DELRAY BEACH, Fla. — A South Florida driver recounted the terrifying moments a piece of metal smashed through his windshield while driving on Interstate 95, missing him by inches.The Florida Highway Patrol said the incident happened Tuesday around 3:30 p.m. south of the Woolbright Road exit.Officials said the metal flew off a tow truck and into Eduardo Medina's truck.The metal missed Medina by inches, leaving a few scratches on his face and hands from the glass.Medina, who speaks Spanish, had his wife Norma Rodriquez translate the moments he scary crash."All he heard was an explosion. DENVER – The man accused of shooting and killing three people at a Thornton, Colorado Walmart on Wednesday night will likely learn if prosecutors will seek the death penalty against him Monday afternoon.Scott Allen Ostrem, 47, made his first court appearance Friday morning in Adams County. Formal charges have yet to be filed against him, but his arrest warrant carried first-degree murder after deliberation charges.Prosecutors are expected to seek similar first-degree murder charges, and an attorney for the state said at Friday’s hearing that “there’s going to be multiple counts in this case.” District Attorney Dave Young said they might also pursue attempted murder charges."When you fire into a crowd of people you don't necessarily need to fire more than one shot to be convicted or charged with attempted murder," Young said.Prosecutors initially argued that they should have until Wednesday to file formal charges, saying that they needed to interview more people and review more video footage to determine who, if anyone in particular, Ostrem was targeting in the shooting.Police and the FBI say they still have not determined a motive for the Wednesday night shooting, which left three people dead.First-degree murder convictions carry sentences of either life in prison without the possibility of parole or the death penalty in Colorado, but prosecutors must say which penalty they are seeking when the initial charges are filed. But only three people remain on Colorado's death row, and no one has been executed in the state since 1997.Young would not comment on whether he would seek the death penalty for Ostrem.And though prosecutors had asked for more time, Judge Ted Tow set the advisement for 1:30 p.m. Monday. The affidavit in the case will remain sealed until at least then.Ostrem was represented by two public defenders in court Friday, and said little, other than answering “yes” when asked questions about his understanding of the proceedings by the judge. She said her team hadn’t been allowed into the store, and that she had concerns that evidence could be destroyed once the store reopens.But the judge denied the request, saying he had no authority to order police or Walmart to do anything.A Walmart spokesperson told Denver-based KMGH on Friday they were working to decide when the store might reopen.Police arrested Ostrem on Thursday morning more than 12 hours after the shooting occurred. An anonymous citizen tip alerted authorities to his presence in the area, police said, though FBI agents also spotted him in the area. DEL MAR (KGTV) — A historic summer season at the Del Mar racetrack is wrapping up Monday, the first season without fans in the stands in the track’s history.But even with all the changes forced by the pandemic, the Del Mar Thoroughbred Club says summer 2020 was a success.With no fans in attendance, the Thoroughbred Club says it missed out on about million in concessions and other on-track revenue this season. However, that was offset by lower staffing costs and an uptick in gambling revenue, according to Craig Dado, the club’s chief marketing officer.“We’re really happy with the numbers we’re getting and we will be able to eek out a small profit this year,” Dado said.Gambling revenues jumped about 7 percent thanks to off-track activity, Dado said, which is where the vast majority of bets are typically placed anyway. Anyone can bet on a Del Mar race using an app.“Basketball was delayed. Baseball was delayed, so a lot of people turned to horse racing, and we’re happy they did,” he said.The season had its hurdles. In July, the track canceled a weekend of racing after 15 jockeys and seven other workers tested positive for COVID-19.Last weekend, a horse was hurt during racing and had to be put down, the first death during racing at Del Mar since 2018.“To only have one in two racing seasons is a phenomenal number and we will definitely be the safest track in North America, as we have been the last two years,” Dado said.Dado attributed the track’s safety record to protocols adopted three years ago.But there are still questions about the kinds of pandemic protocols that will be in place when the November season begins.“At this point, we have no idea what’s going to happen in November,” he said. “Things are starting to open up in San Diego County. (KGTV) - All eyes were on Del Mar's bluffs near the train tracks during Wednesday's storm.Watching the cliffs near Seagrove Park, 10News spotted dirt trickling down the cliffs each time a a train passed by, raising concern after a large bluff collapse Friday.Another area was deemed precarious by the North County Transit District (NCTD) less than a block away from last weekend's collapse.Transit workers told 10News everything was going to plan Wednesday, referencing sand bags keeping debris out of storm drains, funneling water away from the fragile sandstone cliffs.RELATED: Travel nightmare for train passengers after Del Mar bluff collapseAn NCTD official said the agency has personnel monitoring the bluffs 24 hours a day, 7 days a week until further notice."At this time, the tracks are safe and trains are permitted to travel through the area at restricted speeds," said an NCTD spokesperson.SANDAG and North County Transit District completed a million project last fall to shore up the bluffs. 1031

(KGTV) - SANDAG will start a million project in September, hoping to stabilize Del Mar cliffs that support railroad tracks.Geologist Dr. Pat Abbott says this winter and spring have been rough for bluffs, "in the past few months with a lot of rainfall, we've seen cliff collapses galore in Del Mar."SANDAG says they're going to install pillars and repair drainage structures, "put in steel beams, tie backs, bits of concrete walls, to start to stabilize some of the beach cliffs," Abbott added.The nine-month long project stretches from Seagrove Park to Carmel Valley Road."I think it's a wonderful idea, it's better to do it now, get it behind us, before something happens and a train goes off the side of the cliff," neighbor Lynn Kunkle said.Abbott calls it a Band-Aid, "there's no easy way to get out of this...You have tall sea cliff standing here, ocean waves beating at the bottom, rains soaking into the ground you have trains going by better than 50 a day."Each of those factors eroding the cliff side. Down on the beach lies an example of the fight between amn and mother nature. A concrete drain's side sticks out past the eroded cliff by about two feet. Abbott said the same will happen with this project.A seawall has another negative effect, keeping sand from replenishing the beach below. The Coastal Commission made a compromise with SANDAG when they approved the project. SANDAG will build more beach access for pedestrians.Abbott says we need to think long-term, "let's just do a Band-Aid now like the one proposed here, pass it on to the next generation as if it will be simpler for them to solve than it is for us."SANDAG is planning for the long-term, saying they are still looking into options to move the railroad.
