SAN DIEGO (KGTV) — An explosion of COVID-19 cases across California has many businesses once again changing how they operate.But not by choice. The changes come after most counties find themselves in the state's most restrictive purple tier.San Diego County's move to the purple tier means back to takeout and outdoor only dining."I see red … Not in the black right now," says Terryl Gavre, owner of Café 222 in San Diego. "I've been here 29 years, this restaurant opened in 1992 … and I am doing less in sales than I was doing in 1992."Gavre's other spot, Bankers Hill Bar and Restaurant, is in what she describes as a hibernation period. Hunkering down and trying not to lose money.Those business decisions come with a cost."If we stay open, every month you watch the savings account go down, down, down," Gavre said. "We had 15 employees here pre-COVID we're now down to 5. So 10 of my staff members have been laid off. At Bankers Hill Bar and Restaurant, we had 40 people on staff."This week, 28 other California counties across the states moved back into the purple tier."My first thought was that's very frustrating. My second thought was immediately what I've been doing for the last eight months which is lying in bed awake thinking how are we going to pull this off," said Ryan Joiner, who owns Athlon Fitness & Performance in San Luis Obispo.The rules say fitness facilities located in purple tier counties can only operate outdoors.While some businesses have spent the last nine months treading water, the most recent frustration comes with the governor's Monday press conference and changes to the tier system, allowing counties to move back a tier after one week, not two.It drastically changed the makeup of the state and how many businesses across the state can operate."Counties can move back after one week, not just two weeks," Gov. Gavin Newsom said, describing the state hitting the emergency brake. "I'll go back so you can get a sense of where we were just a week ago and now again the purple throughout the state of California.""It's really frustrating for a lot of people and ya it does seem like he's moving toward a backdoor shut down order again," James Gallagher is a state assembly member in Northern California.Gallagher says the governor keeps changing the rules just as people are finding their footing from the last set of guidelines."I just think that this approach is the wrong one," Gallagher said.Gavre says the tighter the restrictions get and the longer they go on the harder for small businesses to keep going."A lot of people out of work right now going into the holidays and I don't know what they are going to do," Gavre said.The state has said the spread of COVID-19, if left unchecked, could quickly overwhelm our health care system and lead to catastrophic outcomes. 2824

SAN DIEGO (KGTV) -- A task force assembled by Governor Gavin Newsom wants to impose a statewide mandate requiring local governments to address homelessness, and hold jurisdictions that fail to make measurable progress accountable with lawsuits.The proposal by the 13-member Council of Regional Homeless Advisors would require an amendment to California’s constitution. If approved by voters, California would become the first state with such a mandate.“A legally-enforceable obligation will sharpen focus. It will enhance a bias towards action and it will elevate this on the list of priorities,” said San Diego County Supervisor Nathan Fletcher, a member of the task force.Although the specifics are still under negotiation, the task force outlined an example scenario where cities and counties would have one year to reduce their homeless populations by “tens of thousands.”“These plans would include specific benchmarks and timelines that jurisdictions would have to meet for moving people into permanent housing through both services offered in interim interventions and creation of housing opportunities,” the Council said in its proposal letter.“It won’t be enough to buy your way through with putting up a number of shelters to make the public think you’re taking action,” Fletcher said. “You will actually have to find a way to tackle the underlying problems.”Supporters likened the proposal to California’s renewable energy mandate. It’s still unclear how much the housing mandate would cost.“I would not be supportive of the state coming down on cities like San Diego and saying you have to change the way you do business, change the way you operate, and not give us any money to do that,” said San Diego City Councilman Chris Cate. Cate said he would prefer to address homelessness with a system of incentives rather than mandates and punishments, but said he was reserving judgment on the plan until more details are released.The Council of Regional Homeless Advisors wants to put the issue before voters on the November ballot. SAN DIEGO (KGTV) -- An Ocean Beach woman was alarmed by a flier taped to her door saying "the antichrist will destroy anyone who worships him." Holly Raines said her 7-year-old son found the flier taped on their front door. “I started reading the letter but I was like half asleep so I started panicking a little bit because it just seemed very threatening and very intense,” Raines said. Several other neighbors say they got one too. The letter stated it was from New Life Christian Chapel, which is a few blocks away from where Raines lives in Ocean Beach. “It was very damning and then it has like a phrase that says ‘The antichrist will destroy anyone who worships him, there is no middle ground,’” she said. Raines said the flier quotes several Bible verses but found them far from comforting. “The words just aren’t very friendly, they talk about slaying lambs and antichrist and unrighteousness,” Raines said. It ended by inviting her to a home Bible study but she can't help but feel like the church crossed a line. “We have a lot of friends that go to church around here and a lot of the community churches here are awesome, they do great things,” Raines said. “The idea of taping anything on somebody’s door is a lot and this is a full document of typing. I mean if anyone wrote me a letter like that I would think it was an angry letter.”10News reached out to New Life Christian Chapel, and Pastor Thomas J. SAN DIEGO (KGTV) -- A woman was arrested late Wednesday night after a crash off Interstate 805 that left her car engulfed in flames.The incident occurred at around 11 p.m. in an area off southbound I-805, near Clairemont Mesa Boulevard.ABC 10News learned the woman was involved in a two-vehicle wreck that then caused her Nissan 350Z to burst into flames.The driver was able to get out of the vehicle without major injuries; the driver of the other car was not injured.It took responding fire crews over 20 minutes to knock down the blaze.The Nissan’s driver was treated at the scene before she was arrested on unspecified charges. 639

SAN DIEGO (KGTV) - An inmate at R.J. Donovan State Prison has filed a lawsuit against the California Department of Corrections and Rehabilitation.Anand Jon Alexander filed the complaint on Monday, alleging prison officials failed to keep him safe and to provide adequate medical care after he was assaulted behind bars.In the complaint, Alexander claims he was attacked by another inmate while waiting to make a phone call on May 18, 2019. He was allegedly stabbed multiple times in the face and kicked on the ground.After the attack he sustained “five facial fractures, a lower orbital floor blowout, sinus and nasal fractures, a deviated septum, a 50% abrasion to the right cornea, long term impairment of his vision and respiration, serious nerve damage, PTSD” according to the complaint.Alexander is 12 years in to a 59 year sentence after he was convicted of rape in 2008.An up and coming fashion designer, Alexander had been featured on “America’s Next Top Model” and was listed in Newsweek’s “Who’s Next in 2007.”But his career was put on hold after being accused by multiple women of sexual assault.Many of the charges were dropped, but he was convicted on one count of rape and 15 other counts following a trial in Los Angeles. The jury found him not guilty or were hung on several other counts.Alexander has maintained his innocence. In the complaint, his lawyer writes he “has acknowledged the existence of blurred lines between his personal and professional relationships…Nevertheless, he holds steadfast to his innocence.”The American Justice Alliance, a group which seeks to free prisoners who have been wrongfully convicted, submitted an amicus brief to the Federal Central District Court.In it, they wrote Alexander “was targeted by a collusion of disgruntled business associates and some former girlfriends, who have admitted they were out to “bring him down,” and “get revenge,” seeking notoriety and monetary benefits. He was then subject to a prosecution and trial riddled with extraordinary police misconduct.”The lawsuit names CDCR as well as Marcus Pollard, the Warden of R.J. Donovan Correctional Facility and Daniel Paramo, the former Warden.It alleges prison officials failed to protect Alexander from harm and after he was injured gave “deliberate indifference to Mr. Alexander’s medical condition.”They are seeking unspecified monetary damages and a jury trial.So far, no criminal charges have been filed against the assailant. 10News reached out to CDCR for comment but had not heard back before the story was published. 2557
