SAN DIEGO (KGTV) -- A judge ruled Wednesday that a Navy commander will face a third trial on charges he tried to rape a junior officer in her home.John Michael Neuhart II asked the judge to dismiss all charges after a second jury was unable to reach a verdict.The judge dismissed charges of assault with intent to commit rape during burglary, burglary and resisting or delaying a peace officer.RELATED: Mistrial declared for former Navy commander accused of rapeThe judge added that prosecutors can proceed with a third trial in January on charges of attempted forcible rape and assault with intent to commit rape.Neuhart now faces six years behind bars and lifetime sex offender registration if found guilty. Neuhart had previously been facing life in prison.In the two trials combined, 21 out of 24 jurors voted to convict Neuhart. SAN DIEGO (KGTV) – A new initiative in Pacific Beach could keep many businesses afloat but may make parking in the area even harder to find.Twenty-six parking spaces on Ocean Boulevard between Grand and Thomas avenues will be temporarily converted to outdoor dining for nearby businesses.Signs posted near the parking spaces show there will be no parking starting Friday, Aug. 21, until Dec. 30 for a special event.PB Shore Club owner Doug Sondomowicz worked with the city’s permits department, local police and fire departments, and the Coastal Commission for five weeks to get permits approved.The area where the parking spots used to be is now where cars and emergency vehicles can drive through along Ocean Boulevard.PB Shore Club will add 22 tables to the patio, bringing them to about 2/3 of their pre-COVID seating capacity.Sondomowicz said he thinks this will allow him to bring almost 100 percent of his employees back. The tables will be ready to go by lunchtime on Saturday."Originally, we laid off every employee we had here … hopefully with this we will get closer to that 100 percent employee mark,” said Sondomowicz. "During these trying times with COVID-19, the city has been gracious to let us use this and be able to keep us open and try to employ more people. And give locals and tourists still options to be able to eat outside beachfront."Waterbar will add around 20 tables and have their patio ready to go by 4 p.m. Friday.Some people in Pacific Beach say finding parking in the area is already difficult and this restriction will make it even harder.Pacific Beach resident Robert Gally opposes the idea, and he told ABC 10News, "A lot of times, I see police responding out here. San Diego (KGTV) -- A person was killed when their motorcycle crashed into a guardrail while riding with friends.Police received the report of the crash at the intersection of Sweetwater and Shannonbrook Court just after 10:30 p.m. in Lemon Grove.Police closed the intersection to investigate how the motorcyclist lost control.The victim died at the scene, their name was not immediately released. 405

SAN DIEGO (KGTV) - A local contractor is facing criminal charges for allegedly taking customers money and doing little to no work.On Monday Stephen Hage Jr. plead not guilty to charges ranging from grand theft to improper home improvement contract procedures.According to the prosecutor Hage allegedly took down payments on home improvement contracts, and after getting the money disappeared after performing little to no work.In November, a Team 10 investigation discovered some customers who said they signed a contract with American Pride Enterprises, paid thousands of dollars up front and were left with little or nothing. James Francois said he paid Hage more than ,000 for a patio.“He never showed up, never delivered any material, never did an hour of work,” Francois told 10News in November.The Contractors State License Board revoked American Pride Enterprises' license for non-compliance with an arbitration award in July of 2018.After the hearing Team 10 investigator Adam Racusin asked Hage if he had a comment about the allegations. Hage’s attorney said they had no comment. Hage is scheduled to be back in court in May. 1144

SAN DIEGO (KGTV) - A Minnesota man suspected of possessing child pornography may be in San Diego, according to the San Diego Police Department.Jamison Michael Nelson, 40, was the focus of a news release issued Monday to alert the public.San Diego Police did not release details about the charges, but information from DL-online.com indicated a man named Jamison Michael Nelson was charged with six felony counts of possessing pornographic works on a computer.The National Center for Missing and Exploited Children received an alert from Google indicating that three images which may have been child pornography had been uploaded to a Gmail account, according to the report.DL-online.com reported that a search of Nelson’s residence turned up a hard drive hidden in a coffee pot.San Diego Police did not indicate why they believe Nelson may be in our area.He is white, six-feet tall, 185 pounds, with brown hair and green eyes. 934
