SAN DIEGO (KGTV) -- A San Diego woman has filed a claim against the San Diego County Sheriff’s Department after she says she was groped by one of their deputies.The complaint by the unidentified "Jane Doe" alleges that Deputy Richard Fischer "rubbed and fondled" her on Aug. 20, the San Diego Union-Tribune reported.It claims Fischer was sent to her home with another deputy about 3 a.m. for a welfare check, but he returned alone an hour later and asked to be let inside."Fischer lied to her and said he needed to use her restroom," the claim states. "Jane Doe let him into her home, but immediately realized the restroom claim was just a ruse to get in the house."It goes on, "Fischer told the woman he thought she was cute, hugged her for 10 seconds without consent and then rubbed his hands down her torso, shoulders, arms, back and buttocks. After the hug, he told her again he thought she was good looking, then hugged her again; the woman resisted more aggressively the second time.The woman has now filed a million claim against the San Diego County Sheriff’s Department.In response, the department has placed Deputy Fischer on administrative assignment.The department responded to the claim in part by saying, “…the department holds all of our employees to the highest standards and is in the process of conducting a prompt and thorough investigation into the allegations.”The woman says she has no surveillance video to back up her claim, but thinks the sheriff’s own technology will provide proof of her claim.The woman said when Deputy Fischer came back to her home, he arrived in one of the department’s marked vehicles, vehicles that have GPS monitoring.Among the allegations against the Sheriff's Department are sexual assault and battery, sexual harassment and infliction of emotional distress.Read the department's full statement below: "The Department has received a complaint and claim from a female adult alleging inappropriate hugging by Deputy Fischer.  The employee was immediately moved to an administrative assignment upon notification of the complaint.  The Sheriff's Department does not comment on pending criminal or internal investigations.  However, the department holds all of our employees to the highest standards and is in the process of conducting a prompt and thorough investigation into the allegations." 2372

SAN DIEGO (KGTV) - A teacher at a middle school in Vista says a look inside her classroom reveals her concerns about the lack of social distancing.Laura Whitehouse’s classroom at Rancho Minerva Middle school. The history teacher has been at the school for seven years, and for the first time, she is anxious about going to school."It’s frightening. It’s frightening," said Whitehouse.She says her fears stem from the lack of social distancing. Her classes have 34 kids, with two kids sitting at each table right next to each other."Distance between each table is about two feet. They’re just on top of each other," said Whitehouse.Whitehouse says the kids are supposed to wear masks, but she sometimes has to remind them to put their masks on, and to maintain social distance."They want to clump together. They want to go to each other’s desk," said Whitehouse.After a few days of in-person learning, Whitehouse on Tuesday received plexiglass for her desk and a HEPA air purifier, but she worries it’s not close to being enough. She says there’s no cleaning between classes, as new students rotate in."The germs that are accumulating are just crazy," said Whitehouse.Amid her concerns, there have been at least four positive COVID-19 cases in the Vista Unified School District, sparking new rules about what will trigger a school to revert to distance learning.Whitehouse, who has asthma, says the new rules don’t address what’s putting her and her students most at risk."I am afraid for them. I just want them and their families to be healthy," said Whitehouse.She’s hoping for more cleaning, and more hybrid learning to reduce the number of kids in the classroom."The fear is this is just going to continue to get worse," said Whitehouse.The teachers union tells ABC 10News they are preparing an OSHA complaint detailing the classroom conditions. Superintendent of Schools Matt Doyle emailed ABC 10News the following statement:"... We have spent more than 2 million dollars on personal protective equipment for our staff and schools. These include facemasks, face shields, gloves, plexiglass barriers for teachers and students, HEPA air filters, additional outside sinks, electrostatic disinfecting machines, posters, and more. Every teacher has been given these supplies ... We will continue to work proactively with teachers and staff to make sure that they get what they need in their classrooms." 2410

SAN DIEGO (KGTV) — An arrest has been made in connection with a fatal hit-and-run Sunday in Sherman Heights, San Diego Police have confirmed to 10News.On Sunday, a silver SUV was traveling eastbound in the 1800 block of Market Street at about 2 a.m. when the vehicle hit a pedestrian. Family members have identified the victim as 41-year-old Jason Gordon.It's still not clear if Gordon was standing in the street or crossing lanes, police said. The driver fled the scene after fatally hitting the man.Police Tuesday released photos of the man they believed to be the suspect of the crash visiting Humberto’s Taco Shop on the corner of Broadway and 25th Street, where he ordered food. The cashier who took the man's order said it appeared that the man had been drinking that night.RELATED: Pedestrian struck, killed by hit-and-run motorist in San DiegoPolice say the photos from the taco shop and photos from Smart Street Lights near the crash scene led them to the home of 28-year-old Christopher Nunez, where they also located the suspected vehicle, a 2008 GMC Envoy. Nunez was arrested and booked into county jail on felony hit-and-run charges.Nunez is being held on 0,000 bail and set to be arraigned on Jan. 24.Gordon's wife, Katie, sent 10News the following statement after the arrest:"While nothing can bring Jason back to his family, this arrest is a small step forward in the healing process. A sincere thanks to everyone who shared information. The support we've gotten from our local community, and across the country, has been very important to us all. We look forward to justice being served so our lifelong healing process can continue to move forward."The family has started a GoFundMe to help with expenses for Gordon's family. 1753

  

SAN DIEGO (KGTV) -- An investigation is underway to find the driver in a hit-and-run crash that injured two passengers in City Heights.Police say the female driver crashed into multiple parked cars on Fairmount Avenue just after midnight on Wednesday.Witnesses told police they heard the crash, and then saw the driver jump out of the car and run, leaving the two female passengers behind.Both women managed to crawl out of the mangled car with the help of nearby neighbors. One of the passengers was seriously injured, but neighbors say they kept her calm and stable until paramedics arrived.Police are investigating what led up to the crash.This is a developing story stay with ABC 10news for updates. 711

  

SAN DIEGO (KGTV) -- A woman was taken to the hospital after the car she was riding in -- which was believed to have been stolen -- struck a building and two parked vehicles in the El Cerrito area on Friday morning.San Diego police said the collision happened at around 5:15 a.m. in the 5800 block of El Cajon Boulevard.Witnesses told ABC 10News they saw a silver Honda Accord traveling at a high rate of speed, possibly reaching 100 MPH, when it lost control and collided with a building and parked cars, littering the area with debris and car parts.Responding emergency crews pulled a female from the wreckage and took her to the hospital. Police said the woman suffered a broken hip and deep laceration on the back of her leg.One witness said a man, believed to be the driver, was able to get out of the wrecked car and ran away from the scene. He was described as Black, in his 20s, wearing a black sweater and black pants.According to police, as officers and emergency crews responded to the crash, a man called 911 to report his car that was left running outside of a business on El Cajon Boulevard was stolen.Police told ABC 10News they believe the car in the crash was the same vehicle stolen a few blocks away. 1226
