans’ employment. I would ask that you reserve judgment or comment on this case until you actually see the evidence presented by the parties.In the event that you will not, I understand that a person unfamiliar with most of the facts in this case, and a person unfamiliar with the obligations that individuals are under when they give deposition testimony, might perceive Mr. Ryan’s statement as noteworthy. It is not. First, as I doubt you’re aware, Mr. Evans himself has testified – unequivocally and under oath – that Mr. Ryan is not racist and was his friend; so whatever point Mr. Evans is trying to make by leaking deposition testimony to you is undone by his own words. Second, this testimony is not Founders’ defense in this case as you allege. Founders evaluated and decided to terminate Mr. Evans based only on his job performance. Mr. Evans’ poor job performance will be apparent when Founders files its upcoming motion. Third, through this testimony, Mr. Ryan was simply saying that he does not assume anything about individuals’ race or ethnicity unless they tell him that information. While it might be acceptable to speculate about this type of thing in casual conversation, Mr. Ryan was not having a casual conversation. He was under oath when he made these statements. As all deponents are instructed, Mr. Ryan was directed not to guess, assume or speculate in his deposition. This is the reason for his answer.The fact that Mr. Evans is selectively leaking this type of information to you indicates that, unlike Founders, he has no evidence to support his position in this case. PHOENIX, Ariz. (KGTV) - A San Diego woman is demanding answers from Phoenix police after her uncle was shot to death by officers outside his apartment.This week, ABC10 News spoke to 18-year-old San Diegan Sadie Whitaker about her family's outrage surrounding the death of her 40-year-old uncle, Ryan Whitaker, who was shot by Phoenix police in May. It was captured on police body camera video that was just released.“I feel like this needs to be heard everywhere. It needs to be national news. It was just wrong,” said Sadie.Police said a concerned neighbor called in to report that Whitaker and his girlfriend may have been having a physical fight inside their Phoenix apartment.In the police body camera video, officers are heard knocking on the door and identifying themselves. Whitaker opens the door and appears to step out with a gun in his right hand which he then appears puts behind his back and lowers to the ground with his left hand visibly in the air. The encounter quickly escalates and shots are heard being fired.Police said the second officer in the video shot Whitaker, believing the first officer was in immediate danger. Whitaker did not fire, they report.Sadie tells ABC10 News that a few days before that, someone had knocked on their door but took off. “This night, when the same thing happened, he brought his gun to the door for protection,” Sadie added.She said his gun was legally purchased and he had no criminal history.After shots were fired, Whitaker's girlfriend appears to become hysterical. She’s heard asking why officers shot him. An officer is heard telling her that Whitaker had just pulled a gun on them. She responds that it’s dark and someone just knocked on the door.An officer is heard saying, “Your neighbor called saying he heard you guys going at it.” She responds, “Literally, we were making salsa and playing Crash Bandicoot so there may have been some screaming from PlayStation but it wasn't domestic violence or anything.”“I do not think [the shooting] was justified whatsoever,” said Sadie.Whitaker's family is calling for the officers to be terminated and face criminal prosecution.“I want there to be awareness and I want people to know that this kind of stuff is going on,” Sadie says.Phoenix Police told ABC10 News that they can’t comment because of pending litigation. Parents of students who had been evacuated from Santa Fe High School in Texas following a school shooting that left 10 dead were shocked to find a man carrying a pistol approaching the school to comfort students.The man, who was wearing a Trump cap and carrying an American flag, said he was walking in front of the school in order to "make America great again.""These folks are having a rough morning and could use some support, and I think these are the kinds of support that they need right now," the man told told reporters."Offering support," the man said, when asked what his "plan of action" was. "'God bless y'all' will go a long ways right now for a lot of people."A parent of a student called the man "an embarrassment.""This guy right here is sick. I'm sorry, he's sick," the man told ABC. "He doesn't need to be walking around the school, carrying a flag and a pistol. He does not need to be out here doing that, and I'm glad they're stopping him."  989

PHILADELPHIA, Pa. – From China to Egypt and beyond, the halls of history span the globe.Yet, it’s been lonesome lately in those halls at some of the 35,000 museums across the country.“We, of course, wanted to reopen as soon as we could and safe a manner as we could,” said Melissa Smith, CEO of the Penn Museum in Philadelphia.It’s one of the few major museums to recently reopen to visitors, after coronavirus restrictions forced them to close their doors for months.“For the most part, it's business as usual with our exhibits,” Smith said.First, though, a task force of 35 museum employees needed to figure out what changes might be needed.“We had to look at a number of things,” Smith said.Among the changes: masks are a must, hand sanitizing stations are now located throughout the museum, clear partitions were installed to protect staff who interact with visitors and benches were marked off, so people can sit socially-distanced.Also, arrows now line the stairs and floors, carefully choreographing how visitors move through the exhibits.“They asked us to follow the arrows and it kind of was a different museum experience, but also I think very helpful, just because there wasn't any confusion,” said museum visitor Soheil Eshghi.There are a few other changes, too: some of the exhibits around the museum have touchscreens, so visitors can dig a little deeper into what’s on display and learn more. The museum is now giving out a disposable stylus to visitors, so they can safely use the touchscreens.Visitors said they don’t mind the changes and are just happy for the chance to come back.“I think that’s one of the things that I've been missing the most since all this shutdown started happening,” said Camille Lawhead, who was visiting the museum.Now, visitors no longer need to be missing it. 1813

PALM CITY, Fla. -- A new dog training facility is almost complete in Florida. Its goal is to rescue pups and turn them into service dogs for veterans who need them now even more than ever during a pandemic.Veteran Suhir Shrestha was born in Nepal and moved to the U.S. He was so thankful for his life here that he decided to enlist in the military as a way to give back, at 39 years old."I deployed to Afghanistan in 2013 and there, obviously, it was a war zone," he said.Shrestha said when he returned, he suffered from PTSD, depression and anxiety."I had a lot of suicidal thoughts and a lot of negative thoughts, nightmares, flashbacks, what have you," he said. "It was very difficult to lead a life."It's a life that has recently take on new meaning with Indie by his side."It has been a tremendous life-changer for me," he said. "Before, I used to be not able to go outside, be nervous of a crowd and just have negative thoughts in me."Indie was adopted from the shelter-to-service dog program through Furry Friends Adoption Clinic and Ranch."Gives me extra confidence to go outside because I have him," Shrestha said."These dogs are coming from high-kill shelters in many cases," said Pat Deshong, the president of Furry Friends Adoption Clinic and Ranch. "We don't necessarily take them to be service dogs, but we take them because they are high energy."The group is building a new training center in Palm City and is weeks away from completion. It's all in an effort to bring veterans from across the country to Florida to adopt."These veterans are so deserving of these dogs," Deshong said. "We don't automatically pick which dog is right for the veteran.
